01-09-1979 (City Council) Minutes REGULAR CITY COUNCIL MEETING JANURARY 9 , 1979 7 : 00 P.M. Meeting was called to order by Mayor John Akin. Those present were Mayor Akin, Councilmen Richard Parker , Kenneth Swayze , Curtis Ratcliff, Mayor Pro-Tem Pat Minihan, Councilwoman Shirley Kent , City Attorney Ted Kent , City Manager Denton Miller, City Secretary Sarah Connelly, Chief-of-Police Roy Randolph, Fire Chief Danny Clark, Dr . Joe Fulgham, Dennis Masters , H.D. R. repre- sentative , Sonic Drive In Representatives , Mr. Taylor Hickman, Mr. Jimmy Coppinger , Mr . and Mrs . H. B. Gray, Mr. Gene Woodard, Mr. and Mrs . Bill Coppinger, Mrs . Wanda Butler, Mrs . Armes , Mrs . Sue Webster, Mr. and Mrs . McGuire, and Mr . Mel Delaney. Invocation was given by Councilman Ratcliff . Approval of previous meeting minutes and monthly bills . After discussion over minutes and bills , Mayor Pro-Tem Minihan made motion of acceptance , Councilman Ratcliff seconded . All in favor . Public Hearing on Zoning, Ordinance #79- 3 , AN ORDINANCE AMENDING ORDINANCE #62- 5 AS AMENDED SO THAT A PART OF ZONE R- 900-F SINGLE FAMILY RESIDENTIAL IS CHANGED TO MULTI-FAMILY ZONING. After discussion by citizens on zoning property, Councilman Parker made motion to accept ordinance , Councilman Swayze seconded Motion carried Al in favor . Councilwoman Kent abstained . Public Hearing on Zoning Ordinance #79- 4 , AN ORDINANCE AMENDING ORDINANCE #62- 5 , AS AMENDED SO THAT A PART OF PUBLIC ZONED PROPERTY IS CHANGED TO C-R-1 , COMMERCIAL DISTRICT. After discussion on ordinance Councilman Ratcliff made motion to accept , Mayor Pro-Tem Minihan seconded, motion carried all in favor . d ( Review and Approval of Final Plat of the Dobbs Addition to the City- of Wylie. After discussion Councilman Parker made motion of acceptance, Councilman Swayze seconded, motion carried all in favor. Public Hearing on Rate Study report for Water $ Sanitary Sewer Services- HDR; AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, ESTABLISH- ING WATER $ SEWER RATES; ESTABLISHING DEPOSIT FOR WATER SERVICE; ESTABLISHING A CHARGE FOR SETTING UP AND TURNING ON WATER SERVICE; ESTABLISHING A CHARGE FOR TRANSFERRING OF ACCOUNTS; PROVIDING A SERVICE CHARGE FOR ALL RETURNED CHECKS; PROVIDING A 10% PENALTY ON PAST DUE ACCOUNTS; REPEALING ORDINANCES #70-12 ; 77-20 ; 78-4, PROVIDING FOR A PENALTY. H D R representative Dennis Masters made presentation to Council and citizens present on the rate increase. After discussion, Mayor Pro-Tem made 'his motion, "In view of fact water service is inadequate and : sting lines and requirements of EPA leaves us no alternatiye , c for the Council to accept his motion for acceptance of propose _ rate number 1 , as proposed by HDR making rate study. But that an ordinance needs to be made that will give relief to citizens 65 years of age or older owning or renting a home with the water account in their name on fixed income by coming in and signing up for such if they qualify within the guidelines of this special ordinance. Councilwoman Kent seconded motion, all in favor of accepting -dinance #79-5 . Public Hearing- Paving of Alley between So. 2nd creet and Hilltop Land and behind 200 , 400 Bik of E . Stone $ Duncanway. Discussion of Paving Ordinance $ Assessment Ordinance . Due to not enough public interest from property owners . Mayor Pro-Tem Minihan made motion to kill petition, Councilman Ratcliff seconded, motion carried all in favor. Melvin Delaney - Request to relay waterline serving his property. Councilman Swayze made motion to grant Mr. Delaney the relay, at Mr. Delaney' s own expense and maintainence . Councilwoman Kent seconded, motion carried all in favor . .,_._ Speed Zone Ordinance #79-6 , AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED FOR VEHICLES UNDER THE PROVISIONS OF SECTION 8 OF ARTICLE 827a VERNON' S TEXAS PENAL CODE, UPON SOUTH BALLARD AVE. OR PARTS THEREOF , WITHIN THE INCORPORATED LIMITS OF THE CITY OF WYLIE, AS SET OUT IN THIS ORDINANCE , PROVIDING FOR A PENALTY. After discussion Councilman Parker made motion of acceptance, Councilman Swayze seconded, motion carried all in favor . Departmental Reports , Monthly R&D Reports . First Quarter Budget Report . Fire Chief Clark made report on Fire Department to Council . Chief-of-Police Randolph made Police Department. Mr. Miller presented First Quarter Report to Council . Petition to Annex 45 . 910 acres in Abst . #23 , A. Atterbury Survey purchased by City of Wylie . Motion of acceptance was made by Councilwoman Kent, seconded by Councilman Parker , all in favor. Review of Financial Audit Report for Fiscal Year Ending Sept. 30 , 1978 was presented to Council by Mr . Miller . Discussion and Approval of Water & Sewer Easement from Ed $ Virginia Collins . Mr. Miller advised Council that easement had not been obtained. Adjournment into Executive session was made by Councilwoman Kent, seconded F ;ouncilman Ratcliff, all in favor . /2 ohn W.
