Staff Presentation Mr. Molina stated that the applicant is proposing a 9,208 square foot addition and a new drop off canopy area. The property is located at 1100 McCreary Road and is zoned within Planned Development 1998-28 and the use is allowed by right. A preliminary plat and final plat is on the current agenda to reflect new and adjusted access, firelane, and utility easements. Property located at 950 Park Blvd. Staff Presentation Mr. Molina stated that the applicant is proposing a 9,924 square foot addition. The property is located 950 Park Boulevard and is zoned Agricultural AG/30 District and the use is allowed by right. The applicant is requesting for conditional approval, based upon. Section 3.1.A.3 of the Zoning Ordinance requiring a 50 feet front yard setback, and proposing a 48 feet 7 inches front yard setback. The variance for the front yard setback will be considered by the Zoning Board of Adjustment on October 19, 2020. The conditional approval is in compliance with Section 212.0091 of the Texas Local Government Code, and is pending approval from the The Zoning Board of Adjustment. Once approved by the Zoning Board of Adjustment, the Site Plan is approved. Board Action. A motion was made by Commissioner Riner, and seconded by Commissioner McCrossin to conditionally approve the Site Plan for Davis Intermediate School, on Lot 1, Block A of Wylie Junior High School Addition, on 44.889 acres, based upon front yard setback requirements within Section 3.1.A.3 of the Zoning Ordinance, and pending the approval of the variance to the Zoning Board of Adjustment meeting on October 19, 2020 for the front yard setback. (ZC2020-09) Staff Presentation Mr. Molina stated that the applicant is requesting to withdraw the item from consideration to pursue other financing options for the property. Public Comments Chair Plunk opened the Public Hearing. Mr. John Read, 106 Lyndhurst Drive, expressed concerns of the height, drainage and the tree line between his property and the subject property. Mr. Kenneth Carr, 104 Lyndhurst Drive, expressed concerns for drainage and questioned if a fence would be installed between the subject property and the adjacent properties. Chair Plunk closed the Public Hearing. Hold a Public Hearing, consider, and act upon a recommendation to City Council regarding a change of zoning from Neighborhood Services District (NS) to Neighborhood Services District Special Use Permit (NS-SUP), to allow for a convenience store with a motor fueling station on 1.056 acres, generally located on the northeast corner of Park Boulevard and Country Club Road. (ZC2020-11) Staff Presentation Mr. Molina stated that the applicant is requesting to rezone 1.056 acres located on the northeast corner of Country Club Road and Park Boulevard. The property is zoned Neighborhood Services, and the request is for Neighborhood Services with Special Use Permit. A Special Use Permit will allow for the development of a 4,000 square foot convenience store with fueling stations. Minutes October 6,2020 Planning&Zoning Page 4 In February 2020 the property owner applied for a similar zoning change. However, the difference between the proposed and initial request was to rezone the entire corner strip of 3.873 acres from Neighborhood Services to Community Retail. City Council denied that zoning request with a vote of 6 - 1. The proposed request is proposing to offer the sale of beer and wine within the convenience store. In order to meet the 300 feet distance requirement from Public School, the applicant is dedicating—450 square feet of land to Dodd Park, which was approved by the Parks Board. Public notifications were mailed to five property owners. One response was received in opposition and none received in opposition. Public Comments Chair Plunk opened the Public Hearing. Mr. Bill Thomas, Engineering Concepts and Design, 201 Windco Circle, represented the applicant, stated that the development will include a walk-in restaurant. A development agreement will be signed prior to plating of the property. Chair Plunk closed the Public Hearing. Board Action A motion was made by Vice Chair Rogers, and seconded by Commissioner Riner, to recommend approval to the City Council regarding a change of zoning from Neighborhood Services District (NS) to Neighborhood Services District Special. Use Permit (NS-SUP), to allow for a convenience store with a motor fueling station on 1.056 acres, generally located on the northeast corner of Park Boulevard and Country Club Road. (ZC2020-11). A vote was taken and carried 5 - 1, with Commissioner Ortiz voting in opposition. WORK SESSION 1. Hold a Work Session to discuss rescheduling of the November Planning and Zoning Meeting. Staff Presentation Mr. Haskins stated that with the elections on November 3, 2020, City Council will meet on November 17, 2020 instead of November 10, 2020. Staff is recommending moving the Planning and Zoning Meeting from November 3, 2020 to November 10, 2020. In addition,November 10th will be the only Planning and Zoning meeting in November.
