Ordinance 1983-15 ORDINANCE NO. ~~~ AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, REGULATING THE ERECTION, CONSTRUCTIOI~, ENLARGEMENT, ALTERATION, REPAIR, MOVING, REMOVAL, DEMOLITION, CONVERSION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA AND MAINTENANCE OF ALL BUILDINGS OR STRUCTURES IN THE CITY OF WYLIE, TEXAS; PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFOR; REPEALING ORDINANCE NO. 78-3 OF THE CITY OF WYLIE, TEXAS AND ALL OTHER ORDINANCES AND PARTS OF THE ORDINANCES IN CONFLICT THEREWITH; CONTAINING A SEVERANCE CLAUSE; PROVIDING PENALTIES FOR VIOLATIONS; AND AN EFFECTIVE DATE. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLI E, TEXAS: SECTION 1. That certain documents, three (3) copies of which are on file in the office of the City Secretary of the City of Wylie being marked and designated as "Uniform Building Code," without Appendix Chapters 1, 7, 11, 12, 23, 32, 35, 38, 49, 51, 53, 55, 57, and 70, 1982 edition, published by the International Conference of Building Officials, be and the same is hereby adopted as the code of the City of Wylie for regulating the erection, construction, enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy, equipment, use, height, area and maintenance of all buildings or structures in the City of Wylie providing for issuance of permits and collection of fees therefore; and each and all of the regulations, provisions, conditions and terms of such "Uniform Building Code," 1982 editi on, and the "Uniform Buil di ng Code Standards, II 1982 editi on, published by the International Conference of Building Officials, on file in the office of the City Secretary are hereby referred to, adopted and made a part hereof as if fully set out in this ordinance. SECTION 2. That Ordinance No. 78-3 of the City of Wylie entitled: An ordinance of the City of Wylie, Texas, regulating the erection, construction, enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy, equipment, use, height, area and maintenance of all buildings or structures in the City of Wylie, Texas; providing for the issuance of permits and collection of fees therefore; repealing Ordinance No. 78-3 of the City of Wylie, Texas and all other ordinances and parts of the ordinances in conflict therewith; containing a severance clause; providing penalties for violations; and an effective date. All other ordinances of parts of ordinances in conflict herewith are hereby repealed. SECTION 3. That the City Secretary shall certify to the adoption of this ordinance and cause the same to be published. SECTION 4. That if any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance, and each section, subsection, clause or phrase thereof, irrespective of the fact that anyone or more sections, sub- sections, sentences, clauses and phrases be declared unconstitutional. SECTION 5. That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject a penalty, and upon conviction shall be punished by fine not to exceed the sum of two hundred dollars ($200.00) for each offense, and that each day such violation shall continue to~ist shall constitute a separate offense. SECTION 6. That this ordinance shall be and is hereby declared to be in full force and effect, from after 45 days from this date of final passage, approval, and publication of the caption.
