03-26-1981 (City Council) Minutes l JOINT PLANNING & ZONING AND CITY COUNCIL MEETING MARCH 26, 1981 "'""" 7:00 P.M. The joint Planning & Zoning and City Council public hearing was called to order at 7:00 p.m. , March 26, 1981 by Mayor John Akin. Mr. William Martin gave the invocation. Those in attendance from the City Council were Mayor John Akin, Council- men Harold Eavenson, William Martin and Don Hughes, City Manager Lee Vickers, City Secretary Gail Wallace. Mayor Pro Tem Roy Hall and Councilman Rowland Kreymer were absent. Twenty-one citizens were pre- sent. Members of the Planning & Zoning Commission present were Chairman Dr. Joe Fulgham, Sue Webster, John Seeley, Frank McMillan, Don Kreymer and Ken Mauk. John Yeager was not present. Also present was Mr. J.T. Dunkin, J.T. Dunkin & Associates. Mayor Akin introduced the members of the Planning & Zoning Commission and the City Council . He advised those in attendance that the pur- pose of the joint meeting was for the public to be made aware ofa new proposed zoning ordinance. It was their opportunity to ask questions and be made aware of any proposed changes to the ordinance. amilk After the introductions, Mayor Akin turned the hearing over to Dr. Fulgham. Dr. Fulgham gave a brief summary of the work done by the Planning & Zoning Commission and the consultant, J.T. Dunkin, in preparation of the proposed ordinance. He then introduced Mr. Dunkin. Mr. Dunkin explained the proposed changes to the zoning ordinance. Instead of 7 districts, the proposed ordinance would include 9 districts. The change would add townhouses and condominiums to the types of structures allowed. The change would also include Planned Development which could either be single or multiple use. Mr. Dunkin then solicited questions from the public. The main concern from the majority of those present was the zoning on their particular property. Mr. Dunkin, along with the Mayor and Dr. Fulgham assured everyone present that the purpose of the public hearing was not to rezone any property; but merely for the purpose of updating the present zoning ordinance. After all questions had been answered, Dr. Fulgham closed the public hearing at 8:15 p.m. John Seeley moved and Frank McMillian seconded to recommend adoption of the proposed zoning ordinance to Council . Motion carried. Mayor asked for further comments, of which there were none. Don Hughes moved and Harold Eavenson seconded to adopt the zoning order. Motion carried. The Planning and Zoning Commission then went into- a separate meeting I , to consider the request for approval of a final plat for Riverview Townhouse Addition. After discussion of drainage ditch improvements and formation of a homeowners association, John Seeley moved and Ken Mauk seconded to approve the final plat. Motion carried. Don Kreymer abstained from both discussionand voting. After conclusion of the joint public hearing, the City Council went into session to consider approval of the proposed zoning ordi- nance. With motion made by Don Hughes, seconded by Harold Eavenson with all in favor, the Council approved the new zoning ordinance. Councilmen Kreymer and Hall not present. The Council then considered a request for multiple family (townhouse) zoning of Riverview Townhouse Addition to be located at lots 10, 11, and 12, block 5, Holiday Terrace third installment. The request for multiple family zoning for townhouse development was approved with a motion by Harold Eavenson, seconded by William Martin, all in favor. Councilmen Kreymer and Hall not present. The final item to be considered was approval of the preliminary and final plat for Riverview Townhouse Addition. Mr. Hemingway went over the plat with the Council . After a brief discussion the plat was approved with motion by William Martin, seconded by Harold Eavenson, all in favor. The plat was approved on condition that the drainage system would require approval by the City engineers and that the townhouses would require a special use permit before con- struction could begin.
