05-10-1983 (City Council) Minutes CITY COUNCIL MINUTES MAY 10, 1983 7:00 P.M. The Wylie CityCouncil met in regular session at 7:00 Y 9 p.m. on May 10, 1983 in the Council Chambers at City Hall . Mayor Squires presided. A quorum was present and notice of the meeting had been posted for the time and manner required by law. Those in attendance were Mayor Squires, Mayor Pro Tem John Akin, Councilman William Martin, Cleo Adams, Don Hughes and Percy Simmons, City Manager Lee Vickers, City Secretary Sarah Connelly and numerous citizens. Mayor Squires called meeting to order, invocation was given by Council- man Cleo Adams. Approve previous minutes and accounts payable. City Manager gave a brief on invoice from Trinity Equipment settlement in regards to work done on backhoe without authorization. Settlement was $2,200.00 to Trinity. Previous Planning and Zoning minutes had been corrected. Councilman Martin requested that the Council minutes of April 22, 1983 reflect that Mayor Squires and Councilmen Martin and Eavenson were not aware of emergency item before it was added to agenda. Mayor Pro Tem Akin made motion to approve, seconded by Councilman Martin, all in favor. Consider ordinance on rezoning of Glen Knoll Mobile Home Park. Mayor opened floor to those in favor of zoning. Mr. Robert O'Donnell , counselor for developers, stated that he would be glad to answer any questions in regards to this item. Those speaking in opposition to the mobile home park were Mike McAnally, Bryant Barry, Tim Hemingway, ...� Henry Martinez and Randy Gaston. Their concerns were the legality of the zoning, commitments made at time Holland Hitch moved to this location, the overload that would be given to the Citizens in regard to taxes, etc. , the traffic congestion in this area, and the fact that a mater plan had been prepared for the City and it was not being followed. Mr. O' Donnell stated that the developers would have to comply with the zoning ordinance in regards to construction. After much discussion on this matter, one question was concern about utilties being extended to that area. Developers stated they would pay their share of any improvements. Mayor Pro Tem Akin made motion to table this item until all questions could be answered. Councilman Simmons seconded. Two in favor (Akin and Simmons) , three opposed (Hughes, Martin and Adams) , motion failed. Councilman Simmons made motion to adopt this ordinance. Mayor Pro Tem Akin seconded. Three in favor ( Akin, Hughes and Simmons) , two opposed (Martin and Adams) , motion carried. First Public Hearing on Annexation on Oaks Retail . Mayor opened , Public Hearing to floor. There was no citizen input on this item. Councilman Martin made motion to procede to second public hearing, seconded by Mayor Pro Tem Akin, all in favor. First Public Hearing on Annexation on Oaks III. Mayor opened Public Hearing to floor. There was no citizen input. Mayor Pro Tem Akin mace motion to procede to second public hearing. Councilman Simmons �+ seconded, all in favor. First Public Hearing on Annexation on Oaks IV. Mayor opened Public Hearing to floor. There was no citizen input. Mayor Pro Tem Akin made motion to procede to second public hearing. Councilman Simmons seconded, all in favor. Consider Ordinance to rezone Tract 1 and 2, S.B. Shelby Survey, Abstract 829 from Public to R-Retail . Mayor Pro Tem Akin made motion to approve Ordinance, seconded by Councilman Simmons, all in favor. Accept Trails Addition Installment #1. After discussion on the installa- tion of alley between South Fourth Street and Hilltop. Joe George, developer, stated that alley is not part of Trails subdivision but of a previous subdivision. Councilman Simmons made motion to accept sub- division with alley being added to as built plans and coming back to City Council when alley is complete. Council Hughes seconded, all in favor. Accept Rush Creek Installment #1. This subdivision had been checked by engineers. Mayor Pro Tem Akin made motion to accept Rush Creek, Councilman Adams seconded, four in favor, one abstaining (Simmons). Consider Variance to Subdivision #82-13 to allow building permits to be issued prior to completion of streets in Westwind Meadows II. Fire Marshal Lester Gayler asked that the City Council not allow this variance or any other variance pass due to lack of fire protection. Harold Spence stated he would also like for City Council not to allow variance as it poses problems for street development and construction of houses. Councilman Simmons made motion to deny variance, seconded by Councilman Adams, all in favor. Administration to inform builders that it is due to fire protection that variance is denied. Consider Ordinance abandoning alley easement maintaining utility easement between Lots 1-2A and Lot 3, BlockSr, Railroad Addition. Mayor Pro Tem Akin made motion to abandon alley, Councilman Simmons seconded, all in favor. Adopt Uniform Building Code. Mayor Pro Tem Akin made motion to adopt without appendix. Councilman Martin seconded, all in favor. To go into effect July 1, 1983. Adopt Uniform Mechanical Code. Councilman Martin made motion to adopt without appendix. Councilman Hughes seconded, all in favor. To go into effect July 1, 1983. Adopt Uniform Plumbing Code. Mayor Pro Tem Akin made motion to adopt without appendix. Councilman Hughes seconded, all in favor. Meeting with builders in order to inform of changes to be held soon. To go into effect July 1, 1983. Consider agreement with Control Management. Due to more information being needed on this item Mayor Pro Tem Akin made motion to table, seconded by Councilman Martin, all in favor. Accept dedication of park land in Westwind Meadows. Melvin St. John v dedicated Block 4 of Westwind Meadows to City for residential park. Mayor Pro Tem Akin made motion to accept dedication, seconded by Councilman Hughes, all in favor. Review draft of proposed Subdivision regulations. This item is to be placed on May 26, 1983 agenda for joint meeting of City Council , Planning & Zoning and Board of Adjustment. Consider Ordinance to tax gross receipts on Bingo games. Mayor Pro Tem Akin made motion to table item indefinately. Seconded by Councilman Simmons , all in favor. --w, Consider Speed Limit Ordinance on F.M. 3412. Councilman Hughes made motion to approve, seconded by Councilman Simmons, all in favor. Authorize purchase of three sets of portable bleachers for Wylie Community Park. Councilman Hughes made motion to authorize purchase, seconded by Councilman Martin, all in favor. Authorize purchase of Police Patrol Car Signs. Councilman Hughes made motion to authorize purchase of signs, seconded by Councilman Simmons, all in favor. It was consensus of Council that City Manager car be marked if City Manager so desired. Citizen Participation. Larry Allen requested that City check into water lines behind three homes on East Stone. Departmental Reports. Reports were given. Mayor Pro Tem Akin made motion to adjourn into executive session in accordance with Article 62-52-17 V.A.C. S. Section 2g. Councilman Hughes seconded, all in favor. Mayor opened back into public session. Items discussed were City Secretary and Planning & Zoning members. Mayor Pro Tem Akin made motion to appoint Carolyn Jones A:. ,'. q- City Secretary, seconded by Councilman Hughes, all "-" in favor. Mayor stated he was in receipt of Mike McAnally's resignation from Planning & Zoning Commission as of May 10, 1983 and it was regretfully accepted by City Council . Recommendations for Sarah Connelly and Art Harris be appointed to Planning & Zoning to take the places of Mike McAnally and Albert Harrison. Council also recommended Bryant Barry be re-appointed. Randy Gaston was also recommended as alternate to Board of Adjustment in place of Art Harris. Councilman Simmons made a motion to appoint the above members, seconded by Councilman Martin, all in favor. Mayor stated he would be holding a meeting with builders and developers. Refuse committee is still conducting study on refuse collection. John Deer backhoe needs repairs in excess of $500.00. Council approved. Lights out on field at Park needs repair. Council a. oved.
