Ordinance 1985-09 ORD I NANCE NO. __r~=.f!...--.- AN ORDINANCE OF THE CITY OF WYLIE REPEALING ORDINANCE NO. 74-12; PROVIDING A PENALTY FOR VIOLATING RULES OF THE WYLIE PUBLIC LIBRARY; PROVIDING A PENALTY FOR FAILURE TO RETURN BOOKS ACCORDING TO THE REGULATIONS OF THE WYLIE PUBLIC LIBRARY; MAKING IT AN OFFENSE AND PROVIDING PENALTY FOR DEFACING PROPERTY OF THE WYLIE PUBLIC LIBRARY; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY CLAUSE; PROVIDING FOR PUBLICATION: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEX{-iS: :3E.:::cr I m,1 1 .. That Ordinance No.. 74-12 is hereby repealed: SECTION 2. That every person who shall take from the Wylie Public Library any book, pamphlet, periodical, paper or other property, except in accordance with the rules of such library, shall be deemed guilty of a misdemeanor; SECTION 3.. That every person who shall take or borrow from the Wylie Public Library any book, pamphlet, periodical, paper or other property and neglect, refuse or fail to return the same within two weeks of the date of mailing a notice by registered mail with return receipt requested to his address, shall be deemed guilty of a misdemeanor; SECTION 4. That every person who shall willfully or wantonly cut, mutilate, mark, tear, write upon, deface or otherwise destroy or injury in whole or in part, any book pamphlet, periodical, map or document, picture, or written or engraved or printed paper belonging to the Wylie Public Library, or shall suffer any such injury to be inflicted while such property is in his custody, or shall willfully or wantonly injury any of the furniture or property in the building of the Wylie Public Library, or shall willfully or wantonly mark or deface or in any way inJury the Wylie Public Library or any part thereof, or any fixtures therein or appurtaining thereto, shall be deemed guilty of a mi sdemE.'anor; SECTION 5: That every person who is assessed a penalty for failure to timely return any item lent them by the Wylie Public Library and who refuses to pay the penalty shall be deemed guilty of a misdeamenor; SECTION 6: That any person who violates any provision of this ordinance shall be deemed guilty of a misdeameanor and upon conviction therefore shall be fined any sum not exceeding the limit provided by State Law. Each day the violation continues shall be considered a separate offense; SECTION 7: That if any section, sub-section, paragraph, sentence, phrase or clause of this ordinance shall be declared invalid for any reason whatsoever, such decision shall not effect the remaining portions of this ordinance which shall remain in full force and effect; and to this end the provisions of this ordinance are hereby declared to be ~:;(-:"vef.. atJ Ie; :3ECTION 8: The caption of this ordinance shall be published one (I) time in a newspaper having general circulation in the City of Wylie and shall be effective immediately upon its passage and publication.
