03-22-1982 (City Council) Minutes LI CITY COUNCIL MINUTES CALLED MEETING MARCH 22, 1982 6:30 P.M. The meeting was called to order by Mayor Akin. A quorum was present and notice of the meeting had been posted for the time and manner required by law. Those in attendance were Mayor John W. Akin, Mayor Pro Tem William Martin, Councilmembers Harold Eavenson, Bill Berry, Reta Allen and Geline Dodd. Also present were City Manager Lee Vickers, City Secretary Gail Wallace and David Engelman, Plano Star Courier. The invocation was given by Mayor Akin. Sanitary Landfill Application. On January 27, 1982, a public hearing was conducted by the Texas Department of Health at the North Texas Municipal Water District to determine if there was any opposition to the application by the City of Wylie for the operation of a class II sanitary landfill in the City limits of Wylie. No citizen appeared in opposition to the permit, but certain officials of the Texas Depart- ment of Health raised the issue of the potential for shallow ground water supply polution. Mayor Akin went on to brief the City Council on procedure at the public hearing, stating further: State officials apparently had no problem with the issuance of a class II permit for operation of the landfill , but asked if the City would be willing to install three shallow test wells, strategically spaced around the landfill area, and that the City cover more frequently than once each week as required in the class II permits, and that the City change the parallel trenches to the progressive trench method. At the public hearing, Mr. William P. Walker, Bureau of Solid Waste Management, also recommended that the City overexcavate the progressive trench surfaces to a depth of not less than 3 feet and to recompact the material within the trench bottom to 95% proctor density. Mayor Akin indicated that he felt this recommendation was a surprise to the consulting engineer Frank Rasor and that it was also a surprise to Mr. Allen, City Director of Public Works, Mayor Akin referred to a letter dated March 19, 1982, signed by Frank Rasor, recommending that the City agree to install three monitoring wells, adopt the progres- sive trench or cell method with walls shaped on a 3:1 slope. Mr Rasor further recommended that, in lieu of over excavation of three feet, that a layer of select material 6-8 inches deep be compacted to 95% standard proctor density. Mr. Rasor indicated in his letter that surface trench at the landfill site seems to be satisfactorily under control at the present time. 'ry The Mayor recommended to the Council that the State Department of Public Health be advised of the City of Wylie's willingness to comply with the recommendations as written in Mr. Rasor's letter, but that the City could not afford to over excavate three feet and compact to 95% proctor density, which would cost approximately $500,000. Bill Berry made a motion, with a second by William Martin to authorize the City Manager to advise the Texas Health Department that the City would comply with the recommendations of Mr. Rasor, but could not afford to over excavate three feet with 95% proctor density compacted. The vote was unanimous. On motion by William Martin, seconded by Harold Eavenson, it was voted unanimously to reappoint Dr. Ted Trimble as City Health Officer. Next, the City Council discussed the need to deannex the Birmingham Trust Land, which had been improperly annexed. On motion by Harold Eavenson, seconded by Geline Dodd, it was voted unanimously to adopt the proposed deannexation ordinance. The City Council discussed a request by Mr. Rose that the City adopt a resolution recommending to the Railroad Commission that Mr. Rose be given a permit to operate a commuter bus between Wylie and downtown Dallas. After some discussion, Harold Eavenson moved with second by William Martin to adopt the resolution on condition that the City do not waive any City rights to recommend or to issue franchises to the bus company and that the Company must provide off-street parking if it expects to operate within the City of Wylie.
