A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WYLIE,
TEXAS, AUTHORIZING THE RE -SALE OF BID -OFF TAX PROPERTY
IN ACCORDANCE WITH THE TEXAS PROPERTY TAX CODE;
AUTHORIZING THE CITY MANAGER OF THE CITY OF WYLIE,
TEXAS, OR HIS DESIGNEE, TO TAKE ANY AND ALL OTHER ACTIONS
NECESSARY TO EFFECTUATE THE SAME; AND PROVIDING FOR AN
EFFECTIVE DATE HEREOF.
WHEREAS, the property identified in Exhibit A (the "Property") is a parcel of real
property which has previously been bid -off to taxing units pursuant to judgments and orders issued
by the District Courts of Collin County; and
WHEREAS, the City of Wylie, Texas (the "City") desires to purchase the Property for
$0.00, which is less than the minimum amount required by Texas Property Tax Code Section
34.05; and
WHEREAS, Texas Property Tax Code Section 34.05(i) provides that the Property may be
sold by private sale for an amount less than the required minimum price with the consent of all of
the taxing units participating in the tax sale, being the City, the Wylie Independent School District,
Collin County and the Collin County Community College District; and
' WHEREAS, the Wylie Independent School District, Collin County, and the Collin County
Community College District have consented to the sale of the Property to the City for $0.00 (the
"Sale");
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WYLIE, TEXAS:
SECTION 1. The findings set forth above are incorporated into the body of this resolution
as if fully set forth herein.
SECTION 2. The City Council of the City of Wylie hereby consents to the Sale.
SECTION 3. The City shall accept title to the Property upon final execution of the deed
to the Property. The City Manager, or his designee, is hereby authorized to execute, on behalf of
the City all documents necessary to effectuate the transfer of title to the Property to the City and
to take all other actions necessary to effectuate the same.
SECTION 4. This resolution shall be effective immediately upon its passage.

By acceptance of this Deed, Grantee acknowledges and agrees that the Property is being purchased and
conveyed "AS IS" with all faults and defects whether patent or latent as of the closing. Grantors, on behalf of
themselves and the other taxing entities on whose behalf it holds title to the Property, specifically negates and
disclaims any representations, warranties or guaranties of any kind or character, whether express or implied. ,
oral or written, past, present, future or otherwise, of, as to, concerning or with respect to the Property, including
without limitation G) the nature and condition of the Property and the suitability thereof for any and all activities

and uses which Grantee may elect to conduct thereon. (ii) the nature and extent of any right-of-way, lease,
possession, lien, encumbrance, license, reservation, condition or any other matter relating in any way to the

'government or other authority or body. (iv) the existence of any toxic or hazardous substance or waste in, on,
under the surface of or about the Property. (v) geological conditions, including, without limitation, subsidence,
subsurface conditions, water table, underground water reservoirs, limitations regarding the withdrawal of water
and faulting. NO whether or not and to the extent to which the Property or any portion thereof is affected by any
stream (surface or underground), body of water, flood prone area, floodplain, floodway or special flood hazard,
without limitation, water, sewage, izas and electric and including the utility availability capacities allocated to
location, age, use, design, quality, description, durability, structural integrity, operation, leasing, title to, or
physical or financial condition of the Property or any portion thereof, or any income, expenses, charges, liens,
encumbrances, rights or claims on or affecting or pertaining to the Property or any Dart thereof, (xiii) the
potential for further development of the Property, or (xiv) the merchantability of the Property or fitness of the
Property for any particular ourvose (Grantee affirming that Grantee has not relied on Grantors' skill or judgment
to select or furnish the Property for any particular purpose, and that Grantor makes no warranty that the Property
is fit for any particular purpose).
Grantor, for the consideration and subject to the reservations from and exceptions to conveyance and
warranty, grants, sells and conveys to Grantee the property, together with all and singular the rights and
appurtenances thereto in any wise belonging, to have and hold it to Grantee, Grantee's successors, or assigns

WHEREAS, pursuant to a delinquent tax collection lawsuit and tax foreclosure sale, the
property located at 600 & 601 Graham Court, Wylie, Texas, ("The Property") was struck off to
the Collin County and Collin County Community College District on its own behalf and as
Trustee for the Wylie Independent School District and the City of Wylie, pursuant to Section
34.010) of the Property Tax Code, and
WHEREAS, Wylie Independent School District consents to the resale of The Property to the
City of Wylie pursuant to Section 34.05 of the Property Tax Code, and
' WHEREAS, Wylie Independent School District desires to authorize the Collin County and
Collin County Community College District to act as Trustee to offer The Property for sale
pursuant to Section 34.05 of the Texas Property Tax Code,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE
WYLIE INDEPENDENT SCHOOL DISTRICT, WYLIE, TEXAS THAT:
Section 1. The Wylie Independent School District does hereby provide specific authorization to
the Collin County and Collin County Community College District to act as Trustee to offer for
sale to the City of Wylie by public or private sale 600 & 601 Graham Court, Wylie, Texas, more
fully described in Exhibit "A," attached hereto and made a part hereof, and the Board of Trustees
for Wylie Independent School District does hereby consent to the sale of 600 & 601 Graham
Court, Wylie, Texas to the City of Wylie in compliance with Section 34.05 of the Texas Property
Tax Code.
Section 2. This Resolution shall take effect immediately from and after its passage in accordance
with the provisions of the law.
