Board Member Byron Betler called the meeting to order at 6:33pm and announced the presence of a quorum. Board Members in attendance; Board Member Byron Better, Board Member Robert Blair, Board Member Richard Covington, and Board Member Andrew Wight. Board Members absent: Board Member Shaun Chronister and Board Member Lance Kiser. Staff present were Mr. Jasen Haskins, Planning Manager, Mr. Kevin Molina, Senior Planner and Ms. Mary Bradley, Administrative Assistant. REGULAR AGENDA Minutes September 21,2020 Zoning Board of Adjustment Page 1 Public Hearing 1. Hold a Public Hearing to consider and act upon a request by Roger Whan for a variance to Section 22-444(7) & 22-445(6) of the Sign Ordinance to allow for the placement of two movement control pole signs with a max height of 8' and max width of 4'.Property located at 807 Woodbridge Parkway. ZBA 2020-14 Staff Comments Mr. Molina stated that the subject property is located at 807 Woodbridge Parkway. The applicant is seeking a variance to allow for two movement control pole signs with a maximum height of eight feet and maximum width of four feet. The purpose of the signs is to give notice to parents and students of the Wylie High School not to use Pet Supplies Plus access as a drop-off or pickup site. According to the Wylie Police Department stopping in a Fire lane or access drive is not an enforceable offense. Additionally, during pick-up times, staff observed that vehicle stacking did not significantly affect traffic flow or access to the site. Public comment foiius were mailed to six property owners. One comment form was received in favor and no comment forms received in opposition of the request. Board Discussion Mr. Brad Quine, Quine and Associates, Inc and Mr. Roger Whan, 2602 Lakeside Drive, McKinney, applicants for the request. Mr. Whan stated that the current school year is lighter than last year,parents use the access along the side of the building and in front of the building as a drop off for students. Board Members discussed different options for signs. Mr. Quine stated that an option considered to include towing will be enforced upon those dropping off students. Board Members encouraged applicants to communicate the concern with the Wylie Independent School District. Public Comments Chair Betler opened the Public Hearing. Board Action Minutes September 21,2020 Zoning Board of Adjustment Page 2 A motion was made by Board Member Newson, and seconded by Board Member Covington, to grant the variance to Section 22-445(6) of the Sign Ordinance to allow a maximum of two temporary "A Sandwich" type signs, not to exceed six feet in height nor 18 square feet per side, and to be placed during Pet Supplies Plus regular business hours on school days only. Property located at 807 Woodbridge Parkway. ZBA 2020-14. A vote was taken and carried 4—0. 2. Hold a Public Hearing to consider and act upon a request by Jill Bresnan for a variance to Section 5.1.F.21 of the Zoning Ordinance to allow for a reduction in required parking for a restaurant without drive-thru. Property located at 960 FM 544. ZBA 2020-15 Staff Comments Mr.Molina stated that the property is located at 960 W.FM 544 and is currently zoned Commercial Corridor. The applicant is proposing to renovate an existing restaurant with a drive-thru by removing its drive-thru aisle and converting it to a patio dining space. This change would increase the square footage of the restaurant by 1,299 square feet and reclassify the restaurant use as one without a drive-thru. The applicant is proposing to renovate the site in two phases. Phase I includes the addition of a covered patio that measures 1,115 square feet and the addition of 14 new parking spaces. Phase II includes the addition of 184 square feet and providing 10 additional parking spaces. Public comment foetus were mailed to nine property owners. One comment faun was received in favor and no comment forms received in opposition of the request. Board Discussion Ms. Jill Bresnan, Manager for Josephine's Neighborhood Bistro, stated that intent is to complete construction within 36 months. Board Members discussed with the applicant the location of the parking spaces and the renovation time frame. Board Members recommended that a total of 47 parking spaces and renovation be completed within 36 months. Public Comments Chair Betler opened the Public Hearing. Property located at 307 W Jackson Ave. ZBA 2020-16 Discussion Applicant: Blake Herperche Owner: Blake Herpeche The subject property is located at 307 W Jackson Ave. and is currently zoned in the Downtown Historic District. The applicant is proposing to construct an outside covered living space and carport that measures 936 sq.ft. The applicant is requesting a variance of 0.3% to allow for an increase in the total square footage of an accessory structure from 5% to 5.3%. The initial plans of the accessory structure were made taking into account Collin County records for the total size of the subject property. However it was discovered during the replatting of the property that the site was 1,081 sq.ft. smaller than what the county records identified. The discrepancy of the size of the subject property may be due to the widening of Brown St. This discrepancy left the designed accessory structure —53 sqft larger than allowed. All other design requirements such as height, setbacks and material will be in compliance with the regulations of the zoning ordinance. Public comment forms were mailed to six-teen (16)property owners within 200 feet of this request, as required by State Law. At the time of posting one comment form was returned in favor with none in opposition of the variance proposal. The Board shall not grant a variance to the development code which: (1) Peluuts a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or Page 1 of 2 Page 2 of 2 ZBOA 2020-16 (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the foitiiulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions, the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions, the strict application of the development code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie. Property located at 950 Park Blvd. ZBA 2020-17 Discussion Applicant: PBK Owner: Wylie Independent School District The subject property is located at 950 Park Blvd and is currently zoned in the Agricultural District (AG/30). The applicant is proposing to make additions to Davis Intermediate School and is requesting a variance due to an encroachment of 2'5" onto the required 50' front setback. A unique circumstance may exist in this case as schools are allowed in all zoning districts. Front setbacks of 50' in the agricultural district are typically in place for agricultural uses. It is more common for a 25' front setback to be required for schools, offices, and administrative buildings. Thus, if the structure were in any other zoning district within the City,it would be in compliance. Wylie East High School faces a similar situation and the Board granted a Variance in that case. On October 06, 2020 the Planning and Zoning Commission granted conditional approval of the site plan for the Davis Intermediate School additions pending the approval of this requested variance. Public comment forms were mailed to forty-five (45)property owners within 200 feet of this request, as required by State Law. At the time of posting no comment forms were returned in favor or in opposition of the variance proposal. The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or Page 1 of 2 Page 2 of 2 ZBOA 2020-17 (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship.
