Wingfield 1 HEAL ATTEST:^ Oneida Gallagher, City Secretary 94 SPECIAL COUNCIL MEETING April 27, 1965 The City Council met in special session April 27, 1965 at 7r.00 O+Clock PM for the express purpose of studying con- sidering and passing resolution of policy and procedure in reference to Capital Improvement of the streets of the City of Wylie and costs estimated for various types of improvements to the streets. The meeting was called to order by Mayor Hampton. Those present: Mayor Hampton. Aldermen: St. John, Shields, Onstot Miller and Wingfield. City Administrator Jack H. Whitt and City Secretary, Oneida Gallagher. The Resolution was read by Mayor Hampton. After a lengthy discussion motion was made by Councilman Miller to pass the Resolution as written and seconded by Councilman Onstot. Unanimous Ayes. Motion was made to adjourn by Councilman Shields and second- ed by Councilman Onstot. Motion carried. May[o///'7" " ty ecretary RESOLUTION i tj THE STATE OF TEXAS Q 0 COUNTY OF COLLIN WHEREAS, the streets of the City of Wylie, Texas, are in need of improvement, and WHEREAS, many citizens of the City of Wylie have requested the City Council to establish a policy regarding the improvements of the streets, and WHEREAS, the City Council of the City of Wylie feels that the streets should be improved and that a policy should be established regarding the improvement of streets; The City Council adopts the following resolutions BE IT RESOLVED BY TUE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: 1 ) That all street improvements shall be permanent. 2) That the abutting property owner shall participate by paying 331/3% of the consteuction costs of a residential type paving section along his abutting property line. 3) That petitions from the owners of abutting properties represent- ing 80% of the abutting property front footage shall be obtained and presented to the City Council along the street or streets in each project. 4) That all petitioned projects shall be subject to approval by the 8ity Council of the City of Wylie, Texas. The City of Wylie shall pay all extra widths and thicknesses that will be required on streets over and above a residential type paving section, for street intersections and alley widths, and for all drainage improvements contingent upon funds being available for said extras and imrpovements . 5) That upon approval of the project by the City Council detailed construction plans and specifications shall be prepared for the approved project and per lineal foot cost announced. 6) Property owners participation for a minimum of 66 2/3% of the paving arts of the project shall be deposited in escrow with the City of Wylie within 15 days after the per lineal foot cost has been an- nounced; otherwise the project will be postponed until 66 2/3% par- ticipation is deposited in escrow. 7 ) The property owners participation shall be for a minimum of 66 2/3$ of the abutting properties of the project and any or all of the cost remaining of the property owner participation not paid at the end of the above described 15 day period shall be assessed. The paving assessment shall bear interest at the rate of 8% per annum, which shall begin at the time of assessment.
