Ordinance 1981-06 ORDINANCE # 81-6 AN ORDINANCE AMENDING ORDINANCE #79-24, SECTION IB BY THE ADDITION OF COMMERCIAL CLASS V ; PRESCRIBING REFUSE COLLECTION AND DISPOSAL RATES FOR THOSE CUSTOMERS OF THE CITY WHO UTILIZE THE COMMERCIAL TRASH BINS WITHIN THE CITY OF WYLIE, TEXAS; PROVIDING FOR A PENALTY; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; DECLARING AN EMERGENCY AND AN EFFECTIVE DATE. WHEREAS, the City of Wylie finds it necessary and desirable to install and utilize commercial trash bins in the collection of solid waste from various commercial firms within the City of Wylie, and WHEREAS, it is necessary to charge a separate rate for the collection and disposal of solid waste from these commercial trash bins; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1. That Section IB of Ordinance #79-24 be amended by the addition of a Commercial Class V which will include the commercial customers who utilize the large metal two and three cubic yard trash containers. The following schedule of services and charges will be charged for the use of these commercial trash bins: 2 CUBIC YARD CONTAINERS Services Monthly per week Service Charge 1 $22.00 2 40.00 3 58.00 4 77 .00 5 95.00 ORDINANCE # 81-6 3 CUBIC YARD CONTAINERS Services Monthly per week Service Charge 1 2 $ 25.00 45.00 3 66.00 4 5 86.00 106.00 The City will collect a deposit for each commercial trash bin equal to the monthly charge for that specific commercial trash bin in the location where it is to be used. In effect, the customer will pay the first and last month of service charges for the commercial trash bin at the time it is installed. SECTION 2. PENALTY. Any unauthorized person, firm, corporation or other entity who is found guilty of pilfering, vandalizing, taking materials from or adding materials to or causing fires to be set in commercial trash bins, or who in any way violates the terms of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction of any such violation, shall be subject to a fine of not less that $1.00 nor more than $200.00. SECTION 3. All ordinances or parts of the ordinances in conflict herewith are specifically repealed and are superseded by this ordinance. SECTION 4. The fact that the collection and disposal of trash and other solid waste is essential to the public health, safety, and welfare creates an emergency and requires that this ordinance take effect on July 1, 1981.
