Ordinance 1983-49 , " ORDIt'ANCE NO '. I' /j U ~ . :.\ .;). ! I AN ORDINANCE FOR ANNEXATION: TO ANNEX TO THE CITY OF WYLIE, COLLIN COUNTY, TEXAS, A TRACT OF LAND OF THE E. C. DAVIDSON SURVEY, ABSTRACT NO. 266 , UPON PETITION OF JERRY W. LANDS FOR SAL del REY PROPERTIES, INC. WHEREAS, JERRY W. LANDS has filed a written petition to annex to the City of Wylie, Collin County, Texas, the tract of land hereinafter described, which said tract of land less than three (3) qualified voters reside, all of which said facts the City Council hereby finds to be true and correct; and WHEREAS, such petition has been heard and considered by the City Council, and it been decided that such annexation of such tract of land would be to the best interest of the public and of the said City of Wylie, Texas, and that such petition for annexation should be, and the same is now granted; now therefore, BE IT ORDAINED BY THE CITY COUNCIL OF WYLIE, TEXAS: The the following described tract of land, described by notes and bounds as follows, to-wit: TRACT NO. 1 BEING a tract of land situated in the E. C. Davidson survey, Abstract Number 266, Collin County, Texas, and being a part of the 80 acres conveyed to E. N. Eldridge in the Collin County Deed Records, volume 358, page 199, and a pa rt of the 45 acres conveyed to Thomas E. El dridge in the Co 11 in County Deed Records, volume 941, page 574. BEGINNING at an iron pin which is approximately 40 feet South of the original E. C. Davidson survey Northeast corner and being in the South ROW line of FM 3412; THENCE SOlo 05' 27" W along the East boundary of said E. C. Davidson survey 1,918.07 feet to an iron pin crossing the NTMWD easement; THENCE N 890 57' 27" W a distance of 1,514.30 feet to a corner; THENCE SOlo 39' 18" W a distance of 1,001.40 feet to a corner which is in the North ROW line of the St. Louis and Southwestern Railroad; THENCE S 870 09' 28" W a distance of 1,008.70 feet along said North ROW line to a corner also in the North ROW line fo the St. Louis and Southwestern Rail- road; THENCE NOlo 48' 32" E a distance of 1,322.71 feet to an iron pin for a corner; THENCE S 890 40' 05" E a distance of 619.61 feet to a fence corner; THENCE N 00 54' 44" E a distance of 1,649.02 feet, passing two monuments describing the South and North boundaries of the NTMWD easement, to an iron pin for a corner, which is in the South ROW line of FM 3412; THENCE N 890 57' 30" E a distance of 1,496.06 feet to an iron pin for a corner; THENCE S 00 36' 34" E a distance of 262.28 feet to an iron pin for a corner; THENCE N 880 35' 58" E a distance of 169.00 feet to an iron pin for a corner; ORDINACE NO. CONT'd PAGE 1A THENCE N 00 01' 55" W a distance of 130.92 feet to an iron pin for a corner; THENCE N 510 46' 13" E a distance of 14.86 feet to an iron pin for a corner; THENCE N 00 12' 36" W a distance of 118.09 feet to an iron pin for a corner; THENCE N 890 58' 30" E a distnace of 220.54 feet to the point of beginning; AND containing 109.898 acres of land, more or less. TRACT NO. 2 BEING a tract of land situated in the E. C. Davidson survey, Abstract Number 266, Collin County, Texas, and being a part of the 45 acres conveyed to Thomas E. Eldridge in Collin County Deed Records, volume 941, page 574. BEGINNING at a monument which is the Southwest corner of an approximate 3.97 acres of land conveyed to C. B. Martin, May 6, 1965, and recorded in the Collin County Deed Records, volume 652, page 562, and being a monument in the North ROW line of FM Road 544; THENCE N 88043' 12" W a distance of 799.37 feet to an iron pin for a corner; THENCE NOlo 48' 32" E a distance of 763.21 feet to an corner which lies in the South ROW line of the St. Louis and Southwestern Railroad; THENCE N 870 09' 28" E along the said South ROW line a distance of 801.74 feet to a fence corner which lies in the said South ROW line; THENCE SOlo 47' 32" a distance of 820.85 feet to the place of beginning and containing 14.532 acres of land, more or less. ORDINANCE NO. CONT'D PAGE 2 be received, annexed to, and made part of - and the same is hereby received, annexed to, and made part of - the City of Wylie, Collin County, Texas, subject to all laws, rules and regulations of said City. The fact that such annexation of said tract of land will be to the best interest ~f the public and the City of Wylie, and, because planned improvements upon said lands create an emergency, a necessity exists requiring that this ordinance be passed and adopted on first reading. This Ordinance shall be in force and effect from and after its passage and approval by the Mayor of Wylie. PASSED AND APPROVED THIS THE d?* ATTEST:
