AN ORDINANCE OF THE CITY OF WYLIE, A HOME RULE POLITICAL
SUBDIVISION OF THE STATE OF TEXAS, PROVIDING AMENDMENTS TO
ORDINANCE 84-12 WHICH ESTABLISHES VARIOUS FEES FOR THE CITY
OF WYLIE. SPECIFICALLY ADDING A NEW SECTION 6, PERIMETER
STREETS AND A NEW SECTION 7, MAINTENANCE BONDS FOR ONE YEAR
WARRANTY ON DEVELOPMENT CONSTRUCTION OF PUBLIC FACILITIES;
PROVIDING A PENALTY CLAUSE, SEVERABILITY CLAUSE; AND AN
EFFECTIVE DATE.

SECTION 6:
PERIMETER STREETS FEE IN LIEU OF CONSTRUCTION:
As referenced in the City of Wylie Subdivision
Ordinance, developers may in certain approved
circumstances make a payment to the City of Wylie
of funds in an appropriate amount to provide for
the cost of construction of the required perimeter
streets in association with their development.
The fee for such payment in lieu of construction
shall be as follows:

Six inch (6") thick required
construction: $2.00 a square foot.

SECTION 7: MAINTENANCE BONDS
As required by the City of Wylie's Subdivision
Ordinance, maintenance bonds to cover the cost of
any repairs that may be required during the one
year warranty period to public works improvements
and facilities dedicated to the City of Wylie at
the time of final plat acceptance shall be in the
amount of ten (10) percent of the total value of
all improvements dedicated and shall be delivered
to the City of Wylie prior to the Council's
consideration of final acceptance.
PENALTY
Any person, firm, corporation or other entity who is found
guilty of violating the terms of this ordinance shall be
deemed guilty of a misdemeanor and upon conviction of any
such violation, shall be subject to a fine of not less than
$1.00 no more than $200.00.

All ordinances or parts of the

It is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses
and phrases of this ordinance are severable and if any
phrase, clause, sentence or section of this ordinance shall
be declared unconstitutional or invalid by any judgement or
decree of a court of competent jurisdiction, such
unconstitutionality or invalidity shall not affect any other
remaining phrase, clause, sentence, paragraph or section of
this ordinance; and the City Council hereby declares it
would have passed the remaining portions even though it had
known the affected parts would be held unconstitutional.
EFFECTIVE DATE
This ordinance and its amendments and the fees which it
amends shall become effective upon publication.
