09-11-1984 (City Council) Minutes CITY COUNCIL METTING MINUTES SEPTEMBER 11 , 1984 7:00 P. M. The Wylie City Council met in regular session on Tuesday, September 11 , 1984 at 7:00 P. M. in the Council Chambers at City Hall . Mayor Akin presided. A quorum was present and notice of the meeting had been posted for the time and in the manner required by law. Those in attendance were Mayor John W. Akin, Mayor Pro Tem Don Hughes, Councilmembers Percy Simmons, William Martin and Cleo Adams, City Manager Gus Pappas, City Secretary Carolyn Jones, C. E. 0. & P. W. D. Roy Faires, Chief Abbott, Brian Chaney, Elayne Mayes and Scott Dorsey from the Wylie News, Fred Ouellette,Truett Smith, Mike Rawlings, John Seeley, Wayne Turner, Bob Vincent and other citizens. Councilmember Gail Wallace was absent. Mayor Akin called the meeting to order and gave the invocation. Approval of Minutes: Motion was made by Mayor Pro Tem Hughes to approve as written, seconded by Councilmember Adams. All in favor. Approval of Ordinance establishing Home Rule Charter Commission: The Home Rule Charter Commission will consist of fifteen (15) citizens of Wylie, with Mr. Truett Smith as Chairman. Motion was made by Mayor Pro Tem Hughes to approve and sign ordinance. Seconded by Councilmember Adams. All in favor. Approval of Annexation Ordinance for 1 .00 Acres out of William Sachse Survey: This property is located on West FM 544 and is part of the Steel Industrial Park. Mr. William Springer has requested annexation and all public hearings have been held. Motion was made by Councilmember Adams to approve and sign annexation ordinance. Seconded by Councilmember Simmons. All in favor. Approval of Annexation Ordinance for 1 .00 Acres out of William Sachse Survey: This property is located on West FM 544 and is part of Steel Industrial Park. Mr. B. C. Covington has requested annexation and all public hearings have been held. Motion was made by Councilmember Martin to approve and sign annexation ordinance. Seconded by Mayor Pro Tem Hughes. All in favor. Final Public Hearing on Annexation of 33.117 acres out of Francisco De La Pina Survey: This property is located on old Highway 78 and is commonly known as East Ridge Addition. Mayor Akin opened the public hearing. There being no questions or opposition the public hearing was closed and this item returned to the Council table. Motion was made by Councilmember Adams to approve annexation and prepare the ordinance. Seconded by Councilmember Simmons, all in favor. Final Public Hearing on Annexation of 8 Acres out of William Sachse Survey: This property is located on West FM 544 and is part of Steel Industrial Park. Mr. Dave Williams requested annexation. Mayor Akin opened the public hearing. There being no questions or opposition, the public hearing was closed and this item returned to the Council table. Motion was made by Councilmember Adams. Seconded by Councilmember Martin. All in favor. Public Hearing on Re-Zoning of Tract 21 out of E. C. Davidson Survey from SF 2 to B-1 : This property is located on Martinez Lane and is directly behind the lot that was re-zoned B-1 recently. Mayor Akin opened the .--w public hearing. There being no questions or opposition the public hearing was closed and this item returned to the Council table. Motion was made by Mayor Pro Tem Hughes to approve the re-zoning of this tract to B-1 . Seconded by Councilmember Adams. All in favor. Approval Zoning Ordinance for Re-Zoning Tract 21 out of E. C. Davidson Survey:Motion was made by Councilmember Adams to sign and approve Zoning Ordinance for re-zoning this tract of land to B-1 . Seconded by Mayor Pro Tem Hughes. All in favor. Public Hearing on Zoning of Steel Industrial Park: This property is located on West FM 544 and consists of 46.73 acres of land belonging to several owners. Mayor Akin opened the public hearing. Mayor Akin recognized Mr. Fred Ouellette. Mr. Ouellette lives on Woodhollow Drive in Wylie. Mr. Ouellette wanted to know the intended use of this property. Is there any control on Industrial zoning in the City of Wylie. City Manager Gus Pappas said the City of Wylie only has one type of Industrial Zoning. If the zoning was categorized, the industrial zoning would be light industry. The City of Wylie does not allow heavy industry. The types of businesses that already exist before this area was annexed are plumbing shop, glass shop and a building warehouse. Mayor Akin assured the public the City does have control over what goes in this Industrial Park. Motion was made by Councilmember Adams to approve the zoning of this park as Industrial . Seconded by Councilmember Martin. All in favor. Approve and Sign Zoning Ordinance on the Steel Industrial Park: There are five (5) property owners who have requested Industrial zoning. They are as follows: 37.730 acres - M. Britton, 5.0 acres - David Williams, 2. acres - A. P. Willis, 1 . acre - B. C. Covington, 1 . acres - W. E. Springer. Motion was made by Mayor Pro Tem Hughes to approve and sign the zoning ordinances for these property owners. Seconded by Councilmember Adams. All in favor. Public Hearing on Proposed Tax Rate for Fiscal Year 1984-85: Mayor Akin stated that the proposed tax rate for the fiscal year 1984-85 is the same tax rate as 1983, which is 49¢ per $100.00. Mayor Akin opened the public hearing. There being no questions or opposition, the public hearing was closed. Mr. Fred Ouellette said he would like to make a comment. The increase in annexation and sales tax the City should be able to reduce the tax rate. If the City would reduce the budget the tax rate could be reduced. Mayor Akin asked if there was any other comments before leaving this item. The next public hearing for the tax rate will be September 25, 1984 at 7:00 P. M. in the Council Chambers. Public Hearing on the Proposed Budget for Fiscal Year 1984-85: Mayor Akin opened the public hearing. Mr. Fred Ouellette would like to go through part of the budget if the Council would allow him to do so. Mr. Ouellette said he had gone through the budget line item by line item. Would someone explain the reason for Food and Ice being a line item on the budget. City Manager Gus Pappas said this goes for the annual Council Dinner after the election in April . It also goes „0.1% for coffee at meetings, and for the staff. There is also ice and water on each City truck in the fields for the City crews. There is a clean up day in the spring, at which the City furnishes drinks for any one who works. Mr. Ouellette then asked about the Council Reserve. What is it for. It is a line item which no one has authority to spend, City Manager Gus Pappas said. Mr. Pappas also stated this would be placed in a separate fund and draw interest and would only be used for an emergency that might come up and was not budgeted. Mayor Akin said this was the first year the City of Wylie did not have to go to the Bank and borrow money to complete the fiscal year. City Manager Gus Pappas said this was not a padded budget. Mr. Ouellette asked who the City Engineer was and why was engineering in each department. City Manager Gus Pappas said the City Engineer was I. W. Santry and his expenses were budgeted in each department in order to track the engineering cost better. Mr. Ouellette wanted to know if the new Public Works Director could do the engineering for the city. City Manager Gus Pappas said you can not hire a certified engineer for $30,000. and expect him to also over see the public works department. Mr. Ouellette wanted to know why the City paid a tax appraisal fee and a computer service for taxes. The State of Texas made it a law for each City to hire a central appraisal district for doing all the appraisals. The computer service is for the tax statements and the posting of payments. Mayor Akin asked if there were any other questions on the budget. There being no other questions or comments, the public hearing was closed. Mayor Akin said the next public hearing on the proposed 1984-85 budget would be September 25, 1984 at 7:00 P. M. in the Council Chambers. Acceptance of Land Dedication for Rush Creek Lift Station: Mr. Roddy Groves and his wife have reached an agreement with the City of Wylie for a land dedication which is necessary to construct our major lift station. Motion was made by Mayor Pro Tem Hughes to accept the land dedication. Seconded by Councilmember Adams. All in favor. Approval of Authorization to Sign Contract for the Collection fo Delinquent Taxes: Motion was made by Councilmember Adams to sign a contract with the law firm in Austin which the City has used for several years. Seconded by Councilmember Simmons. All in favor. ', pproval of Final Plat for "The Meadows" Addition: City Manager Gus Pappas said he had talked with the City Engineer and all correctons have been made to this final plat. Motion was made by Mayor Pro Tem Hughes to approve and sign the final plat for construction. Seconded by Councilmember Simmons. All in favor. Approval of Bills Paid/Accounts Payable: Motion to approve the bills paid and accounts payable was made by Mayor Pro Tem Hughes. Seconded by Councilmember Simmons. All in favor. Approval of Bank Reconciliation Statements: There being no questions, motion was made to approve by Councilmember Simmons, seconded by Councilmember Adams. All in favor. Approval of Budget Report: Motion was made by Councilmember Adams to approve the budget report. Seconded by Mayor Pro Tem Hughes. All in favor. Departmental Reports: All departmental reports were accepted as submitted. Citizen Participation: Mrs. Rosa Sera wanted to know what it would cost for sewer and water to be brought to the lots on Martinez Lane. City Manager Gus Pappas said he was under the impression that the other property owners were getting together and making this request. City Manager said he would be happy to meet with them and give them an estimated cost for water and sewer. Wayne Turner wanted to talk about the sewer lines from the main to the property lines. Mr. Turner said the City did maintain from the property line to the main then it was changed from house to main was for the property owners to maintain. Mr. Turner wants to know which is the correct policy. Mayor Akin .— responded to the question with the statement that this was a problem which the Council was trying to work out and create an ordinance to help prevent this from coming up again. Mayor Akin said that Council and himself are trying to work out this problem, but there are three concerns: 1 . is the citizens and the expense to them, 2. if the City maintains from property line to main the extra expense to tax payers, 3. plumbers think the City is taking away their business. Council Discussion: Mayor Pro Tem Hughes requested a report on the alley behind Chapman's on the abandonment of same. City Secretary Carolyn Jones said the City Attorney Larry Jackson had the papers and is taking care of this. Mayor Pro Tem Hughes requested someone take a look at the drainage problem in front of Chapman's. Councilmember Martin wanted to thank the people for taking care of the early problems. Councilmember Martin also stated his appreciation to the City Manager Gus Pappas for this presentation at the Chamber Coffee on the City's proposed budget. Councilmember Martin is also pleased with the street patching that has been done during the summer. Councilmember Adams said there is a weedy lot --302 W. Oak that needs to be taken care of. C. E. 0. Roy Faires said the letter has already been delivered ."1114ro to the property owner. Motion was made by Councilmember Martin to adjourn. Seconded by Councilmember Simmons.
