02-13-1979 (City Council) Minutes } REGULAR CITY COUNCIL MEETING February 13 , 1979 '-" 7 : 00 P.M. Those in attendance were Mayor Akin, Councilmen Parker, Swayze, Ratcliff, Mayor Pro-Tem Minihan, Councilwoman Keny, City Manager Miller, City Attorney Kent, City Secretary Connelly, Chief-of-Police Randolph, Fireman Mike Rawlings, Mike Schweikhard, Lone Star Gas represent- ative; Walt Broemer and Smokie Bupie, Intertribal Indian Housing representatives ; Mr. Rowland Kreymer and Mr. Pike Tyner. Invocation was given by Mr . Miller . Councilman Parker made motion of approval of previous minutes and monthly bills . Councilman Swayze seconded, all in favor. Mr. Walt Broemer, representative of Intertribal Indian Housing, presented Resolution #79- 2-2 to Council "A RESOLUTION AUTHORIZING PUBLICATION OF THE INTENT TO ENTER INTO A COOPERATION AGREEMENT WITH THE TEXAS INTER- TRIBAL INDIAN HOUSING AGENCY OF TEXAS. " Mr. Broemer explained the program to the Council . Councilman Parker Wff.i* made motion to adopt resolution. Councilman Ratcliff seconded motion passed all in favor. Public Hearing on annexation of 45 . 910 acres of land out of the A. Atterbury Survey, Abst. #23 , located East of and adjacent to the High School Mayor Pro "em Minihan made motion of annexation, Councilman Park seconded, motion passed all in favor. Mr. Miller presented Proposed Ordinance #7,: "PROVIDING FOR A REDUCTION CREDIT ON WATER AND SEWER U. LITY SERVICES PROVIDED BY THE CITY OF WYLIE ; ESTABLISHING AE ELIGIBILITY REQUIREMENTS; PROVIDING THAT THE DURATION OF PERIOD FOR PENALTY. " After discussion on the need of this Ordinance for the citizens on fixed income , Councilwoman Kent made motion of acceptance , Councilman Parker seconded, motion carried all in favor . Mr. Mike Schweikhard, representative of Lone Star Gas presented Ordinance # 79-8 to the Council , "AN ORDINANCE GRANTING LONE STAR GAS ,A FRANCHISE TO FURNISH AND SUPPLY GAS, AND PROVIDING FOR THE PAYMENT OF A FEE FOR THE USE OF STREET, ALLEY' S AND PUBLIC WAYS FOR A PERIOD OF 25 YEARS. Councilman Ratcliff made motion of acceptance, Councilman Swayze seconded motion, all in favor . Mr . Miller presented proposed Ordinance #79-9 to the Council . "AN ORDINANCE OF THE CITY OF WYLIE, TEXAS AMENDING ORDINANCE #78-17 OF THE CITY, SECTION 18 , OVERNIGHT PARKING; SECTION 19 , COMMERCIAL VEHICLES PARKED ON RESIDENTIAL DISTRICT PROPERTY, PROVIDING PENALTIES" . After a discussion on the proposed ordinance Councilman Parker made motion to accept, Councilman Swayze seconded motion, which carried all in favor . Mayor Pro-Tem Minihan presented Park and Recreation presenta- tion in behalf of the Park and Recreation Board to Council Mr. Minihan made request of Council to allocate out of Contingency Fund $4 , 000 . 00 to initiate Master Plan and that he would try to acquire funds from other Organizations . Firm of Schrickel , Rollins and Associates were appointed to negotiate contract to develope plans and grant appli- cation on 45 . 910 acre park site . Councilman Parker made motion that City fund the $4 , 000 . 00 request for Park fund. Councilwoman Kent seconded motion. Mayor Pro-Tem abstained from voting . Motion carried all in favor . Mr . Miller requested approval from Council to submit letter to financial advisors . Councilman Ratcliff made motion to authorize Mr . Miller to proceed with advising financial advisors and to make H D R engineers on the project. Council- man Swayze seconded motion, which carried all in favor. Mr. Miller presented porposed resolution #79- 2-1 , "A RESOL_ UTION OF THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS ENDORSING THE NORTH CENTRAL TEXAS COUNCIL OF GOVERNMENTS CONCERNING GENERAL UTILITY AIRPORT PLANNING FOR NORTH DALLAS AND SOUTH COLLIN COUNTIES AND WYLIE ' S PARTICIPATION IN THE AIRPORT LOCATION FEASIBILITY STUDY. " Mayor Pro-Tem Minihan made motion to adopt resolution and Councilman Swayze seconded motion, motion carried all in favor . Mayor Pro-Tem Minihan made motion of Order Establishing Procedure For City Officer ' s Election. Councilman Parker seconded. Motion carried all in favor. Mr . Cecil Hackler was appointed Election Judge . The Order For City Officers Ellection was signed by Mayor Akin. Mr. Miller p-esented proposed Ordinance # 79-10 , "AN ORDINANACE PROVIDING Ff : CONTINUATION OF THE LOCAL SALES AND USE TAX IMPOSED BY ': JE CITY ON THE SALE AND CONSUMPTION OF ELECTRICITY AND GAS FOR RESIDENTIAL USE , PROVIDING THAT THE SALE AND CONSUMPTION OF ELECTRICITY AND GAS FOR RESIDENTIAL USE SHALL NOT BE EXEMPT FROM SUCH TAX, AND PROVIDING THAT NOTICE OF THIS ORDINANCE BE GIVEN TO THE COMPTROLLERS OF PUBLIC ACCOUNTS OF THE STATE OF TEXAS" . Mayor Pro-Tem Minihan made motion of acceptance, Councilman Parker seconded. Motion carried all in favor. Fireman Rawlings gave Fire Department Report. Mr. Miller presented Police Department Report in absence of Chief Randolph. Mayor Pro-Tem Minihan made motion for adjournment. Council- man Ratcliff seconded motion, carried all in favor.
