Ordinance 1978-23 , ~ ORDINANCE # 78-23 AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, REGULATING THE CON- STRUCTION OF SIDEWALKS AND DRIVEWAY APPROACHES PROVIDING SPEC- IFICATIONS FOR SIDEWALKS AND DRIVEWAY APPROACHES, REQUIRING A PERMIT AND FEE, PROVIDING FOR PENALTIES FOR THE VIOLATION OF THIS ORDINANCE, AND PROVIDING FOR THE PUBLICATION OF THE CAP- TION HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1. A sidewalk shall be defined as that paved portion of a street between the curb lines or the edge of pavement of a roadway and the adjacent property lines for the use of pedes- trians. These sidewalks shall conform to the following standands: A. General Requirements: Concrete sidewalks shall be re- quired and shall have a minimum thickness of four (4) inches. In residential areas (single family, two family and multi-family) sidewalks shall be four (4) feet in width and located within the right-of-way 1 foot from the property line unless field conditions dictate otherwise, and shall extend along the street frontage in- cluding the side of corner lots and block ends. If it should be necessary to construct the walk adjacent to the curb line, the walk shall be a minumum of five (5) feet in width, as per require- ments of Section 9-14-7, Ordinance #71-11. In all uses other than residential, light industrial or heavy industrial, where sidewalks are required, they shall be six (6) feet in width and adjacent to the curb line. B. Concrete Specifications: Concrete for walks shall have a minmum compressive strength of twenty-five hundred (2500) pounds per square inch at twenty-eight (28) days, reinforced with 6" X 6"X #10X #10 steel mesh. The quantity of mixing water shall not exceed seven (7) U.S. gallons per sack (94 lbs.) of Portland ce- ment. The slump of the concrete shall not exceed four (4) inches. A minimum cement content of 4.5 sacks of cement per cubic yard of concrete is required. C. Placement: The Building Official shall inspect the forms before concrete is poured. Concrete shall be free from honey-comb- ing, rock pockets and segregation of ingredients. The addition of heat cement to concrete in order to absorb excess water to acceler- ate hardening is prohibited. D. Forms: Forms shall be set to provide for drainage from the property line to the curb line; the slope in general will be one fourth (~) inch per foot of width of sidewalk. Elevation of walk will be one (1) inch above the curb. E. Joints: One-half (~) inch expansion joints shall be spaced at twenty-four (24) foot intervals or as otherwise specified. Where new work abuts driveways, pavement, curbs, or any other work, ex- pansion joints shall be filled with premoulded bituminous expan- ion joint filler or redwood at least one-inch thick and shall ex- tend the entire depth and width of the concrete section. Sidewalk markings shall be grooved three-eights (3/8) inch deep on four (4) foot centers. F. Finish: The surface may have a monolithic finish by floating with a wooden float until a slight excess of sand appears on the surface or may be brushed after troweling in lieu of float- ing. In no case shall the surface be left slick or with a glossy finish. The edges of the sidewalk, markings, and expansion joints shall be tooled to a smooth finish not less than two (2) inches in width. Exposed edges of the sidewalk shall be rounded with an edger to a radius of one-half (~) inch. SECTION 2. A driveway approach shall be defined as the paved por- tion of a driveway intended for vehicular traffic, and running from the street curb line or edge of paving to the property line. These driveway approaches shall conform to the following standards: A. General Requirements: Reinforced concrete driveway ap- proaches shall be required and shall be a minimum of six (6) inch- es thick. B. Concrete Specifications: Concrete for driveway approaches shall have a minimum compressive strength of 2500 psi in 28 days and a minimum cement factor of 5.0. C. Reinforcing Steel: Reinforcing steel shall be No.3 (3/8 inch nominal diameter) deformed bars, shall be placed on twenty- four (24) inch centers each way in the approach, and shall be lap spliced to existing steel exposed in the existing concrete pave- ment. Welded wire fabric of No. 10 wire on six (6) inch centers each way may be used in lieu of the steel bars. Reinforcing shall be properly supported to assure it will remain at mid-depth of the slab after placing of the concrete. D. Removing Existing Pavement: All existing concrete pave- ment shall be removed by first sawing a groove at least one (1) inch in depth along the proposed break line. Said break line shall lie one (1) foot into the street from the existing face of curb and shall run between the points of curb return for the approach. After the initial saw cut has been made, the pavement and curb may be removed by use of pneumatic equipment. Care shall be ex- ercised to expose the existing reinforcing steel for lap splic- ing to driveway reinforcing, concrete driveways for rear entry garages shall have an expansion joint as required for sidewalks in Section 2E, where abutting to alley pavement. E. Construction Methods: The subgrade shall be excavated and shaped to line and grade in cross section and if considered necessary tamped and sprinkled. The subgrade shall be moist at the time the concrete is placed. Forms shall be of wood or metal, straight, free from warp and of a depth equal to the thickness of the finished work. They shall be securely staked to line and grade and maintained in a true position during the depositing of con- crete. The reinforcing steel shall be placed in position and care shall be exercised to keep all steel in its proper location. F. Connection to Asphalt Pavement: When connecting a drive- way approach to asphalt street paving, the concrete shall be se- perated from the edge of the existing pavement by an eighteen (18) inch strip of hot mixed asphaltic concrete at least six (6) inches in depth. All other applicable requirements listed above concern- ing concrete and reinforcing steel shall remain in effect. G. Texas Highway Department: All driveway approaches con- necting to existing roads which are a part of the State Highway System will require a permit from that organization in additon to those required by this ordinance. Such permit shall be applied for through the City of Wylie, City Manager's Office. SECTION 3. That to obtain a permit as required by this ordinance, the contractor or his authorized representative shall file with the Building Official an application in writing therefore on a form to be furnished for that purpose. This permit shall be re- quired when constructinga new building in either a new subdivi- sion or existing subdivision not already having sidewalks or drive- ways. Such contractor shall be registered with the Building Of- ficial. Each application for a permit shall describe the abutting property adjacent to which the proposed work on public property is to be done, either by lot, block or tract and house number, loca- tion on the street or similar description which will readily iden- tify and definitely locate the site of proposed work, unless de- tailed on plat in conjunction with Section ld, Ordinance #74-15. Each applicant shall give such other pertinent information as re- quired by this Building Official. SECTION 4. Any person desiring a permit required by this Ordinance shall at the time of filing an application therefore, pay a fee of four dollars ($4.00). SECTION 5. Any person, firm, company, partnership, corporation or association violating any provision of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof, shall be subject to a fine in any sum not to exceed Two Hundred Dollars ($200.00). SECTION 6. That this Ordinance shall become effective immediate- ly upon its passage and publication as provided by law.
