Regular City Council Meeting
April 11 , 1978
7 : 00 P,M,
Meeting was called to order at 7 : 00 P.M. by Mayor William
E. Martin. In Attendance Mayor W. E. Martin, Denton Miller?
City Manager, Acting City Secretary, Barbara Ellis , City
Attorney, Ted Kent, Chief of Police, 0, C. Blanks , Fire
Chief, Mike Rawlings , All Aldermen, and Alderpersons elect
Kree present. Invocation was given by Alderman Akin. Also ,
K. C. Swayze, Chuck Elledge , Sue Webster, Representatives
of H.D. R. , Representatives of T.P. $ L. , Melvin St. John,
and Melvin Delaney.
Approval of previous minutes and monthly bills . After dis-
cussion of the minutes and bills , motion was made by Alder-
man Minihan to pass and approve minutes and bills . Seconded
by Alderman Mall . Motion carried and all in favor.
Canvessing Election Results - Order Declaring Results of
City Officers Election. The Election results were read
as follows : John Akin - 85 - Mayor
Pat Miniham - 79 - Alderperson
Shirley Kent - 72 - Alderperson
Kenneth Nall - 1 - Alderperson
Ross Miller - 1 - Alderperson
Motion by Kenneth Nall , second Akin, Motion pass . Alder-
man Ratcliff was not present for the vote on Election results .
Administer Oath - City Attorney, Ted Kent, administered the
Oath of Office to the Alderpersons , Mayor for City of Wylie.
William Martin ask Kenneth Nall to say a few words . Mr.
Nall enjoyed 4 years of Office . William Martin enjoyed his
office and turned the Council over to Mayor John W. Akin.
Mayor Akin explained how the City appreciated their, Mr.
Martin and Kenneth Nalls , work for the City. Alderman Ratcliff
arrived at 7 : 20 P.M.
Appointment of Alderm9.71 to serve unexpired term. Mayor John
W. Akin recommended, genneth Swayze, to be appointed to serve
the one year unexpired term. Motion, Ratcliff, to accept
Kenneth Swayze, as Alderman. Seconded by Richard Parker. Car-
ried all in favor. City Attorney, Ted Kent , administered the
Oath of Office to Alderman Swayze.
Election of Mayor Pro-Tem. Motion was made by Alderman Parker
to elect Alderman Minihan as Mayor Pro-Tem for the next year,
Seconded by Alderwoman Kent. Motion carried all in favor.
Appoint Council Committees . Mayor Akin appointed Alderman
Parker and Alderman Ratcliff to serve on the personnel com-
mittee. Alderman Swayze and Alderman Ratcliff to serve on

the Police and Fire Committe; Alderwoman Kent and Mayor
Pro-Tem Minihan to serve on the Budget Committe ; Alderman --�
Parker and Alderwoman Kent to serve on the Public Works
Committe; and Mayor Pro-Tem Minihan and Alderman Swayze
to serve on the Park and Recreation Committee. --~'
Two New Members for the Planning $ Zoning Board. Mayor
Akin reappointd Chuck Elledge, Frank McMillian, and Dr, Joe
Fulgham to serve on the Planning & Zoning Commission for
the next two years . He also appointed Sue Webster and John
Yeager to serve a two year term on the Planning & Zoning
Commission. He also wanted to express his appreciation to
R.P. Miller for his past service on the P. $ Z. Board.
Opening Bids - Police Cars - An bid made Charles Gothard of
$125. 00 for the Dodge, (1974) , $250. 00 for the Ford, (1975) .
No other bids were made for the equipment and after a dis-
cussion the motion was made by Alderman Minihan to reject
these at this time . Seconded by Alderman Ratcliff. Motion
carried all in favor.
Public Hearing - Noncomforming Use Zoning Variance. After
a Public Hearing was held and Resolution 1977 - 78 P. $ Z
4-1 was read.
A RESOLUTION OF THE CITY OF WYLIE, TEXAS AUTHORIZING THE
BORROWING OF $9 , 700. 00 FOR A FOUR YEAR PERIOD ON THE STREET
PAVING ASSESSMENTS; WITH FOUR YEARLY PAYMENTS.
The Council had a discussion and the motion was made by
Alderman Parker to acceptthe P. & Z . Commissions recommen-
dation and approve Ordinance # 78-12. AN ORDINANCE AMENDING
ORDINANCE # 62- 5 SO THAT A VARIANCE FOR NONCOMFORMING USE IS _
GRANTED TO ALLOW A RESIDENTIAL GARAGE IN A I-1 LIGHT INDUSTRIAL
DISTRICT. Seconded by Alderman Mininhan to accept the var-
iance. Motion carried all in favor.
Public Hearing on Zoning Change. After a Public Hearing
was held and Resolution 1977 - 78 P. $ Z, 4-2 was read and
the discussion completed by the Council a motion was made
by Alderman Mininhan and seconded by Alderman Parker to ac-
cept this Zoning Change recommendation and approve Ordinance
# 78-13. AN ORDINANCE AMENDING ORDINANCE # 62-5 SO THAT A
VARIANCE FOR NONCOMFORMING USE IS GARNTED TO ALLOW A RESIDEN-
TIAL GARAGE IN A I-I LIGHT INDUSTRIAL DISTRICT. Motion car-
ried all in favor.
Public Hearing on Contemplated Annexation of Two Tracts if
Land. Tract 1 and Tract 2 . (Lot and Block and Addition) -
A Public Hearing was held and a discussion was conducted.
There being no opposition the City Manager was instructed
to prepare the Annexation Ordinance to the next regular Meeting.

H. D. $ R. Preliminary Report on Wastewater Treatment Facility.
Bob Scalf brought the Council up to date on the results of
their investigation. Rain fall is over loading the treatment
plant. Industrial waste enters the plant and is a very high
strength waste and causes temporary high waste discharges ,
and presented two preliminary methods of improving the
treatment plant . Sand backwash filters at $129 , 500 . 00 ,
and Micro-Screen Filters at $155 ,000 . 00 , They recommend
the sand filters due to cost and reliability. Will meet
with Council for final recommendations.
Discussion of H.U. D. C. D. Block Grant, Denton Miller brought
the Council up to date on this preapplication procedure and
the things this grant could fund. May 15 , 1978 is dead line
for filing of preapplication
Mr. Miller presented the City Council a proposed Ordinance
controlling fences after discussion the Council tabled the
Ordinance until the next meeting.
Fire Prevention and Engineering Bureau Report . Denton Miller
told the Council of the results of Fire Department Activit-
ies as received by the Bureau.
Street Paving Assessment Report. The Engineers also discussed
the need to contract for a preliminary study of the storm
drainage and street improvements on S, Birmingham and Memorial
Drive and the preapplication andapplication contract for the
HUD Community Developement Block Grant of $500 ,000 . 00 , Motion
by Alderman Mininhair seconded by Alderman Swayze to contract
with HDR to conduct the preliminary design work on the storm
sewer and street design improvements on S. Birmingham and
Memorial Dr. for $1 , 000 . Motion carried all in favor. Motion
by Alderman Swayze , seconded by Alderwoman Kent to contract
with HDR to make preapplications and application with HUD for
a .$500 ,000 Community Development Block Grant for $1 , 500 . Motion
carried all in favor. Resolution 1977 - 78 , 4-1 . Motion was
made by Alderman Parker to have Mayor Akin and City Manager,
Denton Miller, secure a loan of $9, 700. 00 for Street Paving
Assessments to be repaid within 4 years . Seconded by Alder-
man Ratcliff. Motion carried all in favor. Mr. Miller gave
the results of the collections on the Street Paving Assess-
ments and how much was needed to be carried on a loan until
its repaid to the City.
Departmental Repc,rt . Mayor Akin asked Chief, O. C. Blanks , if
he had anything report. After discussion amoung the Council ,
Chief Blanks was dismissed. Fire Chief, Mike Rawlings , came
before the Council and brought 6 Month reports . (R. & D. Reports) .
Mr. Miller went over the 6 months Budget Report and the Cur-
rent Receipts and disbursement report.
Calling of Special City Council Meeting for April 18 ,1978 .
Mayor John W. Akin set April 18 , 1978 as a Special Council
Meeting date to conduct other necessary business .
Mayor Akin appointed Justice of the Peace Buddy Newton to serve
as Municipal Judge for the City of Wylie to begin the term on

April 15, 1978 . Judge Robert King term to end April 301 1978 ,
Motion by Alderman Parker. Seconded by Alderman Swayze to
approve the appointment . Motion carried, all in favor. His
salary was set at $300 , 00 a month.
Motion to adjourn into executive session at 10 : 45 p.M,
