08-28-1984 (City Council) Minutes CITY COUNCIL MEETING MINUTES AUGUST 28, 1984 7:00 P. M. The Wylie City Council met in regular session on Tuesday, August 28, 1984 at 7:00 P. M. in the Council Chambers at City Hall . Mayor Akin presided. A quorum was present and notice of the meeting had been posted for the time and in the manner required by law. Those in attendance were Mayor John Akin, Mayor Pro Tem Don Hughes, Councilmembers Percy Simmons, William Martin, Cleo Adams, City Manager Gus Pappas, City Secretary Carolyn Jones, C. E. O. l& P. W. D. Roy Faires, Scott Dorsey from Wylie News, Don Kreymer, Joe Georg ei, Ri'ck St. John, and other Citizens. Councilmember Gail Wallace was absent,.' Mayor Akin called the meeting to order and Councilmember Martin gave the invoca- tion. Approval of Minutes: There being no corrections or addition, a motion was made by Mayor Pro Tem Hughes to approve. Seconded by Councilmember Adams. All in favor. Final Public Hearing on the Annexation of 46.539 Acres out of Francisco De La Pina Survey: This property is located East of Paul Wilson Road, commonly known as the Masourd Property. Mayor Akin opened the public hearing. There being no questions or opposition, the public hearing was closed and this item returned to the Council table. Motion was made by Councilmember Adams to approve the annexation and prepare the Ordinance. Seconded by Councilmember Simmons. All —`� in favor. First Public Hearing on Annexation of 33.117 Acres out of Francisco De La Pina Survey: This property is located on Old Highway 78 and is commonly called East Ridge Addition. Mayor Akin opened the public hearing. There being no questions or opposition, the public hearing was closed and this item returned to the Council table. Motion was made by Mayor Pro Tem Hughes to approve the first step toward annexation. Seconded by Councilmember Martin. All in favor. First Public Hearing on Annexation of 10 Acres out of William Sachse Survey: This property is located on West FM 544 and is a part of Steel Industrial Park. Mayor Akin opened the public hearing. There being no questions or opposition the public hearing was closed and this item returned to the Council table. Motion was made by Councilmember Adams to approve first step of annexation. Seconded by Councilmember Simmons. All in favor. Public Hearing on Re-Zoning of Trailsplace: This property is located between Park Street and Stone Road. There is approximately 5.54 acres and the present zoning is MF. The request for zoning is to change to Planned Develop- ment. City Manager Gus Pappas reviewed the plat and site plans. There was a lot of study given to the drainage ditch that runs through this property. City engineer and City Manager met and made a request to Mr. Joe George to put a 5 X 5 pad up next to the culvert to help prevent erosion. According to Mr. George these buildings will be sold to investors. Mayor Akin opened the public hearing. There being no questions or opposition, the public hearing was closed and this item returned to the Council table. Councilmember Martin wanted to know if the association agreement was a part of the deed. City Manager Gus Pappas said this agreement would be attached to the deed. Motion was made by Maoyr Pro Tem Hughes to approve the zoning request. Seconded by Councilmember Martin. All in favor. Approve and Sign Zoning Ordinance for Trailsplace: Motion was made by Mayor Pro Tem Hughes to approve and sign Ordinance. Seconded by Councilmember Martin. All in favor. Authorization to Issue Certificate of Occupancy for House in Rush Creek II : This house is located on Lot 14 and in the beginning of this development, was a part of phase one. When the final plats were drawn this lot was put in phase two. All City utilities are in the house and Texas Power and Light should have the electricty in within a few days. The streets are in. Staff recommends this house be issued the C.O. . Councilmember Martin wanted to know if this was a variance. City Manager Gus Pappas said it was not a variance. Motion was made by Mayor Pro Tem Hughes to grant authorization for certificate of occupancy. Seconded by Councilmember Martin. Three (3) in favor, and Councilmember Simmons was opposed. Approval of Plat for Trailsplace: Motion was made by Councilmember Simmons to approve. Seconded by Councilmember Adams. All in favor. City Manager Gus Pappas addressed the drainage ditch problem thorughout the City. These ditches are leaving the City open for liability toward property owners in regards to erosion and flooding. City Manager Gus Pappas said he was working with Mr. Santry and the City Attorney to correct this problem. The one drainage ditch in the City that is in the best of conditions is the one running through Trailspalce. Mr. Roy Faires said there was a problem with kids using the ditch in Trailsplace as a bike path and this is breaking down the ditch. Mr. Joe George said he was aware of this problem and would not object to the City posting no ... trespassing signs. Council Discussion: Mayor Pro Tem Hughes wanted to know if all the mowing was being done. Mr. Faires said that Highway 78 right of way was mowed on Tuesday (8-28-84) and Westwind Meadows Park mowing was started the same day. The Cottonbelt Railroad property would be mowed on Wednesday and the Cottonbel't Railroad would be billed for this. Councilmember Martin wanted to know if City Manager and City staff was working with Emogine Westphal with the driveway and culvert problem. City Manager responded yes, he had been talking with her for several months. The drainage ditch has been cleaned out and the water flows through. Mrs. Westphal feels the City should replace the broken culvert. The pipe was not put in the ground, it was just laid on top and rock put over it. When cars drive into the driveway, over a period of time, it has caused the pipe to break. This is a short pipe and could be replaced. Mayor Akin 'would like the City to go-ahead and replace this culvert. Councilmember Martin wanted a follow up report on the garage sale on S. Second Street. Mr. Faires said the property owners were going to open for four (4) more days and then close down. They are aware that they can only have two garage sales in one year. The property owners are considering opening a retail store at this location, but they have been informed that a retail store has to be contained within the building and not in the front yard. Councilmember Adams reported a culvert on Brown Street, just east of the nursing home needs repair. This culvert has settled and made a low place in the road. Councilmember Adams said there was not going to be another water line laid for Middle School and wants the City to go ahead with lowering the meter. Mayor Akin responded to Councilmember Adams concern about the turning from Highway 78 onto Ballard and from Ballard onto Highway 78 for trucks. There is a problem, but in checking the other streets, there just isn't another truck route at the present time. Mayor Akin would like to see a study done on this problem and check to see what other routes may be made available. Motion was made by Councilmember Martin to convene into Executive Session under the authority of Article 6252-17 of Vernon's Annotated Civil Statutes Section 2 paragraph (g) "Personnel Matters". Seconded by Mayor Pro Tem Hughes. All in favor. Motion was made by Mayor Pro Tem Hughes to reconvene into open session. Seconded by Councilmember Adams. All in favor. The following list of names were submitted to City Staff to contact on serving as a member of the 15 member Home Rule Charter Committee: C. Truett Smith, 0. W. Hampton, David Stephens, Jerry Davis, James Blakey, Geline Dodd, Carol Barry, Judy Trimble, Richard Sewell , John Seeley, Jayne Chapman, Perry Robinson, Ray Mullins, Joe George, Manly Head, Dewayne Boyd, Carey Gooch, Jerry Buchanan, Roy Randolph and Dennis Kauffman. Motion was made by Mayor Pro Tem Hughes to call the names on the above list about serving on the Home Rule Charter Committee. Seconded by Councilmember Martin. All in favor.
