Resolution 2020-60' RESOLUTION NO.2020-60(R)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WYLIE,
TEXAS, TO RATIFY AN INTERLOCAL ENVIRONMENTAL SERVICES
AGREEMENT WITH COLLIN COUNTY, TEXAS FOR
ENVIRONMENTAL HEALTH CARE SERVICES.
WHEREAS, Chapter 791 of the Texas Government Code does permit Interlocal
Agreements between local governments for the purpose of purchasing goods and services; and
WHEREAS, Chapter 791 of the Texas Government Code requires authorization by the
governing body of each party; and
WHEREAS, the City of Wylie has entered into an annual interlocal agreement for
Environmental Health Care Services to be provided by Collin County; and
WHEREAS, the annual agreements were previously signed by the authorized City
Manager;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WYLIE, TEXAS:
SECTION 1: The Mayor of the City of Wylie, Texas, is hereby authorized to ratify on
behalf of the City Council of the City of Wylie, Texas, an annual interlocal agreement for
Environmental Health Services provided by Collin County in the amount of $42,680.00 for fiscal
year 10/1/2020 — 9/30/2021; and
SECTION 2: The City Manager of the City of Wylie, Texas is hereby authorized to execute
on behalf of the City Council of the City of Wylie, Texas, an interlocal agreement between Collin
County and the City of Wylie.
SECTION 3: This Resolution shall take effect immediately upon its passage.
DULY PASSED AND APPROVED, by the City Council of the City of Wylie, Texas on
this the 17th day of November, 2020.

YOU ARE DIRECTED TO MAKE THE FOLLOWING AMENDMENT TO THIS CONTRACT
ITEM #1: Extend agreement for a one (1) year period as provided for in section 2.0 of the agreement.
Agreement shall be in effect from October 1, 2020, through and including September 30, 2021.
Item #2: Add Force Majeure to Terms and Conditions:
Force Majeure: No parry shall be liable or responsible to the other party, nor be deemed to have defaulted under
or breached this Agreement, for any failure or delay in fulfilling or performing any term of this Agreement, when
and to the extent such failure or delay is caused by or results from acts beyond the affected parry's reasonable
control, including, without limitation: acts of God; flood, fire or explosion; war, invasion, riot or other civil unrest;
actions, embargoes or blockades in effect on or after the date of this Agreement; or national or regional
emergency (each of the foregoing, a "Force Majeure Event"). A parry whose performance is affected by a Force
Majeure Event shall give notice to the other party, stating the period of time the occurrence is expected to
continue and shall use diligent efforts to end the failure or delay and minimize the effects of such Force Majeure
Event.
Total amount for fiscal year 2021: $42,680.00
53,350 residents x $.80 per resident.
Except as provided herein, all terms and conditions of the contract remain in full force and effect
and may only be modified in writing signed by both parties.
