CALLED MEETING

The Wylie City Council met in special call session at 6:00 p.m. on May 25,
1982 in the Tower Suite at First State Bank. Mayor Squires presided. A
quorum was present and notice of the meeting had been posted for the time
and manner required by law. Those in attendance were the Mayor, Mayor Pro
Tem William Martin, Council members Percy Simmons, Reta Allen and Geline
Dodd, City Manager Lee Vickers, City Secretary Gail Wallace, Don Huffman
and Gary Phillips from D and H Development Corporation, Melvin St. John,
Harold Spence, Harry Tibbals, Sam Self, Bryant Barry, and David Engleman.
Invocation was given by Mayor Squires.
A presentation was made by Don Huffman regarding a proposed development
involving a large mobile home park and retail facility to be located west
of Maxwell Creek and south of West Highway 78. The development would open
approximately 600 lots. A major concern of the City Council was the rapid
influx of children into the Wylie Independent School District, which at
present is at capacity, should this development become a reality. Mr. Huffman
advised it would take one and one-half to two years to fill the spaces. The
Mayor advised everyone present that a public hearing was set for June 8, 1982
to consider the annexation of this property.
At this point the meeting was recessed in order for the Council to conduct
public hearings on the ground of three tracts of land under consideration ,...,
for annexation.
The first public hearing was held on site at the proposed Oaks Addition
located south of Old Highway 78 East and approximately 250 feet east of
Impression Center. There was no opposition to the annexation.
The second public hearing was held on site at the proposed Tibbals Addition
located east and southeast of Wylie Cemetery. There was no opposition to the
annexation.
The third public hearing was held on site at the west end of Stoneybrook over-
looking the proposed addition located west of Westwind Meadows. There were
approximately 41 residents of Westwind Meadows present at the hearing. The
residents expressed opposition not to the annexation, but to the extension of
Stoneybrook and Willow Way Streets. These streets would be extended through the
new addition to access the additional houses. The residents expressed concern
that the opening up of these streets and their alleys would create unsafe con-
ditions for their children due to increased traffic flow. The general concen-
sus of the crowd was that some other outlet be made for the new addition. All
of the residents present signed a petition against the annexation if Stoney-
brook and Willow Way were extended as access streets into the new addition.
After a rather lengthy and hostile discussion among the residents, Mayor
Pro Tem Martin advised them their opposition would be taken into consideration
by the Council . At this time, the Council recessed in order to return to c.he —,
Tower Suite to reconvene the meeting. Motion to recess was made by Council-
woman Dodd, seconded by Councilwoman Allen, all in favor.
The meeting reconvened at the Tower Suite. City Manager advised Council of
the potential for underground water pollution in the shallow layers at the
sanitary landfill according to the Texas Department of Health. They
have advised the City that three monitoring wells must be installed at
the landfill . Due to the possibility that the City can be fined up
to $2,500 per day if it continues to operate the landfill as is, City
Manager recommended that the landfill be temporarily closed for four
to six weeks in order for an engineering study to be made to determine
whether or not there is underground pollution. At the same time, the
City would enter into a temporary agreement with North Texas Municipal
Water District to dispose of the solid waste at the Maxwell Creek site
at a fee of $45 per load for the trash truck and $19 per load for the
brush truck. Councilwoman Dodd Made a motion to close the landfill for
four to six weeks and negotiate with NTMWD to dispose of the City's
solid waste. Motion was seconded by Councilwoman Allen, all in favor.
Annexation of Tibbals Addition. Councilwoman Allen made a motion to
accept petition for annexation of the 15 acres east of Wylie Cemetery
known as Tibbals Addition. Motion was seconded by Councilwoman Dodd,
all in favor.
Annexation of 20 acres West of Westwind Meadows. Council noted the
opposition to this addition noting that the opposition was more with
the street outlets and not the actual annexation. Councilman Simmons
moved to accept annexation of this addition into the City limits,
seconded by Councilwoman Dodd, all in favor. Council agreed that the
property could be deannexed if rezoning to single family was not
approved by the Planning & Zoning Commission.
Annexation of Oaks Addition. Councilwoman Allen made a motion to accept
petition for annexation of Oaks Addition, seconded by Councilwoman Dodd,
all in favor. By concensus Council approved the enlargement of the
culverts at the entrance of Oaks Addition of Old Highway 78.
Councilwoman Allen moved to adjourn, seconded by Councilman Simmons,
all in favor.
