APRIL 14, 1981
7:00 P.M.
The meeting was called to order by Mayor John W. Akin. A quorum was
present and notice of the meeting had been posted for the time and
manner required by law. Those in attendance were Mayor John W. Akin,
Mayor Pro Tem Roy Hall , Council members Don Hughes, Harold Eavenson
and William Martin. Councilman Rowland Kreymer was not present.
Also present were Police Chief Royce Abbott, Council persons elect
Reta Allen, Geline Dodd and Bill Berry; W. C. Allen, Don Kreymer,
Richard Parker, Shirley Berry, Robert Squires, William Warren and
Mike Rollins.
Mayor Akin gave the invocation.
Canvass of election returns. The following is the official returns
of the City Council election: Bill Berry - 184

A motion was made by Roy Hall , seconded by Harold Eavenson, with all
in favor that these returns be validated into the records.
The minutes from the previous meeting and the accounts payable were
approved with motion made by Roy Hall , seconded by William Martin,
all in favor.
At this time, Mayor Akin read a letter from Allen Funeral Home
addressed to the City Council , City of Wylie, dated April 4, 1981
which stated as follows: "This is to inform you that the Allen's
Ambulance Service will not receive any more Subsidy from the City
of Wylie." The letter was signed by W. C. Allen, Jr. , Allen Funeral
Home.
Consider Amendment to Ordinance Regulating Solid Waste Disposal Fees:
City Manager Vickers advised Council that the sanitary landfill was
being used more and more by individuals outside the City limit.
Our current rates are not up to date with other cities, therefore,
he recommended to the Council that they adopt an amendment to our
ordinance raising the rates for non-resident users. The ordinance
was patterned after the rates presently being used by NTMWD. The
amendment was adopted with motion by Wlllima Martin, seconded by
Reta Allen, all in favor with corrections.
Consider Problem with Fleming Street in Keller Addition. It was
brought to the attention of the Council of an encroachment on City
property. Mr. Richard Parker, owner of the Cotton Belt Apartment
Complex, requested help from the Council to perfect title to his
property. After much discussion of various ways to correct the

problems, a Resolution was adopted by the Council , a certified copy
of which is to be furnished to Mr. Parker, and is made a part of these
minutes.
Consider Resolution urging State Legislature to adopt S.B. 951/H.B. 1960.
A resolution was discussed which would urge the State Legislature to
support the adoption of H.B. 1960 and S.B. 951. These bills would allow
the cities to recieve a pro rata share of state motor fuel and motor
vehicle tax revenue to be used for street construction and maintenance.
The resolution was adopted by motion made by William Martin, seconded
by Geline Dodd, all in favor.
Authorize installation of traffic regulatory signs and street lights in
Westwind Meadows Addition. Westwind Meadows Addition was developed
without provisions for traffic signs and street lights. This has
created a hazard for the families living there. The Council provided
authorization fo the City Manager to erect the necessary traffic signs
and street lights. The cost will be approximately $40.00 per—year for
five to six lights. The traffic signs will cost approximately $600.
Motion was made by Geline Dodd, seconded by Reta Allen, all in favor.
Consider two appointments to Library Board. Peg Barker and Kathy
Elledge both expressed a desire to be replaced on the Library Board.
Betty Stephens and Mary Jo Smith were appointed for one year terms to
replace the two retiring members. These two were approved with
motion made by Harold Eavenson, seconded by Bill Berry, all in favor.
The Mayor requested that Ms. Barker and Ms. Elledge be recognized at
the next regular meeting with plaques of appreciation for their con-
tributions
while serving on the Board.
Departmental Reports. The various departmental reports were dis-
cussed by the Council .
Geline Dodd expressed concern for children who ride their bikes to
school . The Mayor requested City Manager to get the Safety Committee
to look into the possibility of designating bike routes to the ele-
mentary school .
Harold Eavenson expressed concern regarding alcoholic beverages and
motorbikes which may become a problem in the Wylie Community Park.
He recommended adopting an ordinance banning alcoholic beverages
and motorbikes from City parks. The Mayor instructed the City Manager
to draft such an ordinance. The Council was unanimously in favor of
the need for such ordinances.
City Manager asked that the Council and the citizens join in the
effort to stop T P & L from receiving a requested 33% rate increase.
He suggested holding a public hearing on April 28, 1981 at 7:00 p.m.
to make the public aware of the rate increase and solicit the public' s
help in pursuading the PUC not to grant the rate increase. It was
agreed that the public hearing would be held.
Robert Squires was recognized on behalf of the Kiwanis Club. He
volunteered the services of the Kiwanis Club to maintain Kirby Park.
With the Council 's permission, they would assume the responsibility
of mowing, cleaning up and painting the facilities there. He also
advised the Council that the Kiwanis Club would purchase trash

receptacles for the park. The Council welcomed the idea provided
they work with the City Manager in obtaining the proper trash
receptacles. The Mayor conveyed his appreciation to Mr. Squires
for his concern for the cleanliness of the City.
In line with the clean up of Kirby Park, the Mayor reminded every-
one that the first week of May was Clean-Up week in Wylie. He
would like for the entire City to work toghether to promote cleanli-
ness. He asked William Martin to work on behalf of the Lions
Club and to join with the Kiwanis Club in promoting Clean-Up week.
The City Manager discussed the possibility that a private club night
be opened north of the City. Although the potential club would
be just outside the Extra Territorial Area of Jurisdiction, the
Mayor advised that the Council would provide moral support to those
in opposition to the Club. He would take under advisement the
possibility of adopting a resolution in opposition to such a club.
There being no further business, the Council adjourned into exe-
cutive session.

RESOLUTION NO.
WHEREAS, an error was made many years ago during the con-
struction of Fleming Street west of Cotton Belt Avenue, resulting
in an offset in the pavement from the centerline of the street
right-of-way, and
WHEREAS, the apartment building at 300 South Cotton Belt
encroached approximately six feet onto the Fleming Street right-of-
way, and
WHEREAS, a small storage building was inadvertently con-
structed almost entirely upon the dedicated alley located south of
Fleming Street and west of and parallel to Cotton Belt Avenue, and
WHEREAS, the present owner of the property wishes to
correct the previous errors and to clear any legal cloud upon the
title to the property, and
WHEREAS, the City Council of the City of Wylie, after a
comprehensive discussion of the problems in regular Council Session,
and after careful consideration of the various methods by which the
several problems might be corrected, and with due consideration to
the needs of the City for future development of land adjacent to and
west of subject property, and
WHEREAS, the City Council desires to declare its intent to
cooperate with the current property owner to perfect title to the
property without prejudice to the public interest in future land
developments; NOW THEREFORE
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS:
Section 1. That the Mayor be, and he is hereby authorized
to execute a Quitclaim Deed to the right-of-way of Fleming Street
as it is presently designated on the City of Wylie map prepared
by Hogan and Rasor, Inc. of Dallas in December, 1979 and more
specifically described as follows: Extending west from the west
right-of-way line of Cotton Belt Avenue for a distance of approxi-
mately 171 feet as measured along the south right-of-way line of
Fleming Street. The Quitclaim Deed will favor Mr. Richard Parker,
the current owner of property adjacent to and located along both
the north and south side of Fleming Street. In exchange for this
Quitclaim Deed, Mr. Richard Parker will execute a warranty deed
in favor of the City for a new Fleming Street right-of-way extend-
ing west of Cotton Belt Avenue approximately 171 feet, but extend-
ing 25 feet both north and south of the centerline of the paved
section of Fleming Street, providing a 50 foot right-of-way.
Section 2. That the City Council hereby grants a variance
to the present owner, and to future owners , of the apartment build-
ing designated as 300 South Cotton Belt Avenue, as the building
now exists, for the minor encroachment of that building a few
feet into the area normally reserved for a side yard.
Section 3. That the City Council will not require the
storage building presently occupying a portion of the north-south
alley west of Cotton Belt Avenue to be removed from the alley until
it has served its purpose, provided Mr. Richard Parker will convey
to the City a ten foot wide strip of land approximately 100 feet "^
north and south of the storage building to the end that a standard
alley can be paved and used to serve abutting properties in the
future. This parcel of property will contain approximately 2000
square feet.
Section 4. That the costs incidental to the preparation,
execution, and proper filing for record of all the documents
necessary to perfect the title shall be borne by the current
owner, and not by the City of Wylie.
Duly adopted by unanimous vote on this, the 14th Day
of April , A. D. 1981.
