Chair Jason Potts called the meeting to order at 6:30pm and announced the presence of a quorum. Board Members in attendance; Chair Jason Potts, Vice Chair Byron Betler, Board Member Robert Blair, Board Member Andres Gonzalez, Board Member Lisa Shields, and Board Member Dan Norris. Board Members absent: Board Member Shaun Chronister. Staff present were Mr. Jasen Haskins, Planning Manager, Mr. Kevin Molina, Senior Planner and Ms. Tina Link, Deputy Secretary. Minutes June 15,2020 Zoning Board of Adjustment Page 1 REGULAR AGENDA Public Hearing 1. Hold a Public Hearing to consider and act upon a request by the City of Wylie for a variance to Section 22-448 of the Sign Ordinance to allow for an increase of the width of one monument sign located at 2000 N State Hwy 78. ZBA 2020-08 Staff Comments Mr. Molina stated that the subject property is located at 2000 N Hwy 78 and is currently zoned Commercial Corridor The applicant is seeking a variance to allow for a maximum width of 11' in lieu of a maximum width of eight feet for a monument sign. Public comment forms were mailed to 13 property owners. No responses were returned in favor or in opposition of the variance proposal. Board Discussion Board Members discussed the location and size of the sign and whether it was consistent with other Public Building signs. Staff's response to the requested variance width was that it was not dependent on the intended use but on the overall lot size. Public Comments Chair Potts opened the Public Hearing. No one spoke during the Public Hearing. Chair Potts closed the Public Hearing. Board Action A motion was made by Board Member Gonzalez, and seconded by Vice Chair Betler, to grant the variance to Section 22-448 of the Sign Ordinance to allow for an increase of the width of one monument sign. Hold a Public Hearing to consider and act upon a request by Teferi Abebe for a variance to Section 3.2.B of the Zoning Ordinance to allow for a side setback of 5' for the placement of an attached covered patio located at 227 Lake Travis. ZBA 2020-09 Minutes June 15,2020 Zoning Board of Adjustment Page 2 Staff Comments Mr. Molina stated that the property is located at 227 Lake Travis and is currently zoned Single Family 10/24. The applicant is seeking a variance to allow for a 5 foot side setback for the placement of an attached Patio cover that measures 140 square feet. The 5 foot side setback request is in lieu of the normally required 10 foot rear setback. The applicant requested for the cover patio to be allowed as his property has a side door and no rear door. The applicant is proposing to place the covered patio where the existing door is located. Public comment forms were mailed to 31 property owners. One response was received in favor and one in opposition of the request. Board Discussion Board members asked questions regarding the height and placement of the covered patio. Staff's response was that the covered patio would be visible from the right of way as it would be attached to the roof of the existing home. An aerial image of the subdivision showed that multiple households have covered patios with similar setbacks to what the applicant was requesting. Public Comments Chair Potts opened the Public Hearing. No one spoke during the Public Hearing. Chair Potts closed the Public Hearing. Board Action A motion was made by Vice Chair Betler, and seconded by Board Member Gonzales, to grant the variance to Section 3.2.B. of the Zoning Ordinance to allow for a side setback of 5 feet for the placement of an attached covered patio located at 227 Lake Travis Dr. A vote was taken and carried 5 —0. 3. Hold a Public Hearing to consider and act upon a request by Toshiki Watson for a variance to Section 3.2.B of the Zoning Ordinance to allow for a front setback of 11' and a rear setback of 10' for the placement of a new single family home located at 603 E. Marble Street. ZBA 2020-10 Staff Comments Mr. Molina stated that the applicant is seeking a variance to allow for a 11 foot front setback and 10 foot rear setback in lieu of the required 25 foot for the placement of a single family home. The lot was platted with the street frontage being wider than its depth. The applicant's request is to allow for the east side yard to function as a rear yard. Public comment forms were mailed to 14 property owners. One response was received in opposition and none in favor of the request. Board Discussion Board Members asked what was located adjacent to the subject property. Staff's response was that there was a parking lot on the east side, a single family home on the west side, and a restaurant on the north side. Public Comments Chair Potts opened the Public Hearing. Board Action A motion was made by Board Member Gonzales, and seconded by Board Member Blair, to grant the variance to Section 3.2.B of the Zoning Ordinance to allow for a front setback of 11 foot' and a rear setbacks of 10 foot for the placement of a new single family home located at 603 E Marble St. A vote was taken and carried 5 —0. Property located at 405 Elliot St. ZBA 2020-11 Discussion Applicant: Gary Langford Owner: Gary Langford The subject property is located at 405 Elliot St. and is currently zoned Single Family 10/24. The applicant is seeking a variance to allow for a 1' side and rear setback for the continued placement of an accessory structure that measures 72 square feet with a height of 8'. The 1' side and rear setback request is in lieu of the normally required 5' side and rear setbacks. Generally, setbacks for accessory structures are required to provide for maintenance of yards and fences. Public comment forms were mailed to thirty-two (32) property owners within 200 feet of this request, as required by State Law. At the time of posting one comment form was returned in favor and no comment form received in opposition of the variance proposal. Two comment forms was received after the meeting, both in favor. The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. Page 1 of 2 Page 2 of 2 ZBOA 2020-11 In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions, the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions, the strict application of the development code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie. ZBA 2020-12 Discussion Applicant: Russel Davis Owner: Russel Davis The subject property is located at 841 Crestview Lane and is currently zoned Single Family 10/24. The applicant is seeking a variance to allow for a combined area for accessory structures of 1,675 sf and to allow for a max height of 26' for the construction of a two story workshop that measures 1,595 square feet. The property contains an existing accessory structure that measures 80 sf. Generally, a maximum lot coverage is set to ensure that accessory structures do not overcrowd residential lots or overwhelm the primary structure on large lots. A maximum height is set in order to limit the appearance of accessory structure from adjacent residential lots. The 1,675 sf lot coverage request (62.8%) is in lieu of the maximum allowed 60% coverage of 1,599.6 sf. On a larger lot such as this, on nearly an acre, the 60% calculation is taken from a percentage of the main structure, in this case a residential home being 2,666 sf. The height of 26' is in lieu of the maximum allowed height of 14'. The total size of the lot measures approximately one acre. Public comment forms were mailed t fifteen (15) property owners within 200 feet of this request, as required ohree by State Law. At the time of posting two comment forms were received in favor and one comment form was received in opposition of the variance proposal. The applicant is seeking a variance to allow for a 10' rear setback and an increase in the allowed lot coverage of a carport to 6.1%. Generally, a maximum lot coverage is set to ensure that accessory structures do not overcrowd residential lots. A maximum rear setback of 20' is set for carports to ensure that vehicles do not occupy public access drives. The 10' rear setback request is in lieu of the required 20' rear setbacks and the 6.1% lot coverage is in lieu of the maximum allowed 5%. The applicant is requesting approval of these variances to place a 10' X 24' carport on an existing driveway. Public comment forms were mailed to twenty-nine (29) property owners within 200 feet of this request, as required by State Law. This inspection was conducted in order to certify that the steel carport had been constructed as per applicable building codes and per industry standards for steel construction. Upon inspection, the construction of the carport, comprised of 8" C-purlins roof joists and 4" 11 GA steel columns is per industry standard and meets applicable building codes. However, according to your information, a portion of the carport is constructed over the property building line. If a variance cannot be obtained allowing the construction of the"side bay" in the setback, the columns on this side can be removed and the roof structure "cantilevered" over the setback by welding 4" 11 GA struts that extend diagonally to "cut"the cantilever distance of 8'-0" in half(in other words, the struts would meet the roof at'/Z of the cantilever distance).
