March 8, 1977
The City Council of Wylie met in regular session in Council Chambers at
City Hall on March 8, 1977, at 7:00 PM. Those present were Mayor William
--- Martin; Aldermen Kenneth Nall, Pat Minihan, Stan Shively, Don Thomas and
Dwayne Boyd; City Attorney Ted Kent; City Manager Denton Miller, City
Secretary Doris Wilson; Police Chief O. C. Blanks and Fire Chief Danny
Clark. The meeting was called to order by Mayor Martin.
First item on the agenda was consideration of February minutes and
expenditures for March. Motion for approval was made by Alderman Thomas
with second by Alderman Boyd. Vote of All Ayes.
A Public Hearing was held concerning a request made by Gene Foster to
waiver Zoning restriction on type of building material and permission
to build on Lot that is 10 feet less than Zoning requires for Lot 43
of Southside Addition. The Zoning Board ' s recommendation was that
Mr. Foster remove plumbing merchandise and assorted salvaged material
from behind the proposed residence along with the metal fence before
permit is issued, also, that Mr. Foster remove the existing substandard
building on Lot 45, Southside Addition within 60 days after substandard
building on Lot 44 and Lot 46 have been removed, further more new con-
struction to have brick up 1-1 way of first floor on front. After a
discussion, motion was made by Alderman Nall to give building variance
and lot variance with the stipulation that the business materials, sign
and metal fence will be removed before the building permit is issued.
Second was made by Alderman Thomas. Vote of all ayes.
A Public Hearing was held on Abstract 267, 21.18 acres, owned by Mel
Delaney, to establish Zoning of R-1300-M. Motion was made by Alderman
Shively to approve Ordinance No. 77-3, Establishing Zoning of R-1300-M
for 21.18 acres of Abstract 267, being newly annexed territory to the
City of Wylie. Second was made by Alderman Boyd. Passed on vote of
all ayes.
City Manager Miller read recommendations from the Zoning Board that the
City of Wylie exercise their right on extra-territorialjurisdiction and
platting jurisdiction. Motion was made by Alderman Minihan to send a
letter notifying the Collin County Clerk that Wylie will be exercising
their right on extra-territorial jurisdiction and platting jurisdiction.
Second was made by Alderman Shively. Carried unanimously.
Don Hughes met with Council concerning disturbances at Little League
Baseball games. Council asked that a follow-through be made on deter-
mining if a State Law Sign can be placed at baseball park.
Resolution No. 76-77-3-1, Supporting the Proposed. Amendment of the
Municipal Annexation Act, was passed on motion by Alderman Shively with
second by Alderman Thomas. Motion carried.
Motion was made by Alderman Shively to purchase 650' of fire hose for
$936.00 from Fire Extinguishers and Fire Proofing Company. Second
was made by Alderman Boyd. Motion carried.
Departmental Reports were given by Fire Chief Danny Clark and Police
Chief O. C. Blanks. Motion was made by Alderman Shively to authorize
Police Department to use $1, 000.00 donation to buy items as recommended
to Council. Second was made by Alderman Thomas. Motion carried.
Council decided the City will not pay for radio expense for the City Judge.

Motion was made by Alderman Boyd to request the State to put a traffic
signal at Highway 78 and FM 544. , Second was made by Alderman Shively.
Vote of all ayes. A special Council meeting was called for March 17,
1977, at 5:00 PM to consider bids on water lines. Motion was made to
allow K. C. Swayze to use 6" sewer lines in place of 8" sewer lines as
specified on his , plat to service the short areas. Second was made by
Alderman Nall. Vote of all ayes.
Resolution No. 76-77-3-3, Supporting the Highway Funding Proposal
made by the Governor of Texas was passed on motion made by Alderman
Boyd with second by Alderman Thomas. Motion carried.
Ordinance No. 77-4, an Ordinance amending Section 6 and Section 7
of Ordinance 75-1, (Dog and Cat Control) ; Setting a 72-hour period
for vaccination of dogs impounded by City when released to owner for
dogs which do not have current vaccinations; repealing clause; and
declaring an emergency, was passed on motion by Alderman Minihan with
second made by Alderman Shively. Motion carried.
Ordinance No. 77-5, Itinerant Peddler' s, Vendor' s and Solicitor' s
Ordinance was passed on motion by Alderman Shively with second by
Alderman Minihan. Vote of all ayes.
Motion was made by Alderman Thomas to table electrical ordinance and.
electrical board until next meeting. Second was made by Alderman Nall.
Motion carried.
Council asked that new proposed landfill rates be presented at next
meeting.
Resolution No. 76-77-3-4, Assuring F.I.A. Adequate Land Use and. Control
Measures for Flood Prone Areas, appoint City Manager as responsible
officer, Maintain Elevations and enfone programs, was passed on motion
by Alderman- Shively with second by Alderman Minihan. Motion carried.
Resolution No. 76-77-3-5, Reaffirming the Authority of Reviewing
Plan Specifications for Proposed. Construction, Review of Subdivision,
Requirements of Water and Sewer Infiltration Minimization of Flood
Waters, was passed on motion by Alderman Thomas with second by Alderman
Nall. Motion carried.
Cost estimates were read on improvements on Birmingham Street. Council
asked. City Manager to check on City shooting grades on an asphalt street.
Meeting adjourned into executive session at 10:05 PM.
