AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WYLIE,
TEXAS, ADOPTING AND ENACTING A NEW CODE OF ORDINANCES,
CITY OF WYLIE, TEXAS; PROVIDING A PENALTY CLAUSE,
REPEALING/SAVINGS CLAUSE, SEVERABILITY CLAUSE AND AN
EFFECTIVE DATE; PROVIDING FOR THE MANNER OF AMENDING
SUCH CODE; AND PROVIDING FOR THE PUBLICATION OF THE
CAPTION HEREOF.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WYLIE, TEXAS:
SECTION 1. The Code entitled "Code of Ordinances, City of Wylie, Texas," published
by Municipal Code Corporation, consisting of chapters 1 through 118, each inclusive, is adopted.
SECTION 2. All provisions of any ordinance in conflict with this Ordinance are hereby
repealed to the extent they are in conflict, but such repeal shall not abate any pending prosecution
for violation of the repealed ordinance, nor shall the repeal prevent a prosecution from being
commenced for any violation if occurring prior to the repeal of the ordinance. Any remaining
portions of said ordinances shall remain in full force and effect.
SECTION 3. Should any section, subsection, sentence, clause or phrase of this Ordinance
be declared unconstitutional and/or invalid by a court of competent jurisdiction, it is expressly
provided that any and all remaining portions of this Ordinance shall remain in full force and effect.
The City Council hereby declares that it would have passed this Ordinance, and each section,
subsection, clause or phrase thereof, regardless of whether any one or more sections, subsections,
sentences, clauses or phrases is declared unconstitutional and/or invalid.
SECTION 4. Unless another penalty is expressly provided, every person convicted of a
violation of any provision of the Code or any ordinance, rule or regulation adopted or issued in
pursuance thereof shall be punished by a fine not exceeding five hundred dollars ($500.00), except
for:
(1) violations of municipal ordinances that govern fire, safety, zoning, public health and
sanitation, including dumping of refuse, vegetation and litter violations in which the
maximum fine shall be two thousand dollars ($2,000.00) for each offense; and
(2) violations of traffic laws which are punishable as a Class C misdemeanor shall be
punished by a fine not to exceed two hundred dollars ($200.00).
However, no penalty shall be greater or less than the penalty provided for the same or
similar offense under the laws of the state. Each act of violation and each day upon which any
such violation shall continue or occur shall constitute a separate offense. The penalty provided by
this section, unless another penalty is expressly provided, shall apply to the amendment of any
Code section, whether or not such penalty is reenacted in the amendatory ordinance. In addition to
Ordinance No. 2021-17 - Enacting a New Code for the Code of Ordinances
the penalty prescribed above, the City may pursue other remedies such as abatement of nuisances,
injunctive relief and revocation of licenses or permits.
SECTION 5. Additions or amendments to the Code when passed in such form as to
indicate the intention of the City to make the same a part of the Code shall be deemed to be
incorporated in the Code, so that reference to the Code includes the additions and amendments.
SECTION 6. Ordinances adopted after February 9, 2021, that amend or refer to ordinances
that have been codified in the Code shall be construed as if they amend or refer to like provisions
of the Code.
SECTION 7. This Ordinance shall become effective on April 1, 2021.
