Ordinance 1983-03 I ...1 ORDINANCE 83-3 AN ORDINANCE ANNEXING THE HEREINAFTER DESCRIBED TERRITORY TO THE CITY OF WYLIE, COLLIN COUNTY, TEXAS, AND EXTENDING THE BOUNDARY LIMITS OF SAID CITY, GRANTING TO SAID TERRITORY AND TO ALL PRESENT AND FUTURE INHABITANTS OF SAID PROPERTY ALL OF THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS AND BINDING SAID PRESENT AND FUTURE INHABITANTS BY ALL OF THE ACTS AND ORDINANCES OF SAID CITY. WHEREAS, a petition for annexation has been duly signed and acknowledged by each member of the Board of Trustees of the Birmingham Land Trust having an interest in the following described territory, to-wit: Being a tract of land located in Collin County, Texas, located on the east side of Farm Road 1378 and on the north side of Farm Road 3412 (544) and comprised of eleven contiguous and adjacent tracts of land, currently described as the Birmingham Trust Land, and more particularly described as Parcel #3, 47.5525 acres; Parcel #4, 47.6806 acres; Parcel #5, 47.8523 acres; Parcel #6, 49.0532 acres; Parcel #7, 49.2918 acres; Parcel #8, 53.0066 acres. The beforementioned tracts of land numbers 3 through 8 all face on FM 1378. Also included are: Tract #11, 33.0652 acres; Tract #12, 94.5631 acres; Tract #13, 83.7226 acres; Tract #14, 85.5978 acres; and Tract #15, 82.8682 acres. Tracts number 11 through 15 face on FM 3412 (old 544). All of the contiguous land above described, containing a total of 674.2539 acres, is adjacent to present city limits of the City of Wylie insofar as the various tracts front upon FM 1378 and FM 3412 ( old 544). WHEREAS, after conducting public hearings in the manner prescribed by law and hearing the arguments for and against the same, the City Council has voted to annex said territory to the City of Wylie, Texas. WHEREAS, the petition for annexation includes a request that it be made a matter of public record that the land is tax exempt as long as it is part of the Birmingham Trust Land. The Council is desirous of making this request a matter of public record. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1. That the following described property, to-wit: BEING a tract of land located in Collin County, Texas, located on the east side of Farm Road 1378 and on the north side of Farm Road 3412 (old 544) and comprised of eleven contiguous and adjacent tracts of land, currently described as the Birmingham Trust Land, and more particularly described as Parcel #3, 47.5525 acres; Parcel #4, 47.6806 acres; Parcel #5, 47.8523 acres; Parcel #6, 49.0532 acres; Parcel #7, 49.2918 acres; Parcel #8, 53.0066 acres. The beforementioned tracts of land numbers 3 through 8 all face on FM 1378. Also included are: Tract #11, 33.0652 acres; Tract #12, 94.5631 acres; Tract #13, 83.7226 acres; Tract #14, 85.5978 acres; and Tract #15, 82.8682 acres. Tracts number 11 through 15 face on FM 3412 (old 544). All of the contiguous land above described, containing a total of 674.2539 acres, is adjacent to present City limits of the City of Wylie insofar as the various tracts front upon FM 1378 and FM 3412 (old 544). Upon its annexation to the City of Wylie, Texas, the new City limits shall be described by metes and bounds as follows: Commencing at the current City limit located on the east right- of-way line of FM 1378 and the northwest corner of Tract #3, proceeding eastward for a distance of 2,594 feet to the northeast corner of Tract #3, thence southward 3,202.6 feet to a point for corner, thence easterly for a distance of 3,729.58 feet to the northeast corner of Tract #15, thence south a distance of 2,939.3 feet to a southeasterly corner of Tract #3, thence westerly a distance of 392.42 feet to an interior corner in Tract #15, thence south a distance of 809.0 feet, to the intersection of this east boundary line of Tract #15 and the current City limits of the City of Wylie, Texas, thence west along the north right-of-way of FM 3412 (old 544) for a distance of 5,136.8 feet to the southwest corner of Tract #10, which is to be excluded from this annexation procedure, thence north a distance of 1,816.15 feet to the northeast corner of Tract #9, which is also excluded from this annexation, westerly for a distance of 810 feet to the northwest corner of Tract #9 and its intersection with the east right-of-way line of FM 1378, thence north a distance of 4,777.62 feet to the northwest corner of Tract #3 and its intersection with the east right-of-way line of FM 1378, the place of beginning; and the same tracts of land are hereby annexed to the City of Wylie, Collin County, Texas and that the boundary limits of the City of Wylie, be and the same are hereby extended to include the above described territory within the City limits of the City of Wylie, Collin County, Texas and the same shall hereafter be included within the territorial limits of said City and said land and the present and future inhabitants thereof shall hereafter be entitled to all the rights and privileges of other citizens of the City of Wylie, Collin County, Texas and shall be bound by the acts and the ordinances of said City. The City Secretary is hereby directed to file with the County Clerk of Collin County, Texas a certified copy of this ordinance, together with a copy of the attached map prepared by G. M.
