CALLED MEETING
JANUARY 22, 1983
8:30 A.M.
The Wylie City Council met in a special called session at 8:30 a.m. on
Saturday, January 22, 1983 in the Tower Suite at First State Bank Building.
Mayor Bob Squires presided. A quorum was present and notice of the meeting
had been posted for the time and in the manner required by law. Those in
attendance were Mayor Squires, Mayor Pro Tem William Martin, Councilmembers
Rita Allen, Geline Dodd, Harold Eavenson, Percy Simmons, City Manager Lee
Vickers, Director of Public Works Brian Cowan, News Editor David Engelmann,
News Reporter Cathy McAnally, Mike McAnally, and Don Kreymer.
Mayor Squires called the meeting to order and announced that the brief agenda
would be attended to first, after which there would be a work session. He
called for discussion on the proposal for a cooperative project between the
City and the School District to pave Pirate Drive from Second Street west
to Ballard. The City Manager reported that the School had proposed to
accomplish this project in the same manner as the first phase of paving
Pirate Drive. The School surveyor had staked off the right-of-way for the
street, and it was anticipated that the City's engineer would stake the
center line of the street and provide data to establish the proper grade
for the street itself, after which the City would haul in any necessary
fill and would do the preliminary grading and excavation as required. The
estimated cost to the City was placed at $2,000. to $2,500. and the estimated
cost to the School was announced to be $60,000. to $65,000. No one was pre-
""" sent to represent the school , so after a detailed discussion, Councilman
Harold Eavenson moved and Mayor Pro Tem William Martin seconded to table
this issue until the regular Council meeting February 8. The motion carried.
The second item on the agenda was to consider appointment of members to a
Zoning Board of Adjustment. During this discussion, the Council agreed by
concensus that a separate Zoning Board of Adjustment would be appointed,
delaying discussion of the Building Code Appeals Board. Several names
were entered in nomination during the discussion that followed: Dewayne G.
Boyd, 403 Hilltop; Bill Coker, 404 Hilltop; Mrs. Nancy Conkle, 403 Dogwood;
Kent Crane, 106 Cottonbelt; Randall H. Gaston, 402 Stoneybrook; Richard
Hampton, 808 Easter; Art Harris, 307 S. Ballard; Bill James, 803 Memorial ;
William J. LeCocq, 804 Memorial ; Allen Leverett, 514 Dogwood, Albert Buddy
Masters, 108 W. Marble; Ross P. Miller 409 N. Ballard; Patrick E. Minihan,
• 308 Briarwood; Sam Self, 305 Stoneybrook; Mrs. Mary Jo Smith, 406 Briar-
wood; Mrs. Anna Starns, 1004 Memorial ; Mrs. Betty Stevens, 303 Woodhollow
Court.
It was further agreed that the City staff would contact each nominee to
determine if they would be willing to serve if appointed, and that appoint-
ments would be made at the meeting of February 8, 1983.
The third item on the agenda was to approve the site plans for Village East
Apartments. The City Council discussed this matter and concluded that it
aw_ did not need to consider this site plan further, since it had been pre-
viously approved by the Planning & Zoning Commission.
At this time, Mr. Don Whitt, Superintendant of the Schools came in so the
City Council reopened the discussion on Pirate Drive. Mr. Whitt agreed to
furnish a truck and driver to assist in hauling the fill dirt for Pirate
Drive construction. Councilman Simmons wanted a topographic map and
drainage plan for the improvements area, to avoid future drainage problems.
A brief discussion concerning the extension of Pirate Drive east from
Hilltop to Thomas Street ended with a statement by Mr. Whitt that he had 'olel"'
no plans for extending Pirate Drive to the east. Councilman Harold Eavenson
moved, with a second by Councilwoman Geline Dodd to participate with the
School in the improvements to Pirate Drive. The motion carried unanimously.
Mayor Squires introduced Mike McAnally, who had previously prepared a
report on his investigation of the problems surrounding the sanitary sewer
lift station east of Wylie Cemetary. Mr. McAnally's report is incorporated
by reference into these minutes and is made a part of the permanent record
of the City. After a lengthy discussion, the City Council expressed its
appreciation to Mr. McAnally for his thorough and extensive investigation
and the comprehensive report.
As a part of the discussion concerning the lift station, Councilman Percy
Simmons asked the City Manager if Hogan & Rasor, the design engineers,
executed a field survey during the time they were designing the sanitary
sewer lift station which might have put the lift station in the wrong loca-
tion. He exhibited an invoice from Hogan & Rasor;in which an item for
approximately $1,500. had been billed to the City for field survey work
during the design phase of the project, and asked the City Manager to check
and get daily work reports or other documentation to indicate whether the
field work had actually been done.
The Council went into a work session with the first item to be the need
for a formal personnel policy. After some discussion Mayor Squires
appointed Councilman Harold Eavenson to chair a committee to work with
William Martin and the City Manager to prepare a "draft" personnel policy
for Council approval at a later meeting. The City Manager was also re-
quested to check the pros and cons concerning the feasibility of with-
drawing from Social Security System participation.
The need for more comprehensive code enforcement was discussed. Mayor
Squires commented that the "only thing consistent about Wylie ordinance
enforcement is the inconsistency" . The Council agreed, after discussion,
that the developers would be responsible for full knowledge of all ordi-
nance requirements, but that City staff should cooperate to the fullest
extent to make certain that the developers had full knowledge of the
ordinances and that they knew the consequences of failure to comply. Any
change in ordinances should be mailed to all the affected developers.
Councilman Harold Eavenson said the ordinances should be enforced or
recommended to the Council for amendment.
The need for professional level staff to serve as code enforcement officer
and Planning & Zoning Commission staff assistant was discussed. It was
agreed that this person might be a registered professional engineer or
professional city planner, although it was pointed out that salary require-
ments of such people are very high. It was further agreed that the new
Director of Public Works should be an outside man oriented in public con-
struction and who has experience in supervising various work crews. ....
Mayor Squires commented that the Registered Professional Engineer could
be titled City Engineer and could be responsible for plat review, code
enforcement and limited design work.
The Council agreed to the need to review our service charges and fees
- with the objective making them more consistant with those charged
in neighboring cities and to use the revenue to help pay the salaries
of administrative personnel .
Mayor Squires named Councilman Percy Simmons and himself as a committee
to prepare a job description for the code enforcement official . The
City Manager was instructed to contact Bob Mitchell with the City of
Garland and to enlist his assistance in this project.
The City Manager was instructed to compile City expenditures for code
enforcement over the past year, including plat review charges by
Hogan & Rasor and the percentage of time that the former Director of
Public Works devoted to code enforcement. The Council also requested
an estimate of how much additional cost would be involved if a
registered professional engineer were retained.
A discussion took place as to the need for amendments to the current
Zoning Ordinance, the adoption of the Uniform Building Code, with the
attendant plumbing and mechanical codes, and a need for a workshop to
study the codified subdivision regulations. Mayor Squires requested that
the Planning & Zoning Commission study the need for amendments and to
make a recommendation at its meeting of January 27th to the Council as to
whether or not the Uniform Building Code should be adopted without amend-
ments. Later, needed amendments could be adopted after adequate dis-
cussion and consideration had been given.
There was also a brief discussion as to the need for continuing this
workshop at a later meeting, and a motion to . e-journ was made by Reta
