ORDINANCE # 82-2
AN ORDINANCE DISCONTINUING THE PROPERTY COMMONLY REFERRED TO AS THE
BIRMINGHAf1 TRUST LAND; SUPERS:EDING ORDINANCE #81-8; INVOKING THE
AUTHORITY UNDER ARTICLE 973,VTCS; PROVIDING FOR THE PUBLICATION OF
THIS ORDINANCE AND FOR THE RECORDING THEREOF WITH THE COUNTY CLERK;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, it has come to the attention of the Wylie City Council that,
inadvertently, the Council has illegally annexed the Birmingham Trust
Land, do to a procedural error, and
WHEREAS, this City Council is pledged to do its utmost to comply with
all laws of the State of Texas and of the United States of America,
NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS:
Section 1. That the following described property, commonly referred
to as the Birmingham Trust Land, to wit:
Being a tract of land located in Collin County, Texas located
on the east side of Farm Road 1378 and on the north side of
Farm Road 544 and comprised on eleven contiguous and adjacent
tracts of land, currently described as the Birmingham Trust
Land, and more particularly described as Parcel #3, 47.5525
acres; Parcel #4,47.6806 acres; Parcel #5,47.8523 acres;
Parcel #6, 49.0532 acres; Parcel #7, 49.2918 acres; Parcel #8,
53.0066 acres. The beforementioned tracts of land numbers
3 through 8 all face on FM1378. Also included are: Tract #11,
33.0652 acres; Tract #12, 94.5631 acres; Tract #13, 83.7226 acres;
Tract #14, 85.5978 acres; and Tract #15, 82.8682 acres. Tracts
number 11 through 15 face on FM544.
All of the contiguous land above described, containing a total of
674.2539 acres, is hereby discontinued and deannexed from the City
limits of the City of Wylie.
Section 2. The above described land is discontinued from the City
limits of the City of Wylie and the original City limits are retained
as they were prior to the annexation of the Birmingham Trust Land,
under the authority of Article 973, Vernon's Texas Civil Statutes.
Section 3. That a certified copy of this ordinance be published in
the Wylie Daily News, and a second certified copy be placed of record
at the County Clerk's office.
Section 4. That this ordinance shall take effect immediately upon
its adoption.
