06-12-1979 (City Council) Minutes REGULAR MEETING CITY COUNCIL JUNE 12 , 1979 7 : 00 P.M. Present were Mayor John Akin, Mayor Pro-Tem Roy Hall , Councilwoman Kent, Councilmen Don Hughes , Rowland Kreymer, Rat Minihan, City Manager Denton Miller, City Secretary Sarah Connelly, City Attorney Ted Kent, Chief Roy Randolph & Mrs . Randolph, Kathy Randolph, Billy Mills, Billy Bob King, William Martin, Glenn Morrow, Sue and John Webster, Kenneth Swayze , Melinda McCaghren, Ronnie and Doris Smith, Mr. $ Mrs . Starnes , Walt Broemer , Rod Gwoompie , Ken Putman, Mr. McEnrow representive of First Southwest, Richard Parker, Frank Rasor, J. L. Gibson, Troy Gibson, Bob Edgin, Rita Allen, Curtis Ratcliff, Bobby King, Susan Allen, Mr . & Mrs . Buster Pendergrass, Phil Knight and John Pendergrass . Invocation was given by Mayor Akin. Approval of previous meeting minutes and monthly bills . After a general discussion of the minutes and bills, Mayor Pro-Tem Hall made motion to accept minutes and bills , Councilman Hughes seconded, all in favor. Public Hearing on annexation petition by Troy R. Gibson and J. L. Gibson on one acre of land adjacent to FM 2514 and County Road; Public Hearing on annexation petition by Lawrence A. Woodland, Jr . on . 5 acre of land out of the Allen Atterbury Abst . # 23 , on S. Ballard. Mr. Putman, owner of Putman T.V. , asked Council about the city limit sign being moved approximately one year ago . Council informed Mr. Putman that the city limits had been extended for some time and the Highway Department had just gotten their records updated. Mayor Pro-Tem Hall made motion accepting both annexation petitions , Councilman Hughes seconded, all in favor . Cooperation Agreement by and between the Texas Intertribal Indian Housing Agency and City of Wylie, and Resolution supporting the Texas Intertribal Indian Housing Agency' s Intent to apply for Mutual Help Hou, °s and Preliminary Loans . Councilman Hughes made motion to able for further study. Councilman Kreymer seconded. Four voted for, and one abstained (Pat Minihan) . Request by Micky Martin to re-discuss action of City Council on Zoning Request #78-79-11-1 . At previous meeting of May 8 , 1979 , the Council had requested that City Attorney Kent check into the matter of rezoning in regards to Mr. Martin' s request. As Mr. Martin was not present for discussion, Councilman Hughes made request to table for next meeting . Councilman Kreymer seconded. Four yeas and one abstained (Shirley Kent) . All matters incident and related to a Bond election, including the passage of a resolution & order calling said election. Mr . McEnrow, representing First Southwest, went over the necessary items with the Council . Mayor Pro-Tem Hall made motion to adopt the resolution, Councilman Minihan seconded, all in favor. Mr. Billy Mills requested that the Council ban all chickens and fowls from the city. After hearing discussion on the noise and smell of chicken pens within the city, Councilman Minihan made request that the item be tabled until after the existing ordinance had been reviewed. Councilman Hughes made the motion, Councilman Minihan seconded, all in favor. Mr. Mills then asked the Council what would be done when he called the County Health Officer down and they fined the City, what would be done about it. Mayor Akin answered his question that it would be taken care of at that time. Ab Harrison- discuss the problem of drainage between Hilltop and Briarwood adjacent to E. Stone St . (FM 544) . Mr. Harrison was unable to be present and had requested to be put on the next agenda. Discussion of Electrical Code and permit fees . Glenn Morrow presented Electrical Ordinances from other cities to the Council . It was the decision of the Council that a committee be formed consisting of electricians , in order for them to review the current ordinance and make any suggestions in rough draft form to the Council for review. Report on request by Mrs . Bill Chapman concerning mud in swimming pool-Roy Hall . Mr. Hall reported to the Council his action on the earlier request . The Council was made aware that Mr. Bill Chapman was filling his pool from fire hydrant, not only once but twice, without receiving permission to do so the second time , and that they had refused to pay for filling pool when they pa d their water bill on which pool filling was billed. Mr. Miller'aske ' Council if the Chapmans were responsible for paying for the pool filling. Council advised Mr. Miller that the Chapmans owed the water bill . Councilman Kreymer made request that something be done about garbage pick-up for Johnstons . It involves a truck and two men Mr . Kreymer presented a survey for 22 days that labor was $146 . 85 plus use of truck @ $80 . 00/mo . which totaled to $226 . 85 per month and Johnston is only paying $75 . 00/mo . at present. Mr . Miller informed Council that the trailer was packed full with scraps of cloth and was quite difficult to get out of trailer . After a discussion of the matter, Mayor Pro-Tem Hall made motion for Mr. Miller to approach Johnston with proposed increase of $ 225 . 00 . Mr . Minihan made one point he wanted injected into motion that City not make a case out of one industry, but that motion include a general review of all commercial businesses and with that amend- ment he seconded motion. Four in favor, one abstained(Shirley Kent) . Councilman Kreymer made suggestion to Council and would like cooperation of Council and Police Department on. "This suggestion had been used at one time and it did not work to good at that time. But I believe that it could be given a try, that it would work and be of benefit to the men because we are going to have to raise these men or else we will loose them in Police Department. I would like to suggest the 31/2 day work week, because that way it would give those men a chance to pick-up a few dollars extra or else we are going to have to come up with some more money. We are way down below standard." Mayor Akin 9 P advised that this suggestion had been tried before and when we needed the men and they were somewhere else and city was unable .�, to reach them when needed. Citizens disagreed the Mr. Kreymers suggestion for the fact that the Chief needed to be where he could be reached at all times , not only the Chief, but all the patrolmen. Mr . Hall agreed with citizens that we had a good Chief, but that under the past chief who was gone and unreachable for as much as five days at a time , but all they (Hall Vt Kreymer) were asking is that it be tried, if it doesn' t work then they could go back to old way. Councilwoman Kent asked Councilman Hall what was the reason for the request for change . Councilman Hall advised that we were spending $6 , 000 . 00 a year in overtime and all Councilmen took the oath of office to save city as much , money as possible and that under the suggestion there would be no overtime, other than emergency and when someone was on vacation. He felt we could save City approximately $5 , 000 . 00/year and the Chief would be at liberty to go wherever he wanted to . Citizens asked if the Chief had asked for 31/2 day week. Councilman Hall replied, "No, we are asking for him to cooperate with us ." Mayor Akin advised that since Chief was in attendance and that the Chief is responsible for that function that he would like to hear the Chief' s opinion. Chief Randolph reply."This came up before when I first started here, the patrolmen and chief prior to me had worked 32 days when I applied for the Chief job . After I was accepted and appointed Chief the Council asked me to check into changing the shifts back to 8 hour shift . My personal feeling about it is if a man works 12 hours, 3 days straight about the 9th to llth hour your reflexes are extremely low and an officer must be alert because the next car you stop may contain somebody that wants to "blow you away" . If we go to 31/2 day work week, by the way this is the first time I have been approached by any of the Council . other than Mr. Hall and that was on another matter, about any operation of the Police Department. The way it was mapped out an officer would work from 7 a .m. to 7p .m. for 3 days and 7a.m. to 1 p .m. on the 4th day and then be off for the next 31/2 days . I feel my responsibility is to the city and I feel responsible for everything that my men do . If I am only here 31 days , what about the rest of the week? I took the job as a full time job . None of the patrolmen had approached me until June 11 about changing this back. I feel like this has been gone about wrong , if anyone has a suggestion or question about the Polic Department , I feel you should ask the Chief. If you are not oing to consider him the Chief, then do away with him. As :r as the scheduling if the Council votes for me to go to a 3 , day week, I don ' t have much choice . " Mr . Hall replied that they were only asking for him to try it . Chief Randolph said it had been tried and asked how long did it work. Mr. Hall replied that Chief Randolph was a "different man" . Citizens responded in defense of the Chief' s authority for running his department and that the Council let him run his department as he sees fit. Councilman Hall said he was not going to argue over the matter, but he felt the men needed more money. Mr Hall suggested that Art Mason be raised to Assistant Chief with an increase of $40/mo . and raise the other 3 up by $30/mo for the rest of the budget year. Councilman Minihan stated that they would entertain that thought in preparing the budget for this coming year . Mayor Akin asked the Chief to check into the salary paid to other cities of our size and have informantion at the next meeting. Mr . Miller presented a synopsis of the Park program to the Council . The purpose of the resolution was to authorize the Mayor to sign the papers . He explained the amount of the grant would be $482, 800 . $241 , 400 from the City and an equal amount from the Bureau of Outdoor Recreation. Councilman Hughes made motion to accept resolution. Councilwoman Kent seconded, all in favor . Monthly R & D Reports were presented to Council by Mr. Miller. Chief Randolph presented Police Department report . Chief reported that for back-up power system there would be an expense, but he felt it would benefit the City.
