Commission Action Minutes January 7,2020 Planning&Zoning Page 1 A motion was made by Commissioner McCrossin, seconded by Commissioner Rogers,to approve the Minutes from the December 17, 2019 meeting, as presented. A vote was taken and the motion carried 5-0. REGULAR AGENDA A. Consider, and act upon, a recommendation to the City Council regarding a Final Plat for Absolute Automotive Addition, Block A, Lot 1 on 2.222 acres, located at 51 Steel Road. Staff Comments Mr. Molina stated that the Final Plat will establish one lot on 2.222 acres. The site will develop a 11,325 square foot building and provide 27 parking spaces. The plat dedicates 32.5 feet of right-of-way for the future widening of Steel Road and dedicates the necessary fire lane easements. Commissioners Action A motion was made by Commissioner McCrossin, and seconded by Commissioner Rogers, to recommend approval to the City Council regarding a Final Plat for Absolute Automotive Addition, Block A, Lot 1 on 2.222 acres, located at 51 Steel Road. A vote was taken and carried 5—0. Commissioner Rogers recused himself for Item B. B. Consider, and act upon, a recommendation to City Council regarding a Final Plat for Poorkiyani Addition Block A,Lot 1 on 0.477 acres. Property located 2811 FM 544. Staff Comments Mr. Molina stated that the Final Plat will establish one lot on 0.477 acres. The preliminary plat was approved in March 2017. The plat dedicates the necessary rights-of-way, fire lanes, utility, construction, and drainage easements. Commissioners Action A motion was made by Commissioner McCrossin, and seconded by Commissioner Plunk, to recommend approval to the City Council regarding a Final Plat for Poorkiyani Addition,Block A, Lot 1 on 0.477 acres, located at 2811 West FM 544. A vote was taken and carried 4—0. Commissioner Rogers joined the meeting. Public Hearing Minutes January 7,2020 Planning&Zoning Page 2 1. Hold a Public Hearing to consider, and act upon a recommendation to City Council regarding a change in zoning from Commercial Corridor (CC) to Planned Development -Commercial Corridor (PD-CC),to allow for expansion of industrial manufacturing use on 1.225 acres located at 703 Cooper Drive. (ZC 2019-18) Staff Comments Mr. Molina stated that the applicant is requesting to rezone 1.225 acres located at or adjacent to 703 Cooper Road. The applicant is requesting the zoning to Planned Development to allow an existing industrial manufacturing use to expand its building footprint. The existing building measures 11,663 square feet and the proposed expansion includes an additional 9,984 square feet, making the entire building 21,647 square feet in size. The property is legally non-conforming due to type of use and setbacks to the rear, front and side. The PD address the non-confoliuing use and other issues such as parking, setbacks, and building design. Twenty notifications were mailed to property owners within 200 feet. Three responses were received in favor of the request and none were received in opposition.. Public Comments Chair Owens opened the public hearing. No one approached the Commissioners Chair Owens closed the public hearing. The subject property is zoned within.PD 2020-11 and allows for the church use by right. The development is providing 262 parking spaces with 33,015 sf of landscaped area. The site will be accessed from SH78 and by an access drive on the developed property to the northeast. As part of this redevelopment the applicant will be removing side entry doors and providing enhancements to the Church's main entrance. The exterior material of the building will be using existing material found on the structure and is comprised of CMU and EIFS. The applicant will also be making landscaping improvements by adding landscaped islands and planting trees along the street frontage. As presented, this site plan is in compliance with the design requirements of Planned Development 2020-11. The reason for the requested rezoning to Community Retail is to allow for the development of a 4,000 sf convenience store with fueling stations on the corner of Country Club and McMillan and general commercial retail north along Country Club. The proposed zoning change from Neighborhood Services to the Community Retail zoning district would allow for more by right uses such as; • Restaurants with drive through service • Grocery/Convenience store • Fueling station • Animal clinic • Automotive Repair, minor Many of the listed uses in the aforementioned example would require a special use permit to be allowed in the Neighborhood Services zoning district. Page 1 of 1 Page 2 of 2 The applicant is proposing to offer the sale of beer and wine within the convenience store and as such is proposing to dedicate approximately 449 sf of land to Dodd park. This dedication would place the subject property at a legally required distance of 300' from Dodd Elementary, allowing for the sale of alcohol pending the proper TABC permits. The Parks & Recreation Board recommended approval of this dedication at the January 13, 2020 Parks and Recreation Board Meeting. The subject property lies within the General Urban Sector of the Comprehensive Land Use Plan. The proposed zoning and uses are compatible with the Plan. Approval of this zoning change will require the submittal of a final plat and site plan prior to development. The R&P were updated in 1998 and again in 2008. It is hereby declared that appointment to the Planning and Zoning Commission is a distinct honor and the trust imposed in the appointee involves the corresponding obligation of the appointee to serve the community by regular attendance and participation in the proceedings of the body. 2. Creation and Membership 2.1. The Commission wasis created by a 1000 Ordinance, amended by Ordinance 79-26, and the City Charter in 1030, and serves at the will of the City Council. 2.2. The Planning and Zoning Commission shall consist of seven (7) regular members who will serve for terms of two (2) years. A Commissioner shall generally be limited to two two-year terms, as stated in Ordinance 2020-0 The members will be resident citizens, taxpayers and qualified voters of the City. 2.3. All previously adopted Rules of Procedure of the Planning and Zoning Commission are hereby expressly repealed 21. Suspension of Rules ofProcedure 21.1. Any one or all of these rules of procedure may be suspended in order to allow a particular consideration of a matter, provided that it does not violate the state law or home rule charter, and provided that not less than two-thirds Commissioners vote in favor of such suspension. Where any rule embodies a provision of state law, identically or in substance, such rule may not be suspended.
