Ordinance 1981-01 ORDINANCE NO. 81-1 AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, ADOPTING THE NATIONAL ELECTRICAL CODE, 1981 EDITION, OF THE NATIONAL FIRE PROTECTION ASSOCIATION, WITH AMENDMENTS, SO AS TO PROVIDE FOR RULES AND REGULATIONS FOR THE INSTALLATION AND REPAIR OF ELECTRICAL WIRING, CONDUCTORS, EQUIPMENT AND APPLIANCES WITHIN THE CITY: PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; PROVIDING A SEVERABILITY CLAUSE; REPEALING ALL ORDINANCES IN CONFLICT; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1. That the National Electrical Code, 1981 Edition, of the National Fire Protection Association, as amended hereby, be, and the same is hereby, adopted as the Electrical Code of the City of Wylie, Texas. A true and correct copy of the National Electrical Code, 1981 Edition, is attached hereto as Exhibit "A" and made a part hereof for all purposes. A copy of such Code will be kept in the office of the City Secretary of the City of Wylie and available for public inspection at all times during regular business hours. SECTION 2. All Ordinances of the City of Wylie in conflict with any of the provisions hereof or of the National Electrical Code, 1981 Edition, are hereby repealed. SECTION 3. That the National Electrical Code, 1981 Edition, be, and the same is hereby, amended by adding thereto the following sections, which shall read as follows, and shall take precedence over any provision to the contrary, to wit: A. Homeowners may take out electrical permits on residences only when: (1) Homeowner does the electrical work himself. (2) The work must be permitted, inspected, and approved by the City. (3) Persons other than the homeowner shall not be permitted or entitled to engage in any electrical work under such homeowner permit. B. Schedule 40 P.V.C. may be used as underground conduit, but rigid metallic conduit must be used within or passing through any concrete foundation. C. Service entrance wire will be copper and will be sized in accordance to the rating of bus bar in the panel. The nipple from panel to meter will be sized by the wire used on the service entrance. No aluminum wire may be used inside residences. D. All disconnect switches for air conditioning compressor units will be a minimum of 24" above final grade. E. All underground riser conduit must be no less than 2" pipe either schedule 80 P.V.C. or rigid metallic pipe. F. All outlets set in masonry will have a protective covering over the wire and a metal box set in the masonry. If the box is the full depth of the masonry the protective covering over the wire will not be required. G. All mast kits will have a minumum of 2" rigid metallic conduit riser and will have a 2" hub minimum. This riser will be secured to the building so as to not cause damage to service or building. H. Any person found doing electrical work for which a permit is required will be given 24 hours to secure a permit. Any person who is issued a permit under such circumstance will be charged double the regular permit fee. If a person fails to timely acquire a per- mit three times within anyone year period he will be subject to the penalty provided in this ordinance. I. All meter bases must be secured to the structure which they serve. The meter base must be anchored in a way in which the base is self-supporting. No meter will be less than 61 above the finished grade of lot, measured from the center of the meter. J. Temporary electrical services over 1001 from a structure will be built as follows: (1) Overhead service poles will not be less than 4" in diameter, creosote 141 in length, not less than 31 in the ground; wire will be 4/3 Triplex. (2) There will be a disconnect on every supply location. (3) Wire will be 4/3 Triplex. (4) Contractor will be responsible for service maintenance. (5) Underground wire will be of a size to accommodate demand with 18" minimum depth. (6) Supply points will have a disconnect and wire will be protected as the wire leaves the ground. (7) Pole will be braced and outlets minimum of 36" above the ground. K. The sleeve material for the air conditioning compressor wire from disconnect to compressor must be either liquid tight flexible conduit or standard conduit pipe with a ~" minimum size. L. The minimum size wire for connection for any temporary pole wi 11 be #8. M. Metal conduit will be required on all commercial building con- struction. N. Double grounding will be required on every electrical service. A driven ground rod will be required at electrical rough and must be a concealed type ground wire. An exposed ground wire will be required at the water heater. A ground rod, a minimum ~" copper, must have a minimum penetration of 4' . O. No more than 6 openings will be permitted on any kitchen appli- ance circuit, and no less than 2 circuits will be provided per kitchen. P. Commercial and industrial lighting circuits will be figured on a basis of 1~ amps per opening. L. On residential lighting circuits, a maximum of ten openings will be allowed on one, 15 amp. circuit. G. Electrical metallic tubing (E.M.T.) will not be allowed under any slab. E.M.T. will be allowed for a service riser only if it is under no stress and is properly attached to the side of the structure. R. No ground fault protection shall be required. SECTION 4. Should any section, paragraph, sentence, clause or phrase of this Ordinance be held or declared to be unconstitutional or invalid for any reason, such declaration shall not affect the remaining portions of this Ordinance, which are declared to be severable. SECTION 5. Any person, firm or corporation violating any of the provisions of this Ordinance, or of the National Electrical Code, 1981 Edition, as amended, shall be deemed guilty of a misdemeanor and, upon conviction in the Municipal Court of the City of Wylie, shall be subject to a fine not to exceed the sum of Two Hundred Dollars ($200.00) for each offense and each and every day such violation shall continue shall be deemed to constitute a separate offense. SECTION 6. This Ordinance shall take effect on July 1, 1981. The caption of this Ordinance shall be published once.
