Ordinance 1985-111 ORDINANCE NO. J'.5.- /1/ AN ORDINANCE ADOPTING AN INTERIM RATE ORDER APPROVED BY THE PUBLIC UTILITY COMMISSION OF TEXAS IN REGARD TO DOCKET NO. 6475; APPLICATION OF FARMER'S ELECTRIC COOPERATIVE, INC., FOR A RATE INCREASE; ADOPTING RATE SCHEDULES TO BE CHARGED BY FARMER'S ELECTRIC COOPERATIVE, INC., PROVIDING FOR AN EFFECTIVE DATE FOR SUCH RATE SCHEDULES AND PROVIDING CONDITIONS UNDER WHICH SUCH RATE SCHEDULES MAY BE CHANGED, MODIFIED, AMENDED, OR WITHDRAWN. WHEREAS, on September 5, 1985, Farmer's Electric Cooperative, inc. filed a stateoent of intent with the City of Wylie, Texas to increase its revenues 6.73% over test revenues (12 months ending June 30, 1985) through proposed revisions of tariffs, schedules and statements specifying in detail each proposed change for each class of customers and WHEREAS, the City of Wylie, acting under it's Home Rule Charter, the Constitution & Home Rule Statutes of the State of Texas suspended the effective date of such proposed revisions from an effective date of October 10, 1985 to allow for further study and review, investigation, presentation of evidence and findings of the Public Utility Commission. WHEREAS, the City of Wylie, Texas finds that Farmer's Electric Cooperative, Inc. should be granted interim rate relief until final disposition is made in this case and that the PUC interim order meets this determination. THEREFORE, be it ordained by the City Council of the City of Vylie, Texas: SECTION 1: That interim rate relief is appropriate and that an increase in the rates, tariffs and charges of Farmer's Electric Cooperative, Inc. for electric power and energy sold within the City be approved in an amount such that the adjusted total system wide operating revenues be increased $2,724,131, per annum based on the adjusted test year ending June 30, 1985, which constitutes an increase of approximately 4.92%. Such interim schedules of rates, as approved in accordance herewith (see PUC schedules on Farmer's Electric Cooperative, Inc., Revenue Requirements 1 through 5 and staff cost of service study - Proposed Base Rate Revenue Re~uirement nos. 1-5 revised - Docket Q6475) are those under which said company shall be authorized to render electric service and to collect charges from it's customers for the sale of electric power and energy within the corporate limits of the City until such time as said rate schedules may be changed, modified, amended or withdrawn, with the approval of the City Council. SECTION 2: That Farmer's Electric Cooperative, Inc., shall file with the City of Wylie, Texas, within thirty (30) days from the final passage of this ordinance a re~ised schedule of rates and tariffs consistent with State and Federal Law setting forth those rates, tariffs and charges based upon an increase in total operating revenues as prescribed herein. Such schedules of rates and tariffs may be amended or modified upon final determination of the Council of Farmer's Electric Cooperative, Inc. rate request. SE:CTION 3: That such Schedule of Rates, Tariffs and Service Regulations shall be effective for consumption from and after 1 December 1, 1985 in accordance with the Interim Rate Order issued from the proceedings of Docket No. 6475. SECTION 4: That the action of the City Council of Wylie, Texas enacting this ordinance, on the date of it's passage, only an interim rate and tariff schedule for Farmer's Electric Cooperative, Inc. and does not constitute a final determination in the rate request by Farmer's Electric with the Wylie City Council. SECTION 5: Nothing in this ordinance shall hereafter as limiting or modifying, and power of the City to regulate Farner's Electric Cooperative, Inc. be construed now or in any manner, the right the rates and charges of MEETING OF THE CITY COUNCIL OF JANUARY, 1986. .----.....\, Tern 2
