BEING AN ORDINANCE OF THE CITY OF WYLIE, A HOME RULE
POLITICAL SUBDIVISION OF THE STATE OF TEXAS,
ESTABLISHING PERMITTED TIMES FOR REFUSE TO BE PLACED IN
RIGHT-OF-WAY FOR PICK UP PROVIDING FOR A REPEALING
CLAUSE, PROVIDING FOR A SEVERABILITY CLAUSE, PROVIDING
PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED
THE SUM OF FIVE HUNDRED DOLLARS ($500.00) FOR EACH
OFFENSE; AND DECLARING AN EFFECTIVE DATE:
WHEREAS
The City Council has determined that the premature
placement of Refuse provides an attractive
nuisance, and
WHEREAS
The City Council has determined that premature
placement to Refuse is detramental to the health,
safety and welfare of the citizens of the City of
Wylie, therefore:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE,
COLLIN COUNTY, TEXAS, THAT
SECTION 1: It shall be unlawful, in residential areas of
the City, for any person to place Refuse of any
nature on the right-of-way (front, side, or rear)
prior to the hour of Seven (7) P. M. on the day
prior to designated day of pickup.
SECTION 2: The presence of Refuse in right-of-way of any
residence shall be considered prima facie evidence
that the Refuse as placed there by or on behalf of
the owner or occupant of such residence.
SECTION 3: REPEALING CLAUSE
That all ordinances of the City in conflict with
the provisions of this ordinance be, and the same
are hereby, repealed and all other ordinances of
the City not in conflict with the provisions of
this ordinance shall remain in full force and
effect.
SECTION 4: SEVERABILITY CLAUSE
Should any paragraph, sentence, subdivision,
clause, phrase or section of this ordinance be
adjudged or held to be unconstitutional, illegal
or invlaid, the same shall not affect the validity
of this ordinance as a whole or any part or
provision thereof other than the part so decided
to be invalid, illegal or unconstitutional and
shall not affect the validity of the remaining
portions of this ordinance.
SECTION 5: PENALTY
Any person, firm or corporation violating any of
the provisions or terms of this ordinance shall be
subject to a fine not to exceed the sum of Five
Hundred Dollars ($500.00) for each offense, and
each day such violation shall continue to exist
shall constitute a separate offense.
SECTION 6: PUBLICATION CLAUSE
This ordinance shall take effect immediately from
and after its passage and publication of its
caption, as the law in such cases provides.
