09-12-1978 (City Council) Minutes f REGULAR CITY COUNCIL MEETING September 12 , 1978 7 : 00 P.M. Meeting was called to order by Mayor John Akin at 7 : 00 p.m. Invocation was given by Mayor Akin. Present were Mayor Akin, Mayor Pro-Tem Minihan, Aldermen Parker, Swayze, Ratcliff, Councilwoman Kent , City Attorney Kent , City Manager Miller, Chief-of-Police Randolph, Judge Newton, Fire Chief Rawlings and City Secretary Connelly. Citizens attending were Billy Mills and Thomas Maynard. Alderman Parker made motion to approve previous minutes and monthly bills . Alderman Swayze seconded the motion. Motion carried all in favor. Mayor Akin opened the public hearing on the Proposed Annual Budget for Fiscal Year 1978-79 . Mr. Miller asked if there were any questions "concerning the Budget. Mr. Miller explained the proposed Sanitation Rate Ordinance . He explained the survey which had been conducted and the results . He explained the two rate proposals : Rate #1, $4. 00/res . /mo, Rate #2 , $4 . 25/res . /mo. He also explained the new commercial and special rates . After a discussion of proposed Ordinance #78-28 , Alderman Minihan recommended to the Council that aproval of this ordinance be held until later. The Council discussed the replacement of the staff car which was in the Revenue Sharing Fund. It was recommended by the City Manager that this be deleted this year and the money for it placed under equipment for the Street Department. It was agreed that the 1976 Pontiac which e F^ L� M would be replaced by a new vehicle would be reconditioned as soon as the new vehicle arrived and that bid would go out for the new vehicle as soon as possible. The Council also asked that the Municipal Court portion of the Police Department budget be pulled out and a new department created. Mr. Miller advised these changes would be reflected in the budget. Councilwoman Kent made motion to accept Ordinance #78-25 AN ORDINANCE FIXING THE TAX RATE AND LEVY IN AND FOR THE CITY OF WYLIE, TEXAS, FOR THE YEAR 1978 , UPON ALL TAKABLE PROPERTY IN SAID CITY OF WYLIE, TEXAS, FOR THE PURPOSE OF PAYING THE CURRENT EXPENSES OF SAID CITY OF THE FISCAL YEAR ENDING SEPTEMBER 30 , 1979 ; AND THE FURTHER PURPOSE OF CREATING A SINKING FUND TO RETIRE THE PRINCIPAL AND INTEREST OF THE BONDED INDEBTEDNESS OF SAID CITY; PRO- VIDING THAT IN THE EVENT ANY PROVISIONS OF THIS ORDINANCE BE HELD UNCONSTITUTIONAL AND THAT SUCH HOLDING SHALL NOT AFFECT THE REMAINING PROVISIONS HEREOF; REPEALING ALL ORDINANCES AND PARTS THEREOF IN CONFLICT HEREWITH AND PROVIDING FOR PUBLICATION. Alderman Parker seconded the motion. Motion carried all in favor. Alderman Parker made motion to accept Ordinance #78-26 AN ORDINANCE ADOPTING A REVISED BUDGET APPROPRIATING RESOURCES FO' THE BUDGET YEAR ENDING SEPTEMBER 30 , 1978 . Alderman Swr ze seconded the motion. Motion carried all in favor. Alderman Parker made motion to accept Ordinance #78-27 AN ORDINANCE ADOPTING A BUDGET APPROPRIATING RESOURCES FOR THE BUDGET YEAR BEGINNING OCTOBER 1 , 1978 . Alderman -`� Minihan seconded the motion. Motion carried all in favor. 14 Alderman Minihan made motion to accept Ordinance #78-28 AN ORDINANCE AMENDING ORDINANCE #72-3 AS AMENDED BY ORDINANCE# 75-11 & ORDINANCE #77-7 , SECTION 14a, SECTION 14b, SECTION 18b, PRESCRIBING GARBAGE COLLECTION AND DIS- POSAL RATES IN AND FOR THE CITY OF WYLIE, TEXAS; REGULATING GARBAGE DISPOSAL BY COMMERCIAL USERS OF THE CITY LANDFILL; PROVIDING FOR A PENALTY: AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH; DECLARING AN EMERGENCY AND EFFECTIVE DATE: under proposed Rate #1 . Councilwoman Kent seconded motion. Motion carried all in favor. Alderman Swayze made motion to adopt Resolution #1978-79-9-2 . Councilwoman Kent seconded motion. Motion carried all in favor. A Special City Council was called for September 18 , 1978 to hold the Public Hearing on the Annual Budget for fiscal year from October 1 , 1978 to September 30 , 1979 for the Revenue Sharing Fund. Chief-of-Police Randolph made the Police Department report in written form to the Council . The Council was very pleased with the way the report was presented and in the changes which are being made in the department. Thomas Maynard brought a complaint before the Council on a citation for violation of City Ordinance # 75-2 . Council agreed to corrct the situation in the future . Fire Chief Pawlings presented the Fire Departments monthly report to the Council . The Fire Department was complimented on the fine work they had done in the past month. • Council adjourned into executive session with City Manager Miller and Judge Newton. 'W John W.
