ZBA 2020-05 Staff Comments Mr. Molina stated that the subject property is located at 1500 Reagan Drive and is currently zoned within the Creekside Estates Planned Development Ordinance (PD 1999-32). The applicant is seeking a variance to allow for the construction of an eight foot tall wooden fence in lieu of the maximum six feet allowed by the Planned Development. Public comment forms were mailed to 19 property owners. Four responses were received in favor and none received in opposition of the request. One of the responses included a letter from the Homeowners Association approving the request for an eight foot fence. Jason Potts, Chair ATTEST: Mary Bradley Minutes May 18,2020 Zoning Board of Adjustment Page 4 Wylie Zoning Board of r )1 Adjustment o EE AGENDA REPORT Meeting Date: June 15, 2020 Item: 1 Department: Planning Case Number: 2020-08 Prepared By: Kevin Molina Project Location: 2000 N State Hwy 78 Date Prepared: June 02, 2020 Subdivision Name: Woodlake Village Addition Locator Map, Variance Exhibit, Exhibits: Notification Map Subject Hold a Public Hearing to consider and act upon a request by the City of Wylie for a variance to Section 22-448 of the Sign Ordinance to allow for an increase of the width of one monument sign located at 2000 N State Hwy 78. ZBA 2020-08 Discussion Applicant: Pouge Construction Owner: City of Wylie The subject property is located at 2000 N State Highway 78 and is currently zoned within the Commercial Corridor District. The applicant is seeking a variance to allow for a monument sign for the public safety building of the City of Wylie that exceeds the maximum allowed width of 8' for the placement of one monument sign with a maximum width of 11'. The proposed monument sign measures a total area of approximately 88 sqft. A hardship may exist in this case due to the size of the applicant's property and building. Maximum monument sign size regulations are designed for average development sizes. The purpose of the regulations are to reduce sign clutter and increase general visibility. Larger developments generally are either; allowed larger multi-tenant signs, such as a multi-lot retail center; do not require large signs for advertising, such as an industrial park; or require a variance, such as is the case here. Public comment forms were mailed to thirteen (13)property owners within 200 feet of this request, as required by State Law. At the time of posting there were no responses in favor or in opposition of the variance proposal. The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or Page 1 of 2 Page 2 of 2 ZBOA 2020-08 (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. In order to approve a request for a variance, the Zoning Board of Adjustments shall determined that the requests meets four of the following five criteria: (1) The proposed sign shall not adversely impact the adjacent property (visibility, size, location, etc.); (2) The proposed sign does not conflict with the spirit of this article, which is one of providing public safety, open space and air, preservation and enhancement of the appearance of the city and protection of property values; (3) The variance is needed due to restricted area, shape, topography or physical features that are unique to the property on which the proposed sign would be located; (4) The proposed sign is of a unique design or configuration. (5) That the demonstrable hardship is not self-imposed Approved By Initial Date Department Director JH June 10, 2020 Locator Map \ \ \ doo \ .•••• '10 ''''ii;'4.-.\ ''T,'>. /"/ VS",\'?/z \\ ---- _m__--- - —- >, CO 0 ") mm.m, .... u " 1, ,11 11 „vv--- 13----a--- .,- ---- v,.,- '..< „-- _,-- 444'' . 4 7410 v 414. ZBA 2020-09 Discussion Applicant: Teferi Abebe Owner: Teferi Abebe & Dagnaw Almaz The subject property is located at 227 Lake Travis Drive and is currently zoned Single Family 10/24. The applicant is seeking a variance to allow for a 5' side setback for the placement of an attached covered patio that measures 140 square feet. The 5' side setback request is in lieu of the normally required 10' side setback. Unique circumstances may exist due to the property not having a rear door entrance and instead having a side entrance. The covered patio is proposed to be placed where the existing side entrance and uncovered patio are located. Public comment forms were mailed to thirty-one (31) property owners within 200 feet of this request, as required by State Law. At the time of posting there was one (1) response received in favor and one (1)received in opposition of the variance proposal. The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. Page 1 of 2 Page 2 of 2 ZBOA 2020-09 In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions, the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions, the strict application of the development code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie. Marble St.. ZBA 2020-10 Discussion Applicant: LLQ Construction Owner: Toshiki Watson & Madoka Watson The subject property is located at 603 E. Marble Street and is currently zoned Single Family 10/24. The applicant is seeking a variance to allow for a 11' front setback and a 10' rear setback for the placement of a single family home. The 11' front setback request is in lieu of the normally required 25' front setback and the 10' rear setback request is in lieu of the normally required 25' rear setback. The applicant has made this request as they would like to maximize the area of the side yard and have it function as a rear yard for their home. A unique circumstance may exist in this case as the shape of the lot in relation to the street frontage is not typical. Most recent residential lots are designed to have the short edge of the lot along the street frontage. However, this lot was likely platted in the 1940's. Public comment forms were mailed to four-teen (14) property owners within 200 feet of this request, as required by State Law. At the time of posting there was one (1)response received in opposition of the variance proposal. The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or Page 1 of 2 Page 2 of 2 ZBOA 2020-10 (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions, the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions, the strict application of the development code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie.
