AN ORDINANCE AMENDING SECTION I-A OF ORDINANCE NO.
78-23, REGULATING THE CONSTRUCTION OF SIDEWALKS IN
WYLIE, TEXAS; PROVIDING FOR A LINE OF APPEAL FROM
ADMINISTRATIVE DECISIONS; PROVIDING FOR A PENALTY;
CONTAINING A SAVINGS CLAUSE AND PROVIDING FOR PUB-
LICATION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS:
SECTION 1. That Section I-A of Ordinance No. 78-23 is hereby amended
by the addition of the following sentence to the first paragraph: "\4hen field
conditions indicate a need for judicial review as to the requirement for side-
walks along side lot lines for corner lots, an appeal may be filed with the
City Board of Appeals, requesting a variance."
SECTION 2. All ordinances or parts of ordinances in conflict with any
of the provisions of this Ordinance are expressly repealed.
SECTION 3. Any person, firm, or corporation found guilty of a violation
of this ordinance shall be subject to a fine in any sum not to exceed Two Hun-
dred Dollars ($200.00).
SECTION 4. In the event any provlslon of this Ordinance shall be held
unconstitutional and invalid by a court of competent jurisdiction the same
shall not affect the remaining provisions hereof.
SECTION 5. This Ordinance shall be in full force from and after the
date of its enactment, and notice of such enactment shall be published one
time in the official publication of the City.
