CALL TO ORDER
Chairman Dennis Larson announced that a quorum was present and called the
meeting to order at 7:03PM. Those present besides Chairman Larson were, Vice-
Chair Scott Ames, Commissioner Ramona Kopchenko, Commissioner Phillip
Johnston, and Commissioner John Onufreiczuk. Those absent were Commissioner
Tim Bennett, and Commissioner Ruthie Wright.
Staff present was Renae 011ie, Jasen Haskins, and Mary Bradley.
INVOCATION & PLEDGE OF ALLEGIANCE
Commissioner Onufreiczuk gave the invocation and Vice-Chair Ames led the pledge
of allegiance.
CITIZENS COMMENTS
Chairman Larson opened the Citizens Participation. No one approached the
Commissioners; Chairman Larson closed the Citizens Participation.
CONSENT ITEMS
1. Consider and act upon approval of the Minutes from the October 16,
2007 Regular Meeting.
A motion was made by Commissioner Onufreiczuk, and seconded by Vice-Chair
Ames, to approve the minutes from October 16, 2007 Regular Meeting, as

REGULAR AGENDA
Action Agenda
1. Consider and act upon approval for a Site Plan for Helmberger
Industrial Park Addition, Block 1, Lot 3R. Subject property located
at 124 Hooper Road.
Mr. Haskins stated that the applicant is proposing to redevelop a commercial
property located at 124 Hooper Lane. An amended plat was approved on this
property in September 2007 which slightly altered existing boundary lines
between lots 2R and 3R.
Two existing buildings measuring 1,966 square feet and 1,200 square feet are on
the site. The applicant intends to convert the 1,200 square foot existing building
into an animal related use. The site work required prior to obtaining a Certificate
of Occupancy, consists of landscape improvements, resurfacing and the addition
of pavement and necessary parking, alterations to building elevations, and the
eventual demolition of the 1,966 square foot building.
In September 2007, Zoning Board of Adjustment denied a request for a variance
from the applicant requesting no additional masonry to the side or back of the
building. Therefore, the proposed modifications to the exterior will include
application of brick or masonry to the side and rear elevations.
Staff supports and recommends approval of the site plan subject to the removal
of the 1,966 square foot non-conforming building in a timely manner.
Chairman Larson questioned the definition of timely manner. Ms. 011ie stated
that the applicant is leasing the property with the intention to purchase, and will
remove the non-conforming building at the time of purchase. Commissioner
Onufreiczuk questioned the expiration of the lease. Ms. Victoria Bonds, 508
Shore Drive, Wylie, stated that the lease is for one-year and that by December
31, 2008, the non-conforming building will be removed.
Ms. 011ie stated that the outdoor kennel is removed from the Site Plan, per the
text amendment approved by City Council. The text amendment stated that no
outside kennel is permitted within any Non-Residential District, except for Heavy
Industrial District and Corridor Commercial with a Specific Use Permit.
A motion was made by Commissioner Onufreiczuk, and seconded by
Commissioner Johnston, to approve the Site Plan for Helmberger Industrial Park
Addition, Block 1, Lot 3R, with conditions that if the use continues by December
31, 2008, the existing 1,966 square foot non-conforming building be removed.
Motion carried 5 — 0.

PUBLIC HEARING
1. Hold a Public Hearing and consider a recommendation to City
Council regarding an amendment to Zoning Ordinance 2006-04,
Article 3, Sections 3.1,3.2, and 3.3: Amending certain Additional
Provisions to the regulation of Yard Requirements regarding patio
covers. Text Amendment
Mr. Haskins stated that the item was tabled at the October 16, 2007, regular
meeting. Staff has revised the following paragraph into Subsection 4 (Additional
Provisions) of Sections 3.1, 3.2, and 3.3, that reads:
"Non-enclosed attached patio covers, although an addition to and part
of the main structure, shall be exempt from the rear yard set back
requirements above. Patio covers shall be allowed to extend into the
rear setback no closer than 10 feet from the rear property line provided
maximum lot coverage is not exceeded."
This wording allows for the maximum amount of flexibility for the citizens, as the
lot coverage limits size and the building code will limit materials, while
maintaining the spacing, aesthetics, safety, and consistency within Wylie
Neighborhoods. The material type will be determined by the Building Inspections
Department at the time of permitting as regulated by Article 3 of the Zoning
Ordinance.
Also, Staff is recommending the addition of maximum lot coverage to all
residential districts except Multifamily.
Staff distributed a photo of a patio cover that was approved by Building
Inspections that was constructed out of non-corrugated metal and pre-fabricated.
Mr. Haskins stated that one of the items of discussion from the previous meeting,
included the building materials. The Commissioners received and reviewed a
photo of a patio cover that was approved by Building Inspections. The patio
cover was constructed out of non-corrugated metal and pre-fabricated material,
which is allowed from the Building Code. Therefore, the Zoning Ordinance
amendment will not regulate the building materials, but will limit the setbacks and
size of the accessory buildings. The consensus from the Commissioners, after
looking at the photo, was that the patio cover looked very nice. Ms. 011ie stated
that Commissioner Wright did submit a written concern of excluding the "little
people" when considering the restrictions for patio covers, since she was unable
to attend the meeting.
Chairman Larson questioned the maximum lot coverage for Manufactured Mobile
Home. Mr. Haskins stated that Manufactured Homes are typically placed on a
designated lot within a Manufactured Home Park. The lots are usually long and
narrow, so the size of the designated lot will limit the size of the patio cover.
Chairman Larson opened and closed the Public Hearing, as no one was present
to address the Commissioners.

A motion was made by Vice-Chair Ames, and seconded by Commissioner
Kopchenko, to recommend approval to City Council regarding an amendment to
Zoning Ordinance 2006-04, Article 3, Sections 3.1., 3.2, and 3.3: Amending

patio covers. Motion carried 5 — 0.
MISCELLANEOUS
All of the Commissioners were in consensus not to have a meeting on November
20, 2007 or December 18, 2007. A holiday celebration will be held after the
meeting on December 4, 2007, for the Commissioners and Staff.

A motion was made by Commissioner Onufreiczuk, and seconded by
Commissioner Johnston to adjourn the meeting at 7:25p.m. All Commissioners
were in consensus.

Discussion
The property totals 3.915 acres and will create and establish a commercial business campus consisting of nine lots
and one common area lot. Located within the Regency Park Industrial area, the property has frontage along
Regency Drive and Steel Road.
May 2007, City Council approved (PD-2007-14) to rezone from Light Industrial to Planned Development -
Light Industrial to accommodate an innovative commercial/industrial campus with a common area and privately
maintained access easements connecting interior lots.
Site Plan Review & Building Permits are required for development of each lot. Portions of the property are
being dedicated for street rights-of-way by this plat and the necessary water and sanitary sewer services have
been extended.
The Final Plat complies with all applicable technical requirements of the City of Wylie including the
Subdivision Ordinance.

Ordinance 2006-04, Article 5, Section 5.1(F)(3): Retail, Personal Service & Commercial, establishing regulations
specifying the location of Major Automobile Repair uses.
Recommendation
Motion to recommend approval to the City Council to amend Article 5, Section 5.1(F)(3): Retail, Personal Service &
Commercial, allowing Major Automobile Repair uses with an SUP in the Light Industrial Zoning District.
Discussion
Staff has conducted research on the permitted uses within the Light-Industrial (LI) District. Particularly Automobile
Repair, Major. Currently the use is allowed by right in Commercial Corridor and Heavy-Industrial Zoning Districts.
Staff has been approached by a property owner who wishes to operate such use in the City limits of Wylie. However,
the property is currently zoned LL The subject property is located within the Regency Business Park Addition.
The 1962 Zoning Ordinance allowed automobile repair shops subject to no out door storage or outdoor work being
performed in the Commercial 1 and Industrial Zoning Districts. However, with the adoption of the 1985 Zoning
Ordinance Commercial Business Districts C-1 & C-1-R were further refined and replaced with Retail and Business
Districts B-1 & B-2. Automobile repair garage became a permitted use by right within the B-2 Business District and
the Industrial Zoning District. The intent of the B-2 district was to provide uses that are not generally carried on
completely within a building or structure.
Additional revisions and amendments came in 2001 in which the old B-1 and B-2 Districts converted to either
Community Retail or Commercial Corridor Districts. The Regency Business Park Addition annexed in 1984 was
rezoned from Industrial to Business Center (BC) in February 2002 with the adoption of the new city-wide Zoning
Ordinance and Map. The new Business Center District allowed for light assembly and office warehouse uses.
In 2006, the City implemented major revisions to Article 5 of the Zoning Ordinance and the official Zoning Map.
Ordinance 2006-04 & 2006-58 eliminated Business Center (BC) District and Industrial (I) District and created Light
Industrial (LI) and Heavy Industrial(HI) Districts.

It is staff recommendation that major automobile repair uses should be allowed within the Light Industrial Zoning
District with a Specific Use Permit. The Light Industrial Zoning District includes less-intensive assembly,
warehousing and distribution of products, while excludes uses such as but not limited to meat packing, chemicals
and petroleum processing and manufacturing and foundries. The Special Use Permit would provide a means for
developing certain uses in a manner in which the proposed use will be compatible with adjacent properties and
allows for site specific conditions where certain impacts may exist that require additional review to ensure
compatibility between uses. For example, by requiring an SUP, outside storage could be restricted or limited,
whereas without such conditions, outside storage would be allowed by right within the LI District.
Text Amendments are only required to be notified 15 days prior to the public hearing in the official newspaper of the
City. This requirement has been met.
This item will be considered by City Council at its January 8,2008 meeting.
