Chair Jason Potts called the meeting to order at 6:30pm and announced the presence of a quorum. Board Members in attendance; Chair Jason Potts, Vice Chair Byron Betler, Board Member Andres Gonzalez and Board Member Shaun Chronister. Board Members absent: Board Member Lisa Shields, Board Member Dan Norris, and Board Member Robert Blair. Staff present were Mr. Jasen Haskins, Planning Manager, Mr. Kevin Molina, Senior Planner and Ms. Mary Bradley, Administrative Assistant. Board Action A motion was made by Board Member Gonzalez, and seconded by Vice Chair Betler, to approve the minutes as submitted. A vote was taken and carried 4— 0. Minutes March 16,2020 Zoning Board of Adjustment Page 1 REGULAR AGENDA Regular Item A. Consider and act upon adoption of Rules and Procedures for the Zoning Board of Adjustment to reflect changes to State law, City Ordinances, and other matters. Staff Comments Mr. Haskins stated that the City Charter, Article VIII, Section 3.F requires that all Boards and Commission have Rules and Procedures for operation. At the last meeting, a work session was held directing staff to prepare formal documents to adopt by the Board. City Secretary and City Council reviewed and approved the proposed amendments on March 10, 2020. Board Action A motion was made by Chair Potts, and seconded by Board Member Gonzalez, to adopt the Rules and Procedures for the Zoning Board of Adjustment. A vote was taken and carried 4 - 0. Public Hearing 1. Hold a public hearing to consider and act upon a request by Wylie Independent School District for a variance to Section 22-448 of the Sign Ordinance to allow for an increase of the width and area of a monument sign located at 2550 W FM 544. ZBA 2020-04 Staff Comments Mr. Molina stated that the applicant is seeking a variance to allow for a monument sign that exceeds the maximum allowed width of eight feet and maximum square footage of 96 feet for the placement of a school sign that measures approximately 23 feet in width and total square footage of 161 square feet. Public comment forms were mailed to 29 property owners. No comment forms were received in favor or in opposition of the request. Mr. Molina distributed an aerial of the site with the area for the proposed sign highlighted. The Board Members questioned the visibility. Staff responded that the sign is located closer to the building and may not be seen from FM 544. Public Comments Chair Potts opened the Public Hearing. With no one approaching the Board, Chair Potts closed the Public Hearing. ZBA 2020-05 Discussion Applicant: Linda Altier Owner: Linda Altier The subject property is located at 1500 Reagan Drive and is currently zoned within the Creekside Estates Planned Development(PD 1999-32). The applicant is seeking a variance to allow for the construction of an eight foot tall wooden fence in lieu of the maximum six feet allowed by the Planned Development. The applicant is requesting the variance as the extra height will provide additional screening from the adjacent rehabilitation center. While the City Ordinance allows for fence heights of eight feet, the property is limited to the six foot fence height by the Planned Development's design standards. The property owner has received an approval letter from the HOA regarding the requested eight foot height and they are supportive of the construction of the fence pending the approval of this variance. Public comment forms were mailed to nineteen (19)property owners within 200 feet of this request, as required by State Law. Three responses were received in favor and none received in opposition of the variance proposal. The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or Page 1 of 2 Page 2 of 2 ZBOA 2020-05 (6) Is based exclusively on findings of personal or financial hardship. In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions, the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions, the strict application of the development code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie. ZBA 2020-06 Discussion Applicant: Erick Castellanos Owner: Erick Castellanos The subject property is located at 1201 Maritime Lane and is currently zoned Single Family 10/24. The applicant is seeking a variance to allow for a 10' rear setback for the placement of an attached carport that measures 480 square feet. The 10' rear setback request is in lieu of the normally required 25' rear setback. Unique circumstances may exist due to the property being accessed from an alley behind the home. If approved, the carport will be placed on an existing driveway and accessed from the rear alley. Public comment forms were mailed to twenty-six (26) property owners within 200 feet of this request, as required by State Law. At the time of posting there were three responses received in favor and none in opposition of the variance proposal. The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. Page 1 of 2 Page 2 of 2 ZBOA 2020-06 In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions, the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions, the strict application of the development code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie. ZBA 2020-07 Discussion Applicant: H. Neil Matkin Owner: Collin County Community College District The subject property is located at 391 Country Club Rd and is currently zoned within the Business Government District. The applicant is seeking a variance to allow for a monument sign that exceeds the maximum allowed width of 8' and maximum square footage of 96' for the placement of two school signs with a maximum width of 33' and a maximum square footage of 264 square feet. A hardship may exist in this case due to the size of the applicant's property and building. Maximum monument sign sizes are determined based on average development sizes. The purpose is to reduce sign clutter and increase general visibility on those sizes. Larger developments generally are either; allowed larger multi-tenant signs, such as a multi-lot retail center; do not require large signs for advertising, such as an industrial park; or require a variance, such as is the case here. Public comment forms were mailed to thirty-two (32) property owners within 200 feet of this request, as required by State Law. At the time of posting there was one response in favor and none in opposition of the variance proposal. The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or Page 1 of 2 Page 2 of 2 ZBOA 2020-07 (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. In order to approve a request for a variance, the Zoning Board of Adjustments shall determined that the requests meets four of the following five criteria: (1) The proposed sign shall not adversely impact the adjacent property (visibility, size, location, etc.); (2) The proposed sign does not conflict with the spirit of this article, which is one of providing public safety, open space and air, preservation and enhancement of the appearance of the city and protection of property values; (3) The variance is needed due to restricted area, shape, topography or physical features that are unique to the property on which the proposed sign would be located; (4) The proposed sign is of a unique design or configuration.
