Board Member Byron Betler called the meeting to order at 6:30pm and announced the presence of a quorum. Board Members in attendance; Board Member Byron Betler, Board Member Robert Blair, Board Member Richard Covington, and Board Member Andrew Wight. Board Members absent: Board Member Shaun Chronister, Board Member Lisa Shields and Board Member Lance Kiser. Staff present were Mr. Jasen Haskins, Planning Manager, Mr. Kevin Molina, Senior Planner and Ms. Mary Bradley, Administrative Assistant. Discussion Mr. Haskins gave a presentation on the duties and responsibilities of a Zoning Board of Adjustment Board Member. Hold a Public Hearing to consider and act upon a request by Gary Langford for a variance to Section 2.5.C.2(c) of the Zoning Ordinance to allow for a side and rear setback of 1' for the continued placement of an accessory structure. Property located at 405 Elliot St. ZBA 2020-11 Staff Comments Mr. Molina stated that the subject property is located at 405 Elliot Street and is currently zoned Single Family 10/24. The applicant is seeking a variance to allow for a one foot side and rear setback for the continued placement of an accessory structure that measures 72 square feet with a height of eight foot. Three comment forms were received (two responses after posting) all in favor and no comment forms received in opposition of the request. Board Discussion Board Members questioned the hardship. Applicant was not present, staff responded that the property already has a swimming pool and that the applicant had previously mentioned that the pool made them unable to place the accessory structure in the backyard. Public Comments Chair Betler opened the Public Hearing. No one spoke during the Public Hearing. Chair Betler closed the Public Hearing. Property located at 841 Crestview Lane. ZBA 2020-12 Staff Comments Mr. Molina stated that the property is located at 841 Crestview Lane and is currently zoned Single Family 10/24. The applicant is seeking a variance to allow for an increase in the allowed lot coverage of the combined area of accessory structures to 1,675 square feet and to allow for a maximum height of 26 feet for the placement of an accessory structure. The property contains two existing accessory structures, one measures 80 square feet, which will remain. The other one will be expanded as submitted. The allowed lot coverage is 60 percent and is taken from a percentage of the main structure of 2,666 square feet. The applicant is requesting 62.8 percent variance. The intention of the structure is for a two-story workshop that measures 1,595 square feet. Public comment foluis were mailed to 31 property owners. Four comment foluis were received (one after posting), three responses were in favor and one response in opposition of the request. Board Discussion Board Members questioned the status of existing accessory buildings. Mr. Russell Davis, applicant, 841 Crestview Lane, stated that the existing 80 square feet building will remain. Mr. Davis further stated that in response to the comment form in opposition, the accessory building will not have a kitchen, restroom, or plumbing. The accessory building will be used as a workshop and garage only. Most of the surrounding accessory structures are the same size or larger. All neighbors on the same street are in favor of the request. Board Members questioned if variances were granted for the surrounding properties having accessory structures. Staff stated that a portion of the existing accessory structures did receive variances. Public Comments Chair Betler opened the Public Hearing. No one spoke during the Public Hearing. Property located at 214 Cedar Ridge. ZBA 2020-13 Staff Comments Mr. Molina stated that the property is located at 214 Cedar Ridge and is currently zoned Single Family 10/24. Minutes July 20,2020 Zoning Board of Adjustment Page 4 The applicant is seeking a variance for an existing carport and to allow 10 foot rear setback and an increase in the allowed lot coverage of a carport of 6.1 percent. The 10 foot rear setback request is in lieu of the required 20 foot rear setback and the 6.1 percent lot coverage is in lieu of the maximum allowed 5 percent. The applicant is requesting approval of these variances to place a 10 foot by 24 foot carport on an existing driveway which is accessed from the alley. Public comment forms were mailed to 29 property owners. Eight comment forms were received (three after posting), all were in favor and none in opposition of the request. Public Comments Chair Betler opened the Public Hearing. Applicant chose not to speak. Mr. Ron Smith, 216 Cedar Ridge, adjacent property owner, spoke in favor of the carport, stating that the carport is well constructed and does not interfere with the traffic along the alleyway. Applicant: Roger Whan Owner: Dibello Family Interest Ltd The subject property is located at 807 Woodbridge Pkwy and is currently zoned within the Woodbridge Centre Planned Development, PD 2003-01. The applicant is seeking two variances to allow for two movement control pole signs with a max height of 8' and max width of 4'. The granting of this request would approve two variances being an increase in the 5' allowed square footage of a movement control sign to 20 sq ft with a max height of 8' and allowing for the signs to be held up by poles. The purpose of the signs is to give notice to parents and students of Wylie High School to not use Pet Supplies as a drop off or pickup site. The variance exhibit shows the proposed sign and placement of the two signs. The property currently contains six smaller signs that state a similar message. Over several days, staff inspected the site during school release and noticed that some parents and students use the Woodbridge Centre as a pickup area. There are existing signs at Pet Supplies to deter parents from using the Pet Supplies parking lot, which was not full at the observed times. However, this request is in response to some parents are using the side access drives as a pick up zone with students waiting on this property, among others. According to Wylie PD, stopping in a Fire Lane or access drive is not an enforceable offense. Additionally, during pick-up times, staff observed that vehicle stacking did not significantly affect traffic flow or access to the site. Page 1 of 2 Page 2 of 2 ZBOA 2020-14 Therefore, it is staff's opinion that the proposed signs are not in keeping with the aesthetic of the area, may create a dangerous situation due to reduced visibility, are a permanent long-term fixture for an issue that affects the property for a short amount of time, and have no legally enforceable standard. Public comment forms were mailed to six (6) property owners within 200 feet of this request, as required by State Law. At the time of posting there were no responses in favor or in opposition of the variance proposal. The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the fouiiulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. In order to approve a request for a variance, the Zoning Board of Adjustments shall determined that the requests meets four of the following five criteria: (1) The proposed sign shall not adversely impact the adjacent property (visibility, size, location, etc.); (2) The proposed sign does not conflict with the spirit of this article, which is one of providing public safety, open space and air,preservation and enhancement of the appearance of the city and protection of property values; (3) The variance is needed due to restricted area, shape, topography or physical features that are unique to the property on which the proposed sign would be located; (4) The proposed sign is of a unique design or configuration. Applicant: Jill Bresnan Owner: Jill Bresnan The subject property is located at 544 Industrial Park and is currently zoned Commercial Corridor. The applicant is proposing to renovate an existing restaurant with a drive-thru by removing its drive-thru aisle and converting it to a patio dining space. This change would increase the square footage of the restaurant by 1,299 sq. ft. and reclassify the restaurant use as one without a drive-thru. This changes the required parking ratio from 1 space for every 150 sq. ft. to 1 per 100. The applicant is proposing to renovate the site in 2 phases. Phase 1 includes the addition of a covered patio that measures 1,115 sf and the addition of 14 new parking spaces. After completion of phase 1 the building area of the site measures 4,601 sq.ft., requiring 47 parking spaces while providing 37 spaces. The applicant is requesting a temporary parking reduction of 10 spaces. Phase 2 includes the addition of 184 sq. ft. for 3 restrooms and a porch while providing 10 additional parking spaces. After completion of phase 2 the building area of the site will measure 4,785 sq.ft. and be required 48 parking spaces while providing 47 parking spaces. A permanent reduction of 1 parking space is being requested after completion of all renovations. A special circumstance may be apparent for this specific use as restaurants are not allowed to operate at full capacity due to the COVID-19 mandates by the state. While the mandates are not foreseen to be permanent the applicant's request for phase 1 is also not permanent and will mostly be addressed with phase 2 of the renovations. Therefore, if approved, the Phase 1 variance may include an expiration date. Public comment forms were mailed to nine (9) property owners within 200 feet of this request, as required by State Law. At the time of posting one comment form was returned in opposition and none in favor of the variance proposal. Page 1 of 2 Page 2 of 2 ZBOA 2020-15 The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the foiijiulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions, the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions, the strict application of the development code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie.
