09-09-1980 (City Council) Minutes 219 CITY COUNCIL MEETING SEPTEMBER 9, 1980 7:00 P.M. Those in attendance were: Mayor John W. Akin, Mayor Pro-Tem Roy Hall , City Councilmembers, Don Hughes, Rowland Kreymer, Harold Eavenson, and William Martin. Also present were City Manager Lee S. Vickers, Acting City Secretary Donna Christopher, T. D. Box, Eleanor J. Box, R. L. Dixon, Lynda Dawson, Janette Romero, Deborah Finley Bailey, Del Wilson, Bill Tarvin, Kenneth Bailey, Gail Ripple, Morris Ripple, Ted Kent, Linda Goodman, Isabell Adams, Municipal Judge Richard Johnson, Scott Henderson, Royce Abbot, Larry Allen, Denny Lynes, Bill Hoffman, and Carol Tice. The invocation was given by Councilmember William Martin. Councimember William Martin was surprised at the staggering amount of repairs. City Manager Lee S. Vickers made explanation for several items of cost repairs and Larry Allen made explanations for Fire Department repairs done on fire engines. Discussion of Municipal Court policy and personnel problem were directed at Municipal Judge Richard Johnson from members of the Council . He wanted to know if we wanted more professionalism in his court hearings or if they wanted a more relaxed atmosphere in his courtroom. The Council agreed that there are minimum amounts for fines and this should be followed according to each case and that a strict court policy remain in effect. There is a problem with no prosecutor to advise the patrolman in our court hearings and Judge Johnson introduced attorney Scott Henderson to the City Council . Mr. Johnson advised that with the assistance of a prosecutor at least 95% or more of the cases heard would be won by the State. Mr. Scott Henderson, who is an ex-policeman, advised that he would be interested as serving as Prosecuting Attorney for the City of Wylie. The Council agreed with Judge Johnson that the Court should be changed from two afternoons a month to one night a month. Court should convene at 6:30 or 7:00 p.m. City Manager Lee S. Vickers explained the Texas Municipal Retirement System program and recommended that the City Councilmembers adopt the three ordi- nances to take effect as of 10-1-80. Councilman William Martin moved, with a second by Councilman Don Hughes to adopt all three ordinances. The motion carried. Request by Henry Martinez - Council advised to wait until they could meet with the Planning and Zoning Board to recommend what should be done. Consider appointment of City Secretary - City Manager Lee S. Vickers advised the Councilmembers of three very will qualified applicants that he had inter- viewed. Two of the applicants would have had to take a large cut in their current pay and he felt that they might not be as happy taking a cut in pay to work the City. At this time, City Manager Lee S. Vickers recommended appointment of Mrs. Sandra Gail Wallace. He advised that she was the former secretary to Mr. Ted Kent and she comes to the City with very high recommen- dations. Mayor Pro Tem Hall moved, and Councilman Martin seconded the motion. the motion carried. Page 2 220 Consider approval of payment of Tax Consultant - Councilmembers were ad- vised by City Manager Lee S. Vickers that this was the final payment to .., Beau Daffin. Councilman Harold Eavenson moved, seconded by Councilman Don Hughes, and motion carried all in favor. City Manager Lee S. Vickers advised before continuing with the next item on the agenda that there were several people in the audience who would like to present something before the Council . City Manager Lee S. Vickers asked for a spokesman and Mr. Bill Tarvin of the "Citizens Action Committee" came forward. He spoke in opposition to the proposed airport on the Bir- mingham Trust Property. At this time Mr. Bill Tarvin introduced Mr. Kenneth Bailey who is an ex-Mayor Pro Tem for the City of St. Paul . Mr. Bailey introduced a map to the City Council which provided a detailed area of Wylie, St. Paul and the proposed area of the airport. He brought before the Council that if the airport went into effect that there could be as many as 500 planes based at this airport and spoke of the dangers of student pilots. He also pointed out that the Area of the Airport would mean a northernly approach which would be over our elementary school and that they would like to prevent crashes and promote classes. At this time, he asked the City Council to adopt a resolution in opposition to the pro- posed airport site as did Councilmembers would not do this until they have received the feasibility study which is being conducted at this time. Departmental Reports - As the Councilmembers began to review the Police Activity Report, Mrs. Wanda Ellis, a concerned citizen who lives on Hill- top, came before the Council about a new stop sign to be placed at Pirate Drive and Hilltop due to an accident which had just happened there. City Manager Vickers advised that this is not a policy problem that it is an administrative problem; she should have consulted him or Police Chief Abbott first. City Manager Vickers also advised that this would be taken care of as of September 10, 1980. At this time the departmental reports were re- viewed for the Police Department and Police Chief Royce Abbott was advised by the Council to keep up the good work. Larry Allen gave the departmental report for the Fire Department and reported on the repairs to the fire station. Mayor Akin recessed into executive session in accordance with Article 6252-17, section 2G to discuss personnel matters. During the executive session of the the Council , the Council discussed the need for a cost of living increase for the City employees in the various departments and also discussed several other items concerning personnel matters. At the close of the executive session, Mayor Akin called the meeting back into open session. Some of the items which had been discussed in the executive session were discussed briefly, after which Mayor Pro Tem Hall moved, with a second by Councilmember Rowland Kreymer, to increase the Manager's salary effective October 1 , 1980. The vote was unanimous. Mr. Hall also requested that some rock be placed on Cottonbelt south of Brown to help alleviate the muddy situation that occurs during wet weather. There was also discussion of need for addition of rock to Martinez Lane and the landfill road so the trash trucks could make it to the landfill during winter months. It was generally agreed that the rock to be used on the landfill road should be brought in from Terrell , since this rock appears to be harder than the current chalk rock which was used. Page 3 Several drainage problems and traffic problems were discussed and - the manager made notes of these to follow up on at a later date. The Council requested the manager to check on the availability of a construction inspector, who would check all work done on public property such as street paving, alley paving, sanitary sewer or water mains to make certain they comply with the sub-division reg- ulation. The manager was also instructed to consider reactivation of the Electrical Board as soon as possible. Councilmember Harold Eavenson suggested that the Council consider a Joe and Pat Murphy Day in Wylie complete with a presentation of plaques to each and a proclamation by the Mayor. The Council was very much in favor of this and it was agreed that early arrangements would be made. Mayor Akin requested the Council to meet at 7 p.m. on September 23, for the purpose of considering the budget and the adoption of tax ordinances, etc. The manager agreed to prepare a new paving cut policy for considera- tion of the Council which would be designed to regulate paving cuts made by utilities and/or contractors who do work on public property. It was agreed that there should be a traffic study made concerning the needs on Pirate Drive and in addition, to study the feasibility of a joint project between the City and the school district to extend Pirate Drive west to South Ballard. Mayor Akin invited members of the Council to join him in attending the Collin County Public Officials Meeting to be held on September 11 . Several said they would be in attendance.
