Ordinance 1982-14 ORDINANCE # 82-14 AN ORDINANCE REGULATING GARAGE SALES WITHIN THE CITY OF WYLIE, TEXAS; STIPU- LATING CONDITIONS UNDER WHICH GARAGE SALES MAY BE CONDUCTED; PROVIDING A PENALTY FOR VIOLATION OF THIS ORDINANCE; PROVIDING A SAVINGS CLAUSE; AND PRO- VIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1. Garages sales, yard sales, front porch sales, or other sales which may by conducted by a property owner or tenant of residential property within the City limits of Wylie, Texas shall be conducted on a temporary basis and are hereby authorized only in compliance with this ordinance. SECTION 2. A garage sale or a temporary sale (temporary, occassional sale of personal property) is defined as each of one or two sales of tangible property at retail for a period not to exceed four consecutive days in length for each sale during any twelve month period carried on at a home or residence by a person who is not by such person held out as engaging in or who does not habitua Hy engage in the business of se 11 i ng such tangi b 1 e personal property at retail and who does not carryon such sales in such a manner as to create a disturbance or become a nuisance in the neighborhood and only so long as such person in selling only personal property that belongs to such person personally and has not been purchased for purpose of re-sale. To emphasize, a per- son may not conduct more than two garage sales per year and each garage sale must be limited to a period not exceeding four consecutive calendar days in length. SECTION 4. Any person, firm or corporation found guilty of violating the terms of this ordinance shall be assessed a penalty not to exceed $200.00. Each day upon which violations of this ordinance continue shall be considered as a separate offense. SECTION 5. If, for any reason, a phrase, clause, sentence, or section of this ordinance shall be held by court of competent jurisdiction to be invalid, the remaining sections, sentences, phrases and clauses shall remain in effect.
