Consider and act upon approval of the Minutes from the November 18, 2008, Regular Meeting. A motion was made by Vice Chairman Johnston, and seconded by Commissioner Osborne, to approve the minutes from November 18, 2008 Regular Meeting, as submitted. Motion carried 7—0. Minutes December 2, 2008 Wylie Planning and Zoning Board Page 1 of 5 Page 5 of 50 REGULAR AGENDA Action Agenda 1. Consider and act upon approval of a Site Plan for QuikTrip, on one lot, generally located on the north side of FM 544 approximately 1,337 feet west of Springwell Parkway. Mr. Haskins stated that the applicant is QuikTrip, and the property totals 1.19 acres and is currently zoned Commercial Corridor District. The applicant is proposing to construct a 4,902 square foot general merchandise/food store and motor vehicle fueling station commercial facility. The applicant is requesting a conditional approval, due to the Site Plan not meeting all technical requirements. There are three outstanding issues all pertaining to the access easement to the east. The first outstanding issue is the proposed access easement adjoining the property to the east in that it is not owned by the applicant. The second issue is no approval letter from TxDot has been received regarding a curb cut from FM544. The last issue is the requirement for access easement to be filed as a "separate instrument"has not been met. The parking or offset requirements do not technically comply, however staff feels that the intent of the Ordinance is met. The applicant has provided 24 marked parking spaces, and the Ordinance requires 25 for General Merchandise and 4 for stand alone motor vehicle fueling stations. Staff feels that intent is met because the site also includes sixteen fuel pumps that would provide adequate parking spaces for both general merchandise use and motor vehicle fueling station use. The Zoning Ordinance required four feet of offset over 25% of the building façade. The applicant has provided several smaller articulations across the façade and a large awning to provide architectural variation, which is the stated purpose of the required offset. The replat for this property is also on the agenda for the Commissions consideration. Commissioner Bennett questioned the lack of the configuration for the fire lane easement to the east of the property. Staff stated that the Commission could make a condition within the motion to require reconfiguration of the fire lane easement to be drawn on the plat. Mr. Jake Petras, 14450 Trinity Blvd, Suite 300, Fort Worth, Texas, Real Estate Project Manager for the property, stated that there is no problem incorporating the configuration of the fire lane easement onto the Plat. Mr. Joe Demeier, 14450 Trinity Blvd., Suite 300, Fort Worth, Texas, representative for QuikTrip Corporation, questioned the location of the drawing for the access easement. Ms. 011ie stated that the off-site access easement needs to be filed as a separate instrument prior to submittal of the engineering plans, and permits are issued. The Minutes December 2, 2008 Wylie Planning and Zoning Board Page 2 of 5 Page 6 of 50 easements within the boundaries of the subject property are to be filed with the Final Plat, after the plat is approved by the Commission and City Council. The Commission is requesting the on-site access easements be drawn on the plat prior to approval by City Council. Mr. Demeier stated that the drawing for the easement will be corrected before the Plat is considered by City Council. A motion was made by Commissioner Bennett, and seconded by Vice Chairman Johnston, to approve the Site Plan for QuickTrip, on one lot, located on the north side of FM 544 approximately 1,337 feet west of Springwell Parkway, subject to the conditions of a written statement from TxDot approving the eastern most curb cut on FM 544; A filed document dedicating the Public Access and Fire Lane Easement by "Separate Instrument" on the Williams Addition to the City of Wylie; and the fire lane access easement is reconfigured and shown proper access to the property to the east on the plat. Motion carried 7—0. 2. Consider a recommendation to the City Council regarding a Replat for Moss Addition. Subject property being generally located on the north side of FM 544 approximately 1,337 feet west of Springwell Pkwy. Chairman Larson stated that the applicant submitted a letter requesting the Replat for Moss Addition be tabled until the next Planning and Zoning Meeting on December 16, 2008. A motion was made by Commissioner Bennett, and seconded by Vice Chairman Johnston, to table the Replat for Moss Addition, generally located on the north side of FM 544 approximately 1,337 feet west of Springwell Parkway. Motion carried 7—0. Public Hearing 1. Hold a Public Hearing and consider a recommendation to the City Council amending Zoning Ordinance 2001-48, Article 2, Section 2.5 (Regulations Applicable to all Districts) and Article 10, Section 10.2 (Words and Terms Defined); allowing for and providing certain safeguards relating to wind- powered electricity-generating appliances. ZC2008-12. Ms. 011ie stated that with the rising cost of energy everyone is looking for alternative sources of energy. Staff is proposing solar and wind powered sources as a means of providing alternative energy sources, to allow safe, effective and efficient use of such systems. The proposal consists of a draft to the Zoning Ordinance Article 2, Section 2.5, which would allow for wind-powered electricity-generating appliances as an accessory structure. In Article 10, Section 10.2, the definition of a wind turbine would read as a machine designed to convert kinetic energy in the wind to mechanical or electrical energy, for the primary purpose of on-site use and not for resale or transmission off-site. Commissioner Bennett questioned if unused energy known as reverse metering could be sold back to the utility company. Ms. 011ie clarified that commercial resale is not allowed but reverse metering is allowed. Minutes December 2, 2008 Wylie Planning and Zoning Board Page 3 of 5 Page 7 of 50 Within Section 2.5 of Article 2, the wind turbine would be classified as an accessory structure, and would not be allowed unless a primary structure is constructed on the property. The height requirement shall be no more than 60 feet within residential districts and commercial districts and 100 feet in industrial districts. The setbacks of the wind turbines are to be at least 125 percent of the tower's height. The Ordinance will further outline the permit process to operate a wind powered system and will require valid permit holders to submit to the Building Inspection Department every other year a letter prepared by a Professional Engineer registered in the State of Texas. The letter is to state that the wind powered system continues to meet current electrical and structural requirements as set forth in the Ordinance. Chairman Larson recommended that in an effort to aid code enforcement, a clause be included stating that the letter will be sent thirty days prior to the final inspection anniversary date. The wind powered system shall be maintained at all times, and if it becomes inoperable for six months, the owner will have three months to remove or restore the system. The regulations and requirements will be monitored by the Building Inspections and Code Enforcement Department. The Planning Department will regulate the location of the wind powered system and confirm the aesthetic design criteria are met. Chairman Larson opened the Public Hearing. Mr. Mike Correale, Solar Wind Technologies, 1955 Northfork, Lucas, Texas, stated that the wind turbines are not simple, and takes a lot of consideration, thought and process for the safety and general well being of the citizens within the city. A recommendation to add within the proposed ordinance is for the offset setback fall zone and a protection shutdown. The offset setback fall zone would protect the primary buildings, as well as any surrounding trees and neighboring structures, if a blade falls from the tower. The protection shutdown would ensure that the property owner has the capability to turn off the wind turbine if a blade disconnects or when there is a power failure. Mr. Correale recommended that within the permitting requirement, the turbine must comply with UL-1741 compliance for automatic shutdown. The technology software perimeter changes regularly, the turbine that is 1.5kw has the capability of being 5kw. A utility company must be notified when there is a turbine, because sometimes the utility will shut off the power to a property that they find has a turbine and pull the meter. The size of the tower should be clearance of the blade on the tower, to the clearance beneath. Every turbine should be inspected once a year, this will protect and be a maintenance tool to keep the turbine in working order. The net metering is changing. Currently there is no requirement for the utility company to pay for power produced, the citizen should be fairly compensated for the times the meter is running backward. After the first of the year, the legislative could change for net metering. When a large commercial facility uses a large amount of Minutes December 2, 2008 Wylie Planning and Zoning Board Page 4 of 5 Page 8 of 50 power, and turbine is used to offset the meter base, there is a purchase power agreement (PPA). The PPA allows the commercial facility to have an agreement with the utility company to buy that excess power. The off load the peak demand, the demand charges for the power. Chairman Larson questioned the height restriction. Mr. Correale stated that limiting the height of the tower will limit the amount of kilowatts on a tower. He recommended 55 to 60 feet, in order to limit the kilowatts less than 5kw. The tower should be above obstruction from the trees and primary structures, in order to be out of turbulence. Chairman Larson closed the Public Hearing. A motion was made by Commissioner Osborne, and seconded by Vice Chairman Johnston, to recommend approval to the City Council an amendment to Zoning Ordinance No. 2001-48, Article 2, Section 2.5 (regulations Applicable to all Districts) and Article 10, Section 10.2 (Words and Terms Defined); allowing for and providing certain safeguards relating to wind-powered electricity-generating appliances. ZC 2008-12, with stipulation that under Section D, number 4 permitting requirements that the Wind Turbine be UL Compliance for automatic shutdown, and that the tower height be measured from the ground to the top of the hub, and eliminate the kilowatts requirement. Motion carried 7 —0. ADJOURNMENT A motion was made by Vice Chairman Johnston, and seconded by Commissioner Wright, to adjourn the meeting at 7:48PM. All Commissioners were in consensus. Lee Subdivision: Block A, Lot 1 Date Prepared: 12/05/08 Zoning District: Commercial Corridor Site Plan, Elevation& Exhibits: Landscape Plan Subject Consider and act upon approval of a Site Plan for a proposed single-story, 9,840 square foot Church/House of Worship, on one lot(First Church of the Nazarene,Block A,Lot 1), on 1.71 acres generally located south of State Highway 78 and 1,530 feet east of Kreymer Lane. Recommendation Motion to approve a Site Plan for a proposed single-story, 9,840 square foot Church/House of Worship on one lot(First Church of the Nazarene A,Lot 1), on 1.71 acres generally located south of State Highway 78 and 1,530 feet east of Kreymer Lane. Discussion The applicant is proposing to redevelop an existing-vacant single story 9,840 square foot building and convert the site to accommodate a Church/House of Worship. The 1.71 acre lot was originally developed in late-1979 while outside the city limits as part of Wylie Ranch Estates Commercial Park. The property was annexed in 1986 and subsequently zoned Commercial Corridor during the City's 2001 comprehensive city-wide zoning amendment. The property was outside the city limits when it was developed and prior to current zoning regulations; therefore it is currently designated as a nonconforming structure and does not comply with current site, landscape and architectural design regulations. Previous light commercial and assembly uses have occurred on the property over the past few years. The Zoning Ordinance allows for nonconforming structures and uses to continue under certain conditions. Article 9, Section 9.6 City of Wylie Zoning Ordinance Termination of Nonconforming Uses Or Structures: When a building and/or structure designed or used for nonconforming use shall cease to be used in such a manner for a period of six(6)months the right to continue ceases and subject to conformity to current Zoning Ordinance's regulations. The applicant proposes to make revisions to the site for compliance with current standards for parking, fire lane, and landscaping regulations. As reflected on the building elevations, additional brick veneer and/or stone will be applied in order to substantially conform to current architectural design requirements. The applicant proposes a 90-seat sanctuary requiring 23 parking spaces as provided on-site and provide additional ornamental trees and shrubbery. A corresponding replat for the property is on the current agenda for your consideration. Subject property located south of State Highway 78 and 1,530 feet east of Kreymer Lane. Recommendation Motion to recommend approval to the City Council for a Replat for First Church of the Nazarene, Block A, Lot 1. Subject property located south of State Highway 78 and 1,530 feet east of Kreymer Lane. Discussion The applicant is proposing a Replat of Wylie Ranch Estates Commercial Park, Lot 8. This revision to the original plat is to accommodate the redevelopment of the property including abandonment of 75 feet building setback line and dedication of fire lanes and cross access easements. This property was originally developed while beyond the City of Wylie's corporate city limit boundaries. The property was annexed into the City in 1986. Since the late 1970's thru early 2007; the property has been used for light manufacturing and other commercial uses. The current applicant proposes to redevelop the property for Church/House of Worship uses. A site plan is on the current agenda for your review and consideration for approval. Wylie Planning and Zoning Commission CITY OF WYLI AGENDA REPORT Work Session Meeting Date: December 16, 2008 Item Number: 1 Department: Planning Prepared By: Jasen Haskins Date Prepared: December 8,2008 Exhibits: Partial Draft Ordinance Subject Hold a Work Session to consider and give direction to Planning Staff regarding drafting an ordinance to create an overlay district for South Ballard Avenue. Recommendation Direction to Planning Staff on drafting an ordinance to create an overlay district for South Ballard Avenue. Discussion South Ballard has been identified by the City as a valuable area worthy of rejuvenation. South Ballard is expected to become a more visible area within the City as infrastructure and development improvements to the south, such as the extension of the President George Bush Turnpike, are' completed. Because of these reasons staff is proposing an Overlay District that would provide development and design standards that will enhance the District's ability to provide enhanced usable space for the citizens of the City while extending the pedestrian friendly atmosphere and architectural character of the nearby Downtown Historic District. In order to create the best possible opportunities for this important area of Wylie, staff is taking several steps to maximize input from the various stakeholders. This process officially began this past October with a presentation of Staff s intentions to the City Council. From that presentation staff has created a rough draft of a proposed ordinance for the Commission's review. The process will continue with public hearings, citizen input (in concert with the A.C.T.I.ON. plan), P&Z recommendations, coordination with other City Departments and the WEDC, and finally City Council consideration. The area is currently a mix of zoning consisting of Commercial Corridor, Single Family, and Multi-Family uses. Staff believes that South Ballard is ideally suited for Commercial or Mixed-Use development. In order to facilitate these types of developments, staff believes a Form-Based approach to zoning would best serve this area. Page 1 of 2 Page 19 of 50 Page 2 of 2 Considerations for the district include: 1. Exact boundaries of the District—As currently presented the South Ballard Overlay District would comprise lots that front South Ballard south of S.H. 78 and north of Stone Road. Other possible boundaries include the eastern frontage of Jefferson or Birmingham. Expansion to the east is not recommended as the neighborhoods are much more established and the developed lots are contiguous. 2. Traditional Zoning versus Form-Based Zoning - If straight zoning were to be used then a change to Commercial Corridor makes the most sense at this time due to the anticipated development patterns. This type of zoning may then require a DTH style ordinance to accommodate the existing mix of residential and commercial structures. However, staff believes Form-Based zoning may be best suited to this area. Form-Based zoning, in short, involves focusing the Ordinance more on the appearance of the buildings and the space surrounding the buildings then on the uses within the buildings. For example, the current Downtown Historic District Ordinance has a Form-Based element to it in that the look of the buildings in the district are tightly regulated. Form-Based zoning would add another element to this by also regulating the spaces around the buildings to create a unique, pedestrian friendly, commercial and residential environment. 3. What Uses will be allowed based on what zoning category is implemented—Regardless of the form the building and spaces are to ultimately take, staff believes a larger mix of uses then the current DTH uses are in order. Staff recommendations are included in the attached Use Charts exhibit. 4. What Form should by used if Form-Based is recommended?—If a Form-Based ordinance is recommended then the specifics of that form, by definition, must be specified. Staff is recommending a terrace house style of architecture, wide sidewalks, buildings on or near the front build line, and open green space to the rear. Additional parking could be provided on lots at specific intervals owned and maintained by the City. 5. Should a mix of uses be mandatory?—In a high traffic volume area such as S Ballard, commercial uses are the most attractive to potential developers and land owners. However, a mixed use environment creates, arguably, a more attractive and unique space within the City. To create the space envisioned by staff a mandatory mix of uses may be necessary. Currently, staff is researching the notion of developing mixed uses while still allowing the market to dictate the overall development to the maximum extent possible. 6. Should the alley behind those lots on the west side of S. Ballard by utilized? - Average lot depths could be approximately 135' if those alleys are abandoned and a walkable path could be created. However, service, trash, and loading areas must be provided for such commercial uses. 7. Level of direct involvement from the City—In many cases of ambitious projects such as these a high level of public involvement is required; especially to enact and initiate. Staff anticipates that close coordination with the City, WEDC, and the initial developer(s) along with some level of public financial support would be required for proper development to commence. 8. Negative Impacts—If even the minimum recommendation of a zoning change to Commercial Corridor is enacted this proposed change would create numerous non-conforming uses. Certain properties will be unlikely to be redeveloped for some time leading to a mix of old and new. In summary, staff believes that a reconsideration of the form and uses of South Ballard are in order. At a minimum the area should be rezoned as CC with the allowance for such uses in residential style structures. However staff believes this reexamination should be taken one step farther and a unique, pedestrian friendly,mixed-use environment could be created.
