Resolution 2021-20RESOLUTION NO.2021-20(R) A RESOLUTION OF THE CITY OF WYLIE, TEXAS, ORDERING A BOND ELECTION TO BE HELD IN THE CITY OF WYLIE, TEXAS, MAKING PROVISIONS FOR THE CONDUCT OF THE ELECTION AND RESOLVING OTHER MATTERS INCIDENT AND RELATED TO SUCH ELECTION. WHEREAS, the City Council of the City of Wylie, Texas (the "City") hereby finds that an election should be held to determine whether said governing body shall be authorized to issue bonds of said City in the amounts and for the purposes hereinafter identified; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1: An election shall be held on the 2"d day of November, 2021, in the City of Wylie, Texas, which date is not less than seventy-eight (78) nor more than ninety (90) days from the date of the adoption hereof and is a uniform election date pursuant to Texas Election Code, Section 41.001, for the purpose of submitting the following measures: CITY OF WYLIE, TEXAS PROPOSITION A "Shall the City Council of the City of Wylie, Texas, be authorized to issue general obligation bonds of the City in the principal amount of $35,100,000 for permanent public improvements and public purposes, to wit: developing, engineering, constructing, reconstructing, improving, repairing, extending, expanding and enhancing McMillen ' Drive, Park Boulevard and Ballard/Sachse Road, including sidewalks and necessary and related storm drainage facilities and improvements, utility relocations and the acquisition of any needed land and rights -of -way therefor; such bonds to mature serially or otherwise over a period not to exceed FORTY (40) years from their date, to be issued and sold in one or more series at any price or prices and to bear interest at any rate or rates (fixed, floating, variable or otherwise) as shall be determined within the discretion of the City Council at the time of issuance or sale of the bonds; and to cause to be imposed, assessed and collected annual ad valorem taxes, within the limitations prescribed by law, on all taxable property in the City sufficient to pay the principal of and interest on and to provide a sinking fund to redeem the bonds as they become due?" CITY OF WYLIE, TEXAS PROPOSITION B "Shall the City Council of the City of Wylie, Texas, be authorized to issue general obligation bonds of the City in the principal amount of $10,000,000 for permanent public improvements and public purposes, to wit: developing, engineering, constructing, reconstructing, improving, repairing, extending, expanding and enhancing streets, thoroughfares, alleys and sidewalks, including necessary and related storm drainage facilities and improvements, utility relocations and the acquisition of any needed land and rights -of -way therefor; such bonds to mature serially or otherwise over a period not to exceed FORTY (40) years from their date, to be issued and sold in one or more series at any price or prices and to bear interest at any rate or rates (fixed, floating, variable or otherwise) as shall be determined within the discretion of the City Council at the time of ' issuance or sale of the bonds; and to cause to be imposed, assessed and collected annual ad valorem taxes, within the limitations prescribed by law, on all taxable property in the City Resolution No. 2021-20(R) Ordering Bond Election 102744976.4/1001162288 sufficient to pay the principal of and interest on and to provide a sinking fund to redeem the bonds as they become due?" ' CITY OF WYLIE, TEXAS PROPOSITION C "Shall the City Council of the City of Wylie, Texas, be authorized to issue general obligation bonds of the City in the principal amount of $5,000,000 for permanent public improvements and public purposes, to wit: developing, engineering, constructing, reconstructing, improving, repairing, extending, expanding and enhancing streets, thoroughfares, alleys and sidewalks in the Wylie downtown historic district, including necessary and related storm drainage facilities and improvements, utility relocations, street lighting, signage, noise abatements, traffic signalization and controls equipment and the acquisition of any needed land and rights -of -way therefor; such bonds to mature serially or otherwise over a period not to exceed FORTY (40) years from their date, to be issued and sold in one or more series at any price or prices and to bear interest at any rate or rates (fixed, floating, variable or otherwise) as shall be determined within the discretion of the City Council at the time of issuance or sale of the bonds; and to cause to be imposed, assessed and collected annual ad valorem taxes, within the limitations prescribed by law, on all taxable property in the City sufficient to pay the principal of and interest on and to provide a sinking fund to redeem the bonds as they become due?" SECTION 2: In accordance with the provisions of an election services contract with the Collin County Elections Administrator (the "Collin County Contract') for that portion of the City located in Collin County, an election services contract to be entered into with the Dallas County Elections Administrator (the "Dallas County Contract") for that portion of the City located in Dallas County and an election services ' contract to be entered into with the Rockwall County Elections Administrator (the "Rockwall County Contract') for that portion of the City located in Rockwall County, the election shall be conducted by the Collin County Elections Administrator, the Dallas County Elections Administrator and the Rockwall County Elections Administrator, respectively, in accordance with the provisions of the respective election services contracts (collectively, the "Contracts"). SECTION 3: (a) With respect to that portion of the City located in Collin County, early voting for this election shall be conducted October 18, 2021 through October 29, 2021. The Collin County Elections Administration, 2010 Redbud Boulevard, Suite 102, McKinney, Texas 75069, is hereby designated the main early voting polling place, and Bruce Sherbet, Collin County Elections Administrator, is hereby appointed early voting clerk and shall appoint and designate deputy clerks for early voting in accordance with the Collin County Contract. Early voting for that portion of the City located in Collin County will also be conducted at the locations shown in Exhibit A and all other locations as designated by the Collin County Elections Administrator, in accordance with the Collin County Contract. For purposes of processing ballots cast in early voting, the election officers for the early voting ballot board for this election shall be appointed and designated in accordance with the provisions of the Collin County Contract. (b) With respect to that portion of the City located in Dallas County, early voting for this election shall be conducted October 18, 2021 through October 29, 2021. The Dallas County Elections ' Administration, George L. Allen Sr. Courts Building, Main Lobby, 600 Commerce Street, Dallas, Texas 75202, is hereby designated the main early voting polling place, and Michael Scarpello, Dallas County Elections Administrator, is hereby appointed early voting clerk and shall appoint and designate deputy Resolution No. 2021-20(R) Ordering Bond Election 102744976.4/1001162288 clerks for early voting in accordance with the Dallas County Contract. Early voting for that portion of the ' City located in Dallas County will also be conducted at the locations shown in Exhibit A and all other locations as designated by the Dallas County Elections Administrator, in accordance with the Dallas County Contract. For purposes of processing ballots cast in early voting, the election officers for the early voting ballot board for this election shall be appointed and designated in accordance with the provisions of the Dallas County Contract. (c) With respect to that portion of the City located in Rockwall County, early voting for this election shall be conducted October 18, 2021 through October 29, 2021. The Rockwall County Library, 1215 E. Yellowjacket Lane, Rockwall, Texas 75087, is hereby designated the main early voting polling place, and Christopher J. Lynch, Rockwall County Elections Administrator, is hereby appointed early voting clerk and shall appoint and designate deputy clerks for early voting in accordance with the Rockwall County Contract. Early voting for that portion of the City located in Rockwall County will also be conducted at the locations shown in Exhibit A and all other locations as designated by the Rockwall County Elections Administrator, in accordance with the Rockwall County Contract. For more information regarding the City early voting locations within Rockwall County, please contact the Rockwall County Elections Department at (972) 204-6200 or www.rockwallvotes.com. For purposes of processing ballots cast in early voting, the election officers for the early voting ballot board for this election shall be appointed and designated in accordance with the provisions of the Rockwall County Contract. ' SECTION 4: (a) Election day voting for that portion of the City located in Collin County will also be conducted at the locations shown in Exhibit B and all other locations as designated by the Collin County Elections Administrator, in accordance with the Collin County Contract. The election officers and maximum number of clerks for each voting place shall be determined and appointed in accordance with the Collin County Contract. (b) Election day voting for that portion of the City located in Dallas County shall be conducted at the locations and the polling places designated for each election precinct as shown in Exhibit B and all other locations as designated by the Dallas County Elections Administrator, in accordance with the Dallas County Contract. The election officers and maximum number of clerks for each polling place shall be determined and appointed in accordance with the Dallas County Contract. (c) Election day voting for that portion of the City located in Rockwall County shall be conducted at the locations and the polling places designated for each election precinct as shown in Exhibit B and all other locations as designated by the Rockwall County Elections Administrator, in accordance with the Rockwall County Contract. The election officers and maximum number of clerks for each polling place shall be determined and appointed in accordance with the Rockwall County Contract. On election day, the polls shall be open from 7:00 a.m. to 7:00 p.m. SECTION 5: A voting system or systems meeting the standards and requirements of the Texas Election Code, as amended, is hereby adopted and approved for early voting by personal appearance and by mail and for election day voting. The ' Manager and Presiding Judge of such Central Counting Station may appoint clerks to serve at such Central Counting Station, as provided by Texas Election Code, Section 127.006, as amended. With respect to voters of the City residing in Dallas County, the Central Counting Station for the tabulation and counting of ballots for this election shall be located at the Dallas County Elections Administration, 1520 Round Table Drive, Dallas, Texas 75247 and the Manager, Tabulation Supervisor, Presiding Judge and Alternate Presiding Judge at such Central Counting Station shall be determined, appointed and designated in accordance with the Dallas County Contract. The Manager and Presiding Judge of such Central Counting Station may appoint clerks to serve at such Central Counting Station as provided by Texas Election Code, Section 127.006, as amended. With respect to voters of the City residing in Rockwall County, the Central Counting Station for the tabulation and counting of ballots for this election shall be located at the Rockwall County Elections Administration, 915 Whitmore Drive, Suite D, Rockwall, Texas 75087 and the Manager, Tabulation Supervisor, Presiding Judge and Alternate Presiding Judge at such Central Counting Station shall be determined, appointed and designated in accordance with the Rockwall County Contract. The Manager and Presiding Judge of such Central Counting Station may appoint clerks to serve at such Central Counting Station as provided by Texas Election Code, Section 127.006, as amended. SECTION 7: This election shall be held and conducted in accordance with the provisions of Texas Election Code and Texas Government Code, Chapter 1251, and to the extent required by law, all election materials and proceedings shall be printed in both English and Spanish. Resolution No. 2021-20(R) Ordering Bond Election 102744976.4/1001162288 SECTION 8: Notice of election, including a Spanish translation thereof, shall be published on ' the same day in each of two successive weeks in a newspaper of general circulation in the City, the first of these publications to appear in such newspaper not more than 30 days, and not less than 14 days, prior to Election Day. Moreover, a substantial copy of this Resolution and the voter information attached as Exhibit C, including a Spanish translation thereof, shall be posted (i) at City Hall not less than 21 days prior to Election Day; (ii) at three additional public places within the City not less than 21 days prior to Election Day, (iii) in a prominent location at each polling place on Election Day and during early voting, and (iv) in a prominent location on the City's intemet website not less than 21 days prior to Election Day. A sample ballot shall be posted on the City's intemet website not less than 21 days prior to Election Day. SECTION 9: In accordance with Texas Election Code, Section 3.009(b), as amended, the aggregate amount of outstanding principal of the City's debt obligations secured by ad valorem taxes as of the date of adoption of this Resolution, totaled $74,420,000; the aggregate amount of outstanding interest on the City's debt obligations secured by ad valorem taxes as of the date of adoption of this Resolution, totaled $16,220,048; and the ad valorem debt service tax rate for the City as of the date of the adoption of this Resolution is $0.1598 cents per $100 of taxable assessed valuation. Based on the bond market conditions at the date of adoption of this Resolution, the maximum net effective interest rate for any series of the bonds is estimated to be 4.50%. Such estimated maximum rate is provided as a matter of information and in accordance with the requirements of Texas law, but is not a limitation on the interest rate at which the bonds, or any series thereof, may be sold. SECTION 10: This Resolution hereby incorporates the provisions of the Collin County Contract, the Dallas County Contract and the Rockwall County Contract, and to the extent of any conflict between this Resolution and the Collin County Contract, the Rockwall County Contract and the Dallas County ' Contract, the provisions of the Collin County Contract, the Rockwall County Contract, the Dallas County Contract, as applicable, shall control. The Mayor, City Manager or City Secretary or other appropriate official, is hereby authorized to correct, modify or change the Exhibits to this Resolution based upon the final locations and times agreed upon by the Collin County Elections Administrator, the Dallas County Elections Administrator and the Rockwall County Elections Administrator, as applicable, and the City.
