Those present besides Vice-Chairman Ames were, Commissioner Ramona Kopchenko, Commissioner Phillip Johnston, Commissioner Tim Bennett, Commissioner John Onufreiczuk, and Commissioner Ruthie Wright. Chairman Dennis Larson was absent. Staff present was Renae 011ie, Jasen Haskins, and Mary Bradley. INVOCATION & PLEDGE OF ALLEGIANCE Commissioner Onufreiczuk gave the invocation and Commissioner Wright led the pledge of allegiance. CITIZENS COMMENTS Vice-Chairman Ames opened the Citizens Participation. Ms. 011ie stated for the National Community Planning Month, fifth graders from the Wylie Independent School District submitted art work, and the Commissioners voted on each one; Good, First Class, Superior. At the October 23, 2007, City Council meeting a student from each school will be awarded with a prize. Every student will be given a Certificate for Participating. Ms. Renae 011ie presented a prize to Commissioner Wright for giving the correct answer on the name of the town before City of Wylie, which was Nickelville. Vice-Chairman Ames closed the Citizens Participation. Minutes October 16, 2007 Wylie Planning and Zoning Board Page 1 of 3 CONSENT ITEMS 1. Consider and act upon approval of the Minutes from the October 2, 2007 Regular Meeting. A motion was made by Commissioner Onufreiczuk, and seconded by Commissioner Johnston, to approve the minutes from October 2, 2007, regular meeting with no changes or corrections. Motion carried 6 — 0. PUBLIC HEARING 1. Hold a Public Hearing and consider a recommendation to City Council regarding an amendment to Zoning Ordinance 2006-04, Article 3, Sections 3.1,3.2, and 3.3: Amending certain Additional Provisions to the regulation of Yard Requirements regarding patio covers. Text Amendment Mr. Haskins stated that the item is a text amendment to the Zoning Ordinance. Mr. Haskins explained that due to a large volume of requests to the Zoning Board of Adjustment (ZBA) for a variance to construct a non-enclosed patio cover, staff is recommending a change to the rear setback requirements for non-enclosed patio covers within residential districts. The current Zoning Ordinance does not take into consideration the multitude of residential homes that are built on or near the rear building setback lines. Therefore, the recommended revision is to insert the following paragraph into Subsection 4 (Additional Provisions) of Sections 3.1, 3.2, and 3.3, that reads: "Non-enclosed attached patio covers shall be allowed to extend a maximum of 15 feet from the main structure but no closer than 10 feet from the rear property line. In addition, maximum lot coverage cannot be exceeded." Staff is also recommending the addition of maximum lot coverage to all residential districts except Multifamily. Depending on the zoning district the recommended range is from 45 to 60 percent. Currently, City of Wylie does not have maximum lot coverage. This would limit excessively large patio covers while still allowing for flexibility in design and placement, in addition to maintaining open space throughout the City. Ms. 011ie reiterated the reason why lot coverage is to be added, and the need for limitations of a size. Ms. 011ie reviewed the classifications of a hardship, prior to going to the ZBA, and then reasons for granting a variance. Staff researched other cities for the lot coverage, and most surrounding cities have maximum lot coverage and a limit on the size of an accessory structure that is attached to the main structure. Mr. Haskins stated that the amendment does not allow for patios to be permanently enclosed and/or serve as an occupied inhabitable space. If a property owner Minutes October 16, 2007 Wylie Planning and Zoning Board Page 2 of 3 proposes to construct a permanent enclosed patio, the normal setbacks for a main structure would have to be met prior to any building permits being obtained. The revised proposed text amendment would allow for citizens to efficiently and effectively cover portions of their back yards, and keep with the intent of the current ordinance, maintain safety and aesthetics, and potentially reduce energy use by limiting direct sunlight exposure into homes. Mr. Haskins asked the Commissioners for guidance as to where to add the amendment for the patio covers. Since, the Building Official considers the non- enclosed patio cover as an accessory structure, the proposed amendment, if a materials list were added, may be placed in Article 2 of the Zoning Ordinance. Commissioners discussed the setback requirements for property located on large lots, especially one to two acres where the intent may be to expand or construct a patio cover. Commissioner Bennett recommended amending the wording to state: "Non-Enclosed attached patio covers shall be allowed to extend no closer than 10 feet of the rear property line. In addition, maximum lot coverage can not be exceeded." Vice-Chairman Ames opened and closed the Public Hearing, as no one was present to address the Commissioners. Commissioners discussed the building materials, because the patio cover is classified as an accessory structure. Commissioner Johnston stated that patio covers can be purchased made of metal, tin, or wood. Commissioners desired clarification on roof materials, especially for arbor structures. Commissioners requested further research is done on roofing types, distance, or building materials and size of non-enclosed patio covers. Due to many materials a property owner could construct a patio cover of, and clarification needed on the distance from rear property line, additional information is needed; the consensus was to table the requests until November 6, 2007. A motion was made by Commissioner Bennett, and seconded by Commissioner Onufreiczuk, to table the Text Amendment, until November 6, 2007, in order for staff to obtain additional research on wording of the materials, roofing types, distance, and size for non-enclosed patio covers. Subject property being located at 124 Hooper. Recommendation Motion to approve a Site Plan for Helmberger Industrial Park Addition, Block 1, Lot 3R located at 124 Hooper Lane. Discussion The applicant is proposing to redevelop a commercial property located at 124 Hooper Lane. The property is zoned Light Industrial (LI) and totals 1.0 acre in size. An amended plat was approved on this property in September 2007 which slightly altered existing boundary lines between lots 2R and 3R. Two existing buildings measuring 1,966 sq. ft. and 1,200 sq. ft. are on the site. The existing structures were developed as a residence and office space, respectively. The applicant is proposing an animal related use (Animal Boarding/Kennel without outside pens) for the 1,200 square foot building on the property. Site work, as required by the ordinance, will consist of landscape improvements, resurfacing and the addition of pavement and necessary parking, alterations to building elevations, and the eventual demolition of the 1,966 s.f. building. Proposed modifications to the exterior of the remaining building will include application of brick or masonry to the side and rear elevations. In September 2007,ZBA denied a request for a variance from the applicant regarding the use of 100%masonry. A text amendment was approved by City Council on October 23, 2007 to allow Animal Boarding Kennels without outside pens as a permitted use within the Light Industrial zoning district. In summary, the proposed site plan for the development conforms to nonresidential design standards in meeting the intent of the ordinance. Site design is acceptable given the added required improvements, including the upgrading of one nonconforming building, the removal of another, and the paving of driveways,parking spaces, and property access. Staff supports and recommends approval of the site plan subject to the removal of the 1,966 sf non-conforming building in a timely manner. Recommendation Motion to recommend approval to the City Council regarding an amendment to Zoning Ordinance Article 3 (Residential District Regulation). Discussion After careful review and consideration staff is recommending a change to the set-back requirements for non-enclosed attached structures in residential districts. More specifically, a change in the ordinance is recommended to allow for the construction of attached patio covers that may not otherwise be possible under the current ordinance. The current ordinance does not take into consideration the multitude of residential homes that are built on or near the rear building set- back lines. In addition, many of these homes are built with pre-poured concrete patios that extend from the main structure into the rear yard set-back. Under the current ordinance no cover can be constructed over these patios without a variance. Over the past several months numerous cases have come before the Zoning Board of Adjustment (ZBA) requesting variances to the ordinance for set back requirements in order to build a non-enclosed patio cover. In all of these cases the requests were granted. During the October 16, 2007 meeting of this Commission a potential ordinance change was presented by staff. After some discussion the item was tabled pending edits to the maximum allowable size and allowable materials. Staff has further researched those items of concern and amended the recommended change. Therefore, the recommended revision is to insert the following paragraph into Subsection 4(Additional Provisions) of Sections 3.1, 3.2,and 3.3. that reads: " Non-Enclosed attached patio covers, although an addition to and part of the main structure, shall be exempt from the rear yard set back requirements above. Patio covers shall be allowed to extend into the rear setback no closer than 10 feet from the rear property line provided maximum lot coverage is not exceeded." This wording allows for the maximum amount of flexibility for the citizens, as the lot coverage limits size and the building code will limit materials, while maintaining the spacing, aesthetics, safety, and consistency within Wylie neighborhoods. The material type will be determined by the Building Inspections Department at the time of permitting as regulated by Article 3 of the Zoning Ordinance. The property owner/applicant must submit construction plans to the Building Department for review and approval. At that time, the Plans Examiner will review for compliance with zoning Page 1 of 2 Page 2 of 2 ordinance and all applicable building codes. As part of the amendment staff is also recommending the addition of maximum lot coverage to all residential districts except Multifamily. The recommended coverage ranges from 45-60% depending on the zoning district. Because patio covers are a part of the main structure they are included when calculating maximum lot coverage. This addition would limit excessively large patio covers while still allowing for flexibility in design and placement. This additional amendment also makes Wylie consistent with other nearby cities yet conforms with the Comprehensive Plan in providing adequate open space (light, air and vegetation), which includes impervious surfaces consistent with preserving that rural & suburban character of Wyle. This amendment does not allow for patios to be permanently enclosed and/or serve as an occupied inhabitable space. If the property owner wishes to initially, or at a later date build a permanently enclosed patio, the current setback requirements for that property must be met or the property owner must obtain a variance from ZBA in accordance with Article 8, Section 8.4 of the current Zoning Ordinance prior to any construction and permits being issued. In summary, all ZBA cases regarding set-backs and patio covers this year have been granted. The revised ordinance would negate the need for all but one of these cases. The revised ordinance would also allow for citizens to efficiently and effectively cover portions of their back yards. The proposed ordinance revisions would be keeping with the intent of the current ordinance, maintains safety and aesthetics, and potentially reduce energy use by limiting direct sunlight exposure into homes. These districts provide for very low density residential development and agricultural uses which will preserve the rural amenities and character. A. Agricultural District(AG/30) 1. Purpose: Land within Wylie which is presently used for agricultural purposes and to which urban services may not yet be available should continue to be used for such agricultural purposes until needed for urban purposes in conformity with the City's Comprehensive Master Plan. Livestock may be maintained indoors and outdoors within the Agricultural District. It is anticipated that lands currently zoned and used for agricultural purposes will eventually be used for more urban purposes as the City develops.Newly annexed areas that are predominantly used for agricultural purposes will be zoned as an agricultural district until other zoning is required. 2.
