MINUTES
DECEMBER 11 , 1984
7:0 0 P. M.
The Wylie City Council met in regular session on Tuesday ,
December 11 , 1984 at 7 : 00 P.M . in the Council Chambers at
City Hall . Mayor Akin presided . A quorum was present and
notice of the meeting had been posted for the time and in
the manner required by law. Those present were Mayor John
Akin , Mayor Pro Tem Don Hughes , Councilmembers Percy
Simmons , William Martin , Cleo Adams , and Joe Fulgham, City
Manager. Gus Pappas , City Secretary Carolyn Jones , Public
Works Director Bill Windham, Code Enforcement Officer , Roy
Faires , Chief Royce Abbott , Fire Chief Mike Rawlings , Fire
Chief Larry Allen , Gary Roddy , and other citizens .
Mayor Akin called the meeting to order and gave the
invocation .
APPROVAL OF MINUTES : Notion was made by Councilman Martin to --
approve minutes as submitted . Seconded by Councilman Adams ,
all in favor .
APPROVAL OF ANNEXATION ORDINANCE CE ON 48. 816 ACRES OUT OF THE
ALLEN ATTERBURY SURVEY , ABSTRACT NO. 23 : This property is
located on S . Ballard St . adjacent to the new water tower .
Motion was madeby Councilman Simmons to approve and sign
annexation ordinance for the above property . Seconded by
Councilman Martin , all in favor .
PUBLIC HEARING - ZONING OF 48 . 816 ACRES OUT OF ALLEN
ATTERBURY SURVEY, ABSTRACT ITO. 23 This property is located
on S . Ballard St . adjacent to the new water tower . This
property is commonly known as Southpiace Addition . The
request for zoning is B-1 , '3-2 , and Single Family 2 . Mayor
Akin opened the public hearing , and asked if any of the
citizens would like to comment . There were no citizens , but
Mr . Gary Roddy , one of the developers , said they were
requesting Single Family 2 in order to have smaller lots and
to help keep the price of the lots and homes down . Mr .
Roddy will have deed restrictions on these lots which will
state there has to be 1400 sq . ft . of living area. The
other areas are for Business 1 and Business 2 are being
requested due to the area belonging to Lone Star Gas
Company , on which there is equipment . There being no
questions or opposition , the public hearing was closed .

rayor Pro Tem Hughes wanted to know if Alanis was in
connection with this property . City Manager Gus Pappas said
it was approximately 300 feet south of the new fire station
where Alanis would cone through . City !`;onager Gus Pappas
also said at the Plannin , and Zoning meeting , some of the
residents did not want to see business areas on this
property . Councilman Simmons wanted to know if this
creates spot zoning . City :ddanager Gus Pappas said on the
single family area no , but there would be a questions on the
commerical area . If you take one lot and re—zone it , this
does create spot zoning , but when you take large lots it
could be done without questions .
Er . Roddy said when you loot: at the appraisal of a home it
has less' value placed on it when it is located on a busy
road and Sachs° road is very busy . Also , the Lone Star Gas
equipment and water tower and fire station will lower the
appraisal of these homes .
'.1ayor Pro Tem Hughes wanted to know if Business 2 would
continue down Sachse Road toward Alanis , or would it he
zoned single family .

Southplace Addition as follows , south of the Lone Star Gas
equipment , Business 2 from Sachse Road back 350 ft . to end
of property , Business 1 for the lots north of the gas
equipment fronting Sachse Road , and Single Family 1 for the
remainder . Seconded by Councilman Martin , all in favor .

property is located on F '1 544 just west of South Highway 78 .

zoning is Industrial . Hayor Akin opened the public hearing ,
there being no questions or opposition , the public hearing
was closed .
APFROVAE AND SIGN ZONING ORDINANCE ON 0 . 146 ACRES OUT OF
B. C. DAVIDSON SURVEY,, ABSTRACT NO. 266 : There being no
questions from the council table , motion was made by
Councilman FulChar to approve . Seconded by Councilman
Adams , all in favor .

PUBLIC HEARING - (FINAL) ANNEXATION OF 2 ACRES OUT OF
WILLIAM SACIISE SURVEY , ABSTRACT NO. 835 : This property is
located on FM 544 and is a part of Steel Industrial Park .
Mayor Akin opened the public hearing , there being no
questions or opposition , the public hearing was closed .
PUBLIC HEARING - (FINAL) ANNEXATION ON 0. 99E ACRES OUT OF
THE WILLIAM SACIISE SURVEY , ABSTRACT NO. 835 : This property
is located on FM 544 adjacent to Steel Industrial Park.
Mayor Akin opened the public hearing , there being no
questions or opposition , the public hearing was closed .
ACCEPTANCE OF UTILITY EASEMENT FROM L. E. /WYLIE PROPERTIES :
This easement has been granted to the City in order for the
water lines to be laid for the new ground storage tank .
Motin was made by Councilman Simmons to accept this
easement . Seconded by Councilman Martin. All in favor .
APPROVAL OF CONTRACT TO LEASE CITY LANDFILL: City Manager
Gus Pappas said there has been no response from Moore
Industrial on this lease agreement . Notion to table this
item was made by Councilman Simmons . Seconded by Councilman
Adams , all in favor .
AWARD BID FOR POLICE CAR: The City received three bids for
this polic car which are :
Tomes Ford $11 , 092 . 32
Lakeside Chev . $10, 993 . 18
Carter Chev . $10, 995 . 00
Staff recommends awarding the bid to Carter Chevrolet .
Motion was made by Councilman Fulghman to award bid to
Carter Chev . Seconded by Councilman Martin . All in favor .
APPROVAL OF BILLS PAID AND ACCOUNTS PAYABLE: Motion was
made by Councilman Simmons to approve bills paid and
accounts payable with the exception of Speed Fab , which is
to be called about . Seconded by Councilman Adams . All in
favor .
DEPARTMENTAL REPORTS : All departmental reports were
accepted as submitted .
GENERAL COUNCIL DISCUSSION : Councilman Simmons said the
Fire Marshal reported he was not getting called to inspect
building plans before permits were being issued . City
Manager Gus Pappas said he had talked with the Fire Marshal

this date and the problem has been taken care of .
Councilman Simmons wanted to know if the Construction Board
had been called about a meeting and if so when was the
meeting . Code Enforcement Officer boy Faires said the
meeting had been set for January 14 , 1985. Councilman
Simmons wanted to know if the Code Enforcement Officer had
checked out the wrecking yard next to ?usinn Truss . City
;Manager said this would be done if it has not already been
done .
ayor Pro Tem hughes wanted to compliment the staff on the
Christmas party for the city employees . Also wanted to know
if any of the council had roeieved circulars in their door
about a sale in a home on Driarwood . hayor Pro Tem Hughes
wanted to know if this could be checked out , since there
sitouic, not be a business in a residential area .
Councilman Fu_i gham said a man at 109 S . Birmingham called
him and said a man in a City car was looking through
binoculars and when the man asked what the City employee was
doing the car left . City Manager Gus Pappas said he would
look into this , but sometimes it was possible for the code
enforcment officer to be using binoculars .
Is the Construction Board taking the place of the Electrical
!;oard . City Manager Gus Pappas said yes , but is does more
than just electrical . Also , Councilman Fulgham wanted to
know if a man had taken the electrical test and needed a few
points to pass . City Manager Gus Pappas said that Mr .
Faires uses test that are made up by an electrical
instructor in Garland . fes , a man did take the test and has
come to Mr . gaires in protest due to the fact he needed a
few points to pass . This problem has been worked out .
Councilman :Martin wanted to compliment the staff on the
Christmas party . Also , at Steel Industrial Park there has
been a camp area or mobile home park opened up . City
Manager Gus Pappas said this is not a pert of Steel
Industrial Park , but that a Er . Roy Jacobs owns this
property . IIe has a water tap from North Texas :Municipal
'Dater District , but has begin to sell water to several
property owners . When :ETIUD found out about Er . Jacobs
selling water to others , they have informed him of pulling
his water meter . .,'hers ' TMWD pulled this meeter , it has left
several people without water , including Steel Industrial
Park. because the City knew this was going to happen , r

County health Officer and will continue to make these
coapalints until this has been cleaned up . If Mr . Jacobs
request annexation and water service , the staff would
recommend that it be refused , due to the pre—existing clause
in annexation .

iayor Akin wanted to know if there had been a response from
the people west of town on the new water lines . City hanger
Gus Pappas said a letter committing Wylie Lake Ranch plus a
check for this area has been received , also a letter from
i iortex Nursery stating they were willing to pay their share .
hayor Akin wanted to !. now if there was a need for the second
meeting in December . City Nanager Gus Pappas said if there
was a meeting it would be to act on the pending annexations
that could have the ordinances signed .
iiayor Akin also commented on the Tree Lighting and the
Christman Parade and stated that it was the best the City
has had in some time . Mayor Akin thanked Carolyn Jones ,
;layne Hayes , and i t ';;rs , Wacefied for their work of
these two programs .
Mayor Akin also asked about the ground storage tanks . This
company is moving along , Pr .Uindham has already received the
tie down bolts . Sometimes next week the City crew will
begin preparing the site for the pouring of the pad .
City i•ianager Gus Pappas said the Charter is printed and
labels are on the envelopes and some have been stuffed .
Should be ready for mailing in a few more days .
