Those present besides Chairman Dennis Larson were; Vice-Chairman Phillip Johnston, Commissioner Willie Osborne, Commissioner John Manganilla, Commissioner Ruthie Wright and Commissioner Tim Bennett. Commissioner Ramona Kopchenko arrived late. Staff present was Renae 011ie, Planning Director, Charles H Lee, Senior Planner, Jasen Haskins, Assistant Planner, and Mary Bradley, Administrative Assistant, Shane Colley, Construction Manager. INVOCATION & PLEDGE OF ALLEGIANCE Commissioner Osborne gave the invocation and Vice Chairman Johnston led the pledge of allegiance. CITIZENS COMMENTS Chairman Larson opened the Citizens Participation. No one approached the Commissioners; Chairman Larson closed the Citizens Participation. CONSENT ITEMS 1. Consider and act upon approval of the Minutes from the November 4, 2008, Regular Meeting. A motion was made by Vice Chairman Johnston, and seconded by Commissioner Osborne, to approve the minutes from November 4, 2008 Regular Meeting, as submitted. Motion carried 6—0, with Commissioner Kopchenko absent. Minutes November 18, 2008 Wylie Planning and Zoning Board Page 1 of 4 Page 5 of 26 REGULAR AGENDA Action Agenda 1. Consider a recommendation to the City Council regarding a Final Plat creating six Light Industrial lots for Regency Business Park Phase III , generally located at the east end of Capital Street. Mr. Haskins stated that the applicant is New Heights Baptist Church, and the property is 7.097 acres. The Plat creates six lots with Light Industrial District zoning, however no Site Plan has been submitted at this time. The Preliminary Plat was approved by City Council in June 2008. The Final Plat conforms to the Preliminary Plat except for the relocation and width of an easement to the eastside of the property, which will be filed by a separate instrument. The filing of the easement will be completed before the Plat is considered by City Council. With no questions for the applicant or Staff, a motion was made by Vice-Chairman Johnston, and seconded by Commissioner Osborne, to recommend approval to the City Council for the Final Plat Regency Business Park Phase III, creating six Light Industrial lots. The property is generally located at the east end of Capital Street. Motion carried 6 —0, with Commissioner Kopchenko being absent. 2. Consider and act upon approval of a Site Plan for Wylie Civic Center Addition, Block A, Lot 1. Subject property being generally located on the southeast corner of E. Brown Street (F.M. 3412) and Country Club Boulevard(F.M. 1378). Mr. Lee stated that the applicant is the City of Wylie. The City is proposing a one story 44,231 square foot library, two-level 47,456 square foot recreation center and a 3-story 46,034 square foot city hall. The property is 19.674 acre site and is zoned Business Government(BG) District. Construction for temporary detour (bypass) of County Club Road's northbound lanes shall occur in the near future to accommodate timely construction of Civic Center site. Therefore, the primary and secondary entry onto site will be Country Club Road, approximately 700 hundred feet south of Brown Street intersection with secondary entry-point located along the temporary detour roadway (1,400 feet north of F.M. 544). In conformity with the City's Zoning Ordinance 348 parking spaces are being provided for the site. The building primary exterior along the front façade will be constructed of White Austin Stone. The side &rear elevations will consist of Red Clay-Tile exterior materials. Portions of the Library and Council Chambers exterior walls shall consist of an Accent Metal Panel system. Commissioner Kopchenko arrived at the meeting. Minutes November 18, 2008 Wylie Planning and Zoning Board Page 2 of 4 Page 6 of 26 The Preliminary Plat is on the current agenda for consideration. The Commissioners discussed in length the design of the building, and the adequacy of the parking. Staff explained the amount of money allocated within the 2005 Bond Program to the Commissioners and that the budget prevents re-design of the overall project. The parking is more than adequate for the use, however additional parking may be added to the property once the parks and amenities are designed. Commissioner Wright questioned the Wisteria plant, which is shown on the south side of the building, around the rain water harvesting tanks. Mark Scruggs, ArchiTexas, 1907 Marilla Street, Dallas, Texas, stated that the tanks which will collect the rainwater into metal tanks that have a stone base around them. There will be seven tanks total, which will be painted with high performance, and made out of recyclable materials. The height of the tanks graduate from seventeen feet around the City Hall, to nine feet around the Library, and the tanks are seventeen feet in diameter. The Wisteria plant will grow and cover the sides of the tank. The Wisteria plant will require maintenance, but it is environmentally good. Commissioner Kopchenko questioned the windows. Mr. Scruggs stated that due to the scale of the buildings the Site Plan does not truly depict the actual size of the windows. The windows are eighteen inches from the floor and go up at least seven feet, some windows are taller in parts of the building. There is a large overhang on the south side of the building, which will encourage community use. A motion was made by Vice Chairman Johnston, and seconded by Commissioner Bennett, to approve the Site Plan for Wylie Civic Center Addition, Block A, Lot 1 generally located on the southeast corner of E. Brown Street (FM 3412) and Country Club Boulevard (FM 1378). Motion carried 7—0. 3. Consider a recommendation to the City Council regarding a Preliminary Plat creating four (4) lots on 260.09 acres, generally located north of FM 544, south of FM 3412 (Brown Street), and east and west of FM 1378 (Country Club Drive). Mr. Lee stated that the property total 260.09 acres and creates and establishes four lots for the development of City Hall, Recreation Center and Library on Lot 1. The Site Plan for the City Hall, Recreation Center and Library was considered on the current agenda. Designated access points will be located off FM 1378 to include a divided entrance with one lane ingress to the subject property and two lanes of egress. Commissioner Bennett questioned the North Texas Water Municipal District easement directly under the building. Mr. Dave Littleton, Halff Associates, 1201 N. Bowser, Richardson, Texas, stated that the thirty foot easement is noted that the NTWMD easement will be abandoned by separate instrument. A motion was made by Commissioner Osborne, and seconded by Vice Chairman Johnston, to recommend approval to City Council for a Preliminary Plat Wylie Civic Center, establishing four (4) lots on 260.09 acres, generally located north of FM 544, south of FM 3412 (Brown Street), and east and west of FM 1378 (Country Club Drive). Recommendation Motion to approve a Site Plan for QuikTrip, on one lot, located on the north side of FM 544 approximately 1,337 feet west of Springwell Pkwy, subject to the conditions of items 1, and 2 as identified in the body of this report. Discussion The property totals 1.19 acres and is currently zoned Commercial Corridor(CC). The applicant is proposing one commercial building of 4,902 square feet on the 1.19 acre lot for a commercial (General Merchandise/Food Store less that 5,000 square feet and Motor Vehicle Fueling Station) use. The site plan, as presented, does not meet all the technical requirements of the City of Wylie, however due to real estate obligations the applicant is submitting the Site Plan to this Commission for conditional approval. The issues that necessitate the need for conditional approval are as follows: First, the applicant is proposing to build access improvements on the property directly to the east (Lot 1, Block A Williams Addition) of the site without ownership of that property. Secondly, the applicant has not yet acquired TxDOT approval for the eastern most curb cut that would provide a second access to both properties from FM 544. Lastly, the applicant has not yet filed the `separate instrument' that would be required to create the fire lane easement as shown on the property to the east. If conditionally approved, the applicant must provide the following two items prior to the issuance of any permits: 1 - A written statement from TxDOT approving the eastern most curb cut on FM 544. 2 — A filed document dedicating the Public Access and Fire Lane Easement by `Separate Instrument' on the Williams Addition to the City of Wylie. In addition, the site does not technically comply with the offset or parking requirements of the Zoning Ordinance, however, in regards to these two items staff feels that the intent of the Ordinance is met in both cases. The applicant has provided 24 marked parking spaces yet the Ordinance calls for 25 based on the General Merchandise or Food store use and size of the building. In addition, the current Zoning Ordinance requires a minimum of 4 parking spaces for stand alone Motor Vehicle Fueling Stations together with automatic car wash Page 1 of 1 Page 9 of 26 Page 2 of 2 facilities. The proposed use is a combination of the two separate uses as listed in Article 5, Section 5.2.F.13 & 17, but does not include a car wash facility. Staff feels that the intent is met because the site also includes sixteen fuel pumps that would provide `parking spaces' by customers buying fuel in addition to using the convenience store. The Zoning Ordinance also requires four feet of offset over 25% of the building façade. This building does not provide this to the letter. However, the applicant has provided several smaller articulations across the façade and a large awning to provide architectural variation, which is the stated purpose of the required offset. The replat for this property is also on the agenda for the Commissions consideration. In summary, this Site Plan does not currently meet all the requirements of the Zoning Ordinance. While, staff believes the intent of the Ordinance is met in regards to the parking and the architectural elements, this Plan should receive only conditional approval, based on the need of additional documentation, if this Commission elects to offer approval to facilitate the applicants request for an approved Site Plan due to real estate considerations. Subject property being generally located on the north side of FM 544 approximately 1,337 feet west of Springwell Pkwy. Recommendation Motion to recommend approval to the City Council for a Replat creating two commercial/retail lots for the QT Eight Hundred Ninety Four Addition. Discussion The property totals 3.6137 acres and would create two commercial/retail lots of 2.4206 and 1.1931 acres. The property is zoned Commercial Corridor (CC) District and was originally plated as 'Moss Addition' in January 1993, which also included a tract immediately to the west (Lot 2, Block 1). That property was replatted as `Children's Lighthouse' in February 2007. This replat further subdivides the original Lot 1, Block 1 into two separate lots. This plat creates a fire lane and cross access easement between the two lots, including an easement that includes a small portion of Lot 1, Block A of the `Williams Addition' to the east. The site plan, as presented, does not meet all the technical requirements of the City of Wylie. First, the applicant is proposing to construct drive improvements on the property directly to the east (Lot 1, Block A Williams Addition) of the site without ownership of that property. Secondly, the applicant has not yet acquired TxDOT approval for the eastern most curb cut that would provide a second access to both properties from FM 544. Lastly, the applicant has not yet filed the `separate instrument' that would be required to create the fire lane easement as shown on the property to the east. The applicant has agreed to provide the following two items by this meeting or request that the item by tabled until the December 16th, 2008 meeting. 1 - A written statement from TxDOT approving the eastern most curb cut. 2—The `Separate Instrument' creating the fire lane easement on the Williams Addition. ZC 2008-12 Discussion "There's a great big electricity source up in the sky. Wind. It's free, non-polluting, and endless". With the rising cost of energy everyone is looking for alternative sources of energy. Residential Power Appliances (RPA) is that alternative. Small wind powered electric systems sized for homes, farms and small businesses as an industry has experienced major growth in the past decade. Skystream 3.7 is a new generation of RPAs that will change the energy landscape of how homes and small businesses receive electricity. Consideration In an effort to provide for alternative renewable energy, staff is proposing solar and wind powered sources as a means of providing alternative energy sources to the residents within Wylie, and to allow safe, effective and efficient use of such systems. A wind turbine as they are sometimes called is a machine designed to convert kinetic energy in the wind to mechanical or electrical energy, for the primary purpose of on-site use and not for resale or transmission off-site. Wind energy conversion systems include a tower and all directly connected facilities and associated control equipment, but not including any wired connections stemming from the tower. The proposed amendment would allow wind turbines in all districts based on specific regulations and would be classified as an accessory structure. The proposed text amendment would limit the height of such structures as well as clearly define the design and permitting requirements. Height requirements shall be no more than 60' within residential districts and 100' in commercial districts. The ordinance regulates the setbacks for windmills/turbines as at least 125% of the tower's height Page 1 of 2 Page 19 of 26 Page 2 of 2 The Ordinance will set forth the design requirements of wind powered systems within Residential and Commercially zoned district to be limited to 5kw of peak power output; and 25kw peak power output within Industrial Zoned districts. All wind powered systems are limited to 60dB at any point along the property line. The Ordinance will further outline the submittal process required to obtain a permit to construct all wind powered systems. In addition to making application for a building permit for a Wind Powered System a site plan along with elevations shall also be submitted to the Planning Department. A property owner with a valid permit to operate a wind powered system must submit to the Building Inspection Department a bi-annual letter prepared by a Professional Engineer registered in the State of Texas, stating that the wind powered system continues to meets current electrical and structural requirements as set forth in this Ordinance. Any owner's permitted wind turbine that becomes inoperable for six(6)months will be notified by the Code Enforcement Department that the owner has three(3)months from the notice date to restore or remove the system. Although the state does not have a program at this time that provides funding of renewable energy equipment on an individual basis, there are tax exemptions available in certain instances. For example businesses that either use or manufacture or install wind energy generators can receive franchise tax deductions and/or exemptions. There also exists a property tax exemption involving wind energy generation for business installation or for the construction of such systems.
