CALLED MEETING
MARCH 11, 1982
5:30 P.M.
The Wylie City Council met in special call session at 5:30 p.m. on
March 11, 1982 in the Council Chamber at City Hall . Mayor John W.
Akin presided. A quorum was present and notice of the meeting had
be posted for the time and in the manner required by law. Those
in attendance were the Mayor, Mayor Pro Tem William Martin, Council
members Reta Allen, Geline Dodd and Harold Eavenson. Councilman
Berry was not present. Also present were: Jeanette Stephenson,
Dallas Morning News; Charles Willis, Bill Metzger, Bob Squires, Del
Wilson and Kenneth Swayze.
Invocation was given by Mayor Akin. After the invocation, Mayor
Akin welcomed the guests and informed them of the reason for meeting.
Mr. Bill Metzger, P.E. , Turner, Collie & Braden, reported on develop-
ment of airport master plan to Council , after which a question and
answer session occurred. Mr. Metzger also covered the activity fore-
cast, construction costs, operating costs and revenue estimates.
Mr. Charles Willis submitted twenty copies of the draft Environmental
Impact Assessment Report. It was agreed to make copies available at
Municipal Library and City Hall for interested people to inspect and,
if desire, to borrow. Copies also to be delivered to the cities of
Plano and Garland.
Mayor asked if sealed bids were available -- an item of old business
from the March 9th meeting. Mr. Kenneth Swayze submitted the only
sealed bid for the equipment storage building and pavillion for Wylie
Community park, with a base bid of $10,350.00 plus options of $450.00
for electric wiring and $75.00 for plumbing rough-in. It was the only
bid, and gifts totalling $7,000.00 have been pledged.
On motion by Harold Eavenson, seconded by Geline Dodd, it was voted
unanimously to award a contract in the amount of $10,875.00 to
Mr. Kenneth Swayze, who agreed to complete the building within 45
days. Mayor expressed City's appreciation to Mr. Swayze for the mag-
naminous bid and for his contribution and placement of infield clay
on two of the ballfields.
Council requested City Manager to purchase approximately 160-175 cubic
yards of Seagoville clay for the third field.
Del Wilson asked for clarification of legal status of Birmingham
Trust Land, which was annexed by petition of the Board of Trustees
under authority of Article 974 g, V.T.C.S. , on August 25, 1981. —•
City Manager explained that, through his error, the Council illegally
annexed the land by failing to publish the notices required by
Article 1070a. , ibid. , since 1979. If no further action were taken,
and State Legislature would likely validate the illegal annexation
in 1983.
After some discussion, it was reaffirmed that the City Secretary would
publish a resolution dated March 11, 1982 to the effect that Council
would take early action to deannex the Birmingham Trust Land by
ordinance. It was further agreed that, if desired, the Council could
annex subject land at a later date, using statutory procedure man-
dated in Article 1070a.
There being no further business, the meeting was adjourned.
