AN ORDINANCE AMENDING ORDINANCE #78-28 AS AMENDED BY ORDINANCE #79-24.
PRESCRIBING SOLID WASTE COLLECTION AND DISPOSAL RATES IN AND FOR THE
CITY OF WYLIE. TEXAS; REGULATING SOLID WASTE DISPOSAL BY NON-RESIDENTS
AND COMMERCIAL USERS OF THE CITY SANITARY LANDFILL DISPOSAL SITE; RE-
PEALING ALL ORDINANCES OR PARTS THEREOF IN CONFLICT HEREWITH; CONTAIN-
ING A SEVERABILITY CLAUSE; PROVIDING A PENALTY FOR VIOLATIONS; DECLARING
AN EMERGENCY AND AN EFFECTIVE DATE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE. TEXAS:
SECTION 1. COLLECTION AND DISPOSAL RATES. Each premise within the
Corporate limits of the City of Wylie served from the public water
supply shall be charged for solid waste collection and removal; except
those in Commercial Class IV or special rate as set by the City Mana-
ger or his designee. at the following prescribed rates:
A. The fee for collection of solid waste from residential
premi ses. churches. lodges. mobile homes (per trail er) .
apartments (per unit) and duplexes (per unit) shall be
$5.00 per month.
B. COMMERCIAL RATES. Each commercial premise shall be
charged according to the class as determined by the
City Manager or his designee and the number of recep-
tacles based upon the following:

SECTION 2. DISPOSAL RATES. Use of the City Sanitary Landfill dis-
posal site by private persons. firms. or corporations:
A. All non-commercial residents of the City of Wylie may
dispose of solid waste at the sanitary landfill for a
charge of $1.25 upon presentation of their current
month I s water bi 11 or recei pt of depos it for water ser-
vice. or pay according to the schedule set forth in
Section 2 C.
B. All resident commercial users of the sanitary landfill
disposal site will be required to pay fees as follows:

per pickup load $3.50 (without side boards)
pickups (with side boards) $6.50
small. two wheel trailers $6.50 per load
twelve foot two wheel trailer $10.00 per load
fourteen foot two wheel trailer $12.50 per load
sixteen foot two wheel trailer $15.00 per load
fifty-five gallon barrels $3.50 each
trucks and trailers sixteen feet or longer and
eight feet wide with side boards $1.00 per cubic
yard for un-compacted solid waste.
C. All non-residents and commercial haulers wishing to use
the City sanitary landfill site will be required to pay
according to the following schedule:
passenger cars and station wagons. $5.00 per load
pickups with no side boards. $10.00 per load.
commercial haulers with vehicles larger than pickups
will be required to purchase a permit at $35.00 per
month payable in advance. plus a charge to be billed
monthly calculated at $1.50 per cubic yard.
D. All non-residents who deposit junk. such as inoperable
refrigerators. stoves. air conditioners. or barrels of
up to 55 gallons. will be required to apy $6.00 per item.
SECTION 3. SEVERABILITY. All provisions of any ordinance in conflict
herewith are hereby repealed insofar as it affects only that portion
described herein.
SECTION 4. VALIDITY. If any section. paragraph. subdivision. clause.
phrase or provision of this ordinance shall be adjudged invalid or held
unconstitutional. the same shall not effect the validity of this ordi-
nance as a whole or any part or provisions thereof other that the part
so decided to be invalid or unconstitutional.
SECTION 5. Any person. firm or corporation or other entity who violates
any provision of this ordinance shall be deemed guilty of a misdemeanor
and upon conviction of any such violation. shall be subject to a fine
of not less than one dollar ($1.00) nor more than two hundred dollars
($200.00) .
SECTION 6. The fact that the collection and disposal of trash. garbage.
rubbage. or other solid waste is essential to the public health. safety.

and welfare creates an emergency and requires that this ordinance take
effect immediately after its passage. ~
