Those present besides Chairman Dennis Larson were; Commissioner Willie Osborne, Commissioner John Manganilla, Commissioner Ramona Kopchenko and Commissioner Ruthie Wright. Commissioner Tim Bennett and Vice Chairman Phillip Johnston were absent. Staff present was Renae 011ie, Planning Director, Charles H Lee, Senior Planner, Jasen Haskins, Assistant Planner, and Mary Bradley, Administrative Assistant. INVOCATION & PLEDGE OF ALLEGIANCE Commissioner Osborne gave the invocation and Commissioner Kopchenko led the pledge of allegiance. CITIZENS COMMENTS Chairman Larson opened the Citizens Participation. No one approached the Commissioners; Chairman Larson closed the Citizens Participation. CONSENT ITEMS 1. Consider and act upon approval of the Minutes from the December 2, 2008, Regular Meeting. A motion was made by Commissioner Osborne, and seconded by Commissioner Kopchenko, to approve the minutes from December 2, 2008 Regular Meeting, as submitted. Motion carried 5 —O. Minutes December 16, 2008 Wylie Planning and Zoning Board Page 1 of 4 REGULAR AGENDA Action Agenda 1. Consider a recommendation to the City Council regarding a Replat for Moss Addition. Subject property being generally located on the north side of FM 544 approximately 1,337 feet west of Springwell Pkwy. Mr. Haskins stated that the applicant is requesting the Replat to be tabled, as no approval for an access curb cut was received from TxDot. The applicant is requesting to table until January 6, 2008. Chairman Larson expressed concern if three weeks was adequate time, and recommended tabling until January 20, 2008. Mr. Sam Satterwhite, Wylie Economic Development Director, not speaking on the behalf of the applicant, but stated that moving the date to January 20, 2008, will further delay the closing of the property. A motion was made by Commissioner Osborne, and seconded by Commissioner Wright, to table the Replat for Moss Addition, until January 6, 2008. The property being generally located on the north side of FM 544 and approximately 1,337 feet west of Springwell Parkway. Motion carried 5 —O. 2. Consider and act upon approval of a Site Plan for a proposed single-story, 9,840 square foot Church/House of Worship, on one lot of 1.71 acres generally located south of State Highway 78 and 1,530 feet east of Kreymer Lane. Mr. Lee stated that the applicant is proposing to redevelop an existing vacant single story 9,840 square foot building to accommodate a Church/House of Worship. The property is a 1.71 acre tract of land that was developed as part of Wylie Ranch Estates Commercial Park in late 1979. In 1986 the property was annexed into the city and subsequently zoned Commercial Corridor in 2001 with the city-wide zoning amendment. The existing structure is designated as a nonconforming structure; however the applicant proposes to make revisions for compliance with current standards for parking, fire lane, and landscaping regulations. Additional brick veneer and/or stone will be applied in order to substantially conform to current architectural design requirements. The applicant proposes a 90-seat sanctuary requiring 23 parking spaces as provided on-site and provide additional ornamental trees and shrubbery. A corresponding replat for the property is on the current agenda for your consideration. The Commissioners questioned the "substantial conformance" of the site plan. Mr. Lee stated that the proposed facility will be a 90-seat sanctuary requiring 23 parking spaces, which is met. However, the Ordinance requires a break every twelve parking spaces, and the applicant is not able to meet that requirement. Instead, the applicant is proposing to provide additional ornamental trees and shrubbery. The applicant is not meeting the letter of the Ordinance, but meeting the intention with additional modifications. Minutes December 16, 2008 Wylie Planning and Zoning Board Page 2 of 4 With no questions for the applicant, a motion was made by Commissioner Kopchenko, and seconded by Commissioner Manganilla, to approve the Site Plan for First Church of the Nazarene, on Lot 1, Block A, a single-story 9,840 square foot Church/House of Worship, generally located south of State Highway 78 and 1,530 feet east of Kreymer Lane. Motion carried 5 —0. 3. Consider a recommendation to the City Council regarding a Replat for First Church of the Nazarene, Block A, Lot 1. Subject property located south of State Highway 78 and 1,530 feet east of Kreymer Lane. Mr. Lee stated that the applicant is proposing a Replat of Wylie Ranch Estates Commercial Park, Lot 8, and platting as First Church of the Nazarene. The plat will accommodate the redevelopment of the property including abandonment of 75 feet building setback line and dedication of fire lanes and cross access easements. A Site Plan is on the current agenda for consideration also. With no questions for the applicant, a motion was made by Commissioner Wright, and seconded by Commissioner Osborne, to recommend approval to the City Council for a Replat for First Church of the Nazarene, Block A, Lot 1. Subject property being located south of State Highway 78 and 1,530 feet east of Kreymer Lane. Motion carried 5 -0. Work Session 1. Hold a Work Session to consider and give direction to Planning Staff regarding drafting an ordinance to create an overlay district for South Ballard Avenue. Mr. Haskins stated that the City of Wylie has identified South Ballard as a valuable area worthy of rejuvenation. South Ballard is expected to become a more visible area within the City as infrastructure and development improvements to the south, such as the extension of the President George Bush Turnpike is completed. Staff is proposing an Overlay District that will provide development and design standards to enhance the usable space for the citizens while extending the pedestrian friendly atmosphere and architectural character of the nearby Downtown Historic District. Staff gave a presentation to City Council in October, and from that presentation staff has created a rough draft of a proposed ordinance for the Commission's review. Mr. Haskins presented eight considerations for the Commissions review and they included; Exact boundaries of the district; Traditional Zoning versus Form-Based Zoning; Uses allowed based on zoning category implemented; What Form should be used if Form-Based is recommended; Should a mix of uses be mandatory; Should the alley behind those lots on the west side of South Ballard be utilized; Level of direct involvement from the City; and negative impacts. The consensuses from the Commissioners was that they all liked the proposed District, directed staff to continue moving forward, extend the Overlay District to Birmingham with Form Based Zoning, and make it pedestrian friendly including crossing Highway 78. Ms. 011ie confirmed the boundaries that were discussed, and the Commissioners agreed that the District will extend west to Birmingham, and cease at the alley behind the western properties of First Street. Discussion The applicant has submitted a Concept Plan for initial review and approval for a Bank with drive-through facilities. The purpose for the Concept Plan is to provide the City with relevant information and data necessary to assess the merits of a particular development and ensure that it is consistent & compatible with Comprehensive Plan, Thoroughfare Plan as well as other adopted ordinances and regulations. Initial development of Woodlake Village Shopping Center in the Summer of 2003 consisted of (5) five lots on approximately 27 acres. The site includes an 187,000 square foot Wal-Mart Supercenter, a fueling station (Murphy Oil) and a strip center with restaurant,medical office and various professional service uses. The subject 1.065 acre lot fronts SH 78 and will consist of 4 drive through lanes that will exit on to the southern parking area of Wal-Mart. Currently, the applicant's design team has indicated that exterior materials will consist primarily of brick, CMU block and earth-toned stucco generally consistent with surrounding development in color and style. Additionally, the design for landscaping will include adequate trees, shrubbery and ground cover in excess of minimum design requirements per Zoning Ordinance. In summary, the Concept Plan as presented conforms with the Comprehensive Plan and other relevant regulations. However, upon approval of a Concept Plan the applicant shall be required to submit Final Site Plan, Replat and other necessary documents and data to Planning Department and subsequent P&Z Commission as well as City Council review for the plat.
