ORDINANCE NO. 76-3
AN ORDINANCE REGULATING AND PRESCRIBING THE RATES TO BE CHARGED
FOR TELEPHONE SERVICE WITHIN THE CITY OF WYLIE~ PROVIDING AN
EFFECTIVE DATE OF RATES ~ PROVIDING CITY OF WYLIE SHALL HAVE THE
RIGHT TO REGULATE TELEPHONE SERVICE RENDERED TO CUSTOMERS IN
WYLIE AND PROVIDING A SEVERABILITY CLAUSE.
WHEREAS, the General Telephone Company of the Southwest has
presented information indicating that present revenues at Wylie
are not adequate~ and
WHEREAS, application has been made for relief from this
condition by an adjustment of its rates for extended area service~
and
WHEREAS, it is found by the City Council of the City of Wylie
that the rates and charges hereinafter set forth are fair and
reasonable and will enable General Telephone Company of the
Southwest to earn a fair rate of return on the fair value of its
property used and useful and devoted to rendering such services,
and that a high standard of service shall be continued hereafter
to the said citizens of Wylie during all times telephone service
is rendered to them by the General Telephone Company of the
Southwest, its successors and assigns.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WYLIE, TEXAS:
Section 1: That General Telephone Company of the Southwest
is hereby authorized to place into effect within the corporate
limits of the City of Wylie, on July 16, 1976, the following
schedule of rates for extended area telephone service provided
within its base rate area, the rates contained in its Wylie
Local Exchange Tariff for extended area telephone service
provided outside its base rate area, and such other charges and
rates for services listed in its Texas General Exchange Tariff,
as from time to time added to, deleted from, or in any manner
changed.

Section 2: That nothing in this ordinance contained shall
be construed in any manner, now or hereafter, as limiting,
enlarging or otherwise modifying the statutory right and power
of the City Council to lawfully regulate the rates charged by
the General Telephone Company of the Southwest for its service
within the City of Wylie, Texas, unless superseded by law.
Section 3: It is hereby declared to be the intention of
the City Council of the City of Wylie that the sections, paragraphs,
sentences, clauses and phrases of this Ordinance are severable
and if any phrase, sentence, paragraph, or section hereof should
be declared unconstitutional, such unconstitutionality or invalidity
shall not affect any of the remaining phrases, clauses, sentences,
paragraphs or sections of this Ordinance, since the same would
have been enacted by the City Council without the incorporation
in this Ordinance of any such unconstitutional or invalid phrase,
clause, sentence, paragraph or section.
