Ordinance 1992-01 ORDINANCE NO. f,J-/ AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, PROHIBITING THE USE, CONSUMPTION, POSSESSION, SALE AND GIVING AWAY ALCOHOLIC BEVERAGES WITHIN THE CITY PARKS AND OTHER PUBLIC PLACES IN THE CITY OF WYLIE, TEXAS; PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT THEREWITH; PROVIDING A SEVERABILITY CLAUSE; AND FURTHER PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Ordinance No. 71-8, as codified in Section 2.1 of Chapter 7 of the Wylie City Code and Ordinance No. 85-49, as codified in Section 6.05 of Chapter 1 of the Wylie City Code, both prohibit the consumption of alcoholic beverages in public places and City Parks respectively; and, WHEREAS, both said ordinances of alcoholic beverages in Parks and City of Wylie; and prohibit the possession other public places in the WHEREAS, allowing a problem in enforcing frustrating the purpose such consumption; and possession of alcoholic beverages the prohibition on consumption and intent of said ordinances to creates thereby prevent WHEREAS, the City Council has determined that prohibiting possession of alcoholic beverages as well as consumption is necessary to properly enforce and effectuate the intent of the City Council in regard to consumption of alcoholic beverages within the City Park and other public places; NOW, THEREFORE, CITY OF WYLIE, TEXAS, BE IT ORDAINED BY as follows: THE CITY COUNCIL OF THE SECTION 1. That Chapter 1, Section 6.05 of the Code of Ordinances, City of Wylie, Texas, is hereby amended to read as follows: "Section 6.05 Possession, Consumption and Use of Alcoholic Beverages in Class Containers a) It shall be unlawful for any person to sell, give away, possess or consume any beer or alcoholic beverage within in any City park in the City of Wylie. b) any glass Park." It shall be unlawful for any person to possess or use container of any kind or nature within in any City SECTION 2. That Chapter 7, Section 2.01 of the Code of Ordinances, City of Wylie, Texas, is hereby amended to read as follows: "Section 2.01. Possession and Consumption of Beverages in Public Place Alcoholic It shall be unlawful for any person to possess or consume any alcoholic beverage or beer in any public place within the corporate limits of the City of Wylie." SECTION 3. That all other ordinances and code provisions in conflict herewith hereby are repealed to the extent of any conflict or any inconsistency. SECTION 4. Should any paragraph, sentence, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof, other than the part or parts so declared to be invalid, illegal or unconstitutional. SECTION 5. This ordinance shall take effect immediately from and after its passage and the publication of the caption as the law and the City Charter provide in such cases.
